The extent to which confidentiality debars disclosure or inspection of documents, or an award or associated document, in arbitration proceedings has long fuelled debate within the law reports.

This has been the case in three differing contexts:

  • Applications to the court by a non-party (A) for sight of documents from an arbitration between B and C: see, for example, Dolling-Baker v Merrett , London and Leeds Estates Ltd v Paribas Ltd No (2) , and Glidepath BV v Thompson .
  • Applications to the court or to an arbitral tribunal by party A as against party B for permission to use in arbitration or court proceedings (between A and C) documents from the arbitration between A and B: see, for example, Ali Shipping v Shipyard Trogir  and Emmott v Michael Wilson & Partners Limited .
  • Publication and anonymisation of documents and determinations in arbitral applications before the courts (for example, challenges under sections 24 , 68 and 69 of the Arbitration Act 1996 (AA 1996) ): see, for example, City of Moscow v Bankers Trust Co  and Symbion Power LLC v Venco Imtiaz Construction Company .

Two very recent decisions ( The Chartered Institute of Arbitrators v B and others  and Cape Intermediate Holdings Ltd v Dring , which focus, directly and indirectly, upon the first and third contexts above) illustrate that the requirement of confidentiality in arbitration may be diluted (or third party access to court documents may be permitted) where that is justified by considerations as to the “interests of justice”.

First, in The Chartered Institute of Arbitrators v B and others , the Chartered Institute of Arbitrators (CIArb) appointed an arbitrator in a dispute between A and B at the request of A. B made an application under section 24(1)(a) of the AA 1996 for the removal of the arbitrator on grounds of bias. That was granted. Independently, the CIArb had commenced disciplinary action against the same arbitrator further to a complaint from a third party (also alleging bias and improper conduct).

In order to facilitate its disciplinary proceedings, the CIArb made two applications to the court under the CPR : for copies of documents relating to the section 24 application by B (that is, statements of case, witness statements , written submissions and skeleton arguments), and for permission to rely on the same.

The court (per Moulder J) granted the applications.

As to access, Moulder J observed that non-parties have an express right to sight of statements of case and any judgment or order made in public in court proceedings (per CPR 5.4C(1) ), whereas non-party access to other documents can only be permitted under the court’s discretion, and only where such documents are considered to be on the court record.

In the latter regard, the court determined that it must strike a balance between preserving confidentiality and the interests of open justice, whether there is a legitimate interest on the part of the party seeking the documents, the reasons for seeking to preserve confidentiality, and any harm that might be caused by non-party access. Given that the disciplinary process against the arbitrator would be barred unless the documents were made available to the CIArb, access to the documents was therefore necessary in the interests of justice. As to the approach under CPR 5.4C, the court relied upon Cape Intermediate Holdings Ltd v Dring ; as to the wider question of overriding arbitral confidentiality, the court relied upon Ali Shipping , Glidepath , Emmott , and City of Moscow .

As regards reliance on the documents, the court granted declaratory relief under CPR 3.10 on the basis that this furthered the overriding objective in the CPR (applying Rolls-Royce Plc v Unite the Union and LD Commodities Rice Merchandising LLC and another v The owners/charterers of the vessel Styliani Z ).

Second, in Cape Intermediate Holdings Ltd v Dring , the Supreme Court confirmed the approach of the Court of Appeal to access to documents under CPR 5.4C (which was the approach adopted by Moulder J in the CIArb case above) and further emphasised the breadth of the courts’ inherent discretion as to access.

In this regard, the court observed that, for the purposes of CPR 5.4C, “records of the court” connotes only documents and records that the court holds for its own purposes. It does not indicate every single document generated in connection with a case and filed, lodged or kept at court.

However, Lady Hale went on to emphasise that (beyond CPR 5.4C, and pursuant to the principle of open justice), unless inconsistent with statute or rules of court, all courts and tribunals exercising the judicial power of the state have an inherent jurisdiction to determine what open justice requires in terms of access to documents or other information. In principle, the public should be allowed access not only to written submissions and arguments, but also to documents placed before the court and referred to during the hearing. This should not be limited to those which the judge has been asked to read or has said he or she has read. However, an application for access requires the kind of balancing undertaken in the CIArb case.

Thus, the Supreme Court (in a case which was not concerned specifically with arbitration) expanded the scope for overriding the confidentiality of arbitral documents which derive from court proceedings (by indicating that it may be possible for a third party to obtain sight of and to rely upon documents which are beyond those which are “records of the court” for the purposes of the CPR).

Accordingly, these recent decisions continue the trend under English law to acknowledge that arbitral confidentiality is not an absolute bar to disclosure of or access to arbitral documentation. Moreover, they emphasise that third party access to documents generated in arbitral applications before the courts remains possible, despite confidentiality, where an appropriate and sufficient interest can be made out; and such access is not limited by the wording of the CPR.

Trump’s Trial Has Entered Its Final Stages. Here’s What Comes Next.

Closing arguments start Tuesday in the Manhattan hush-money trial of Donald J. Trump, signaling the final stages of the first criminal trial of an American president. Both prosecutors and defense lawyers will make their final cases for his guilt or innocence before jurors deliberate Mr. Trump’s fate.

In closing arguments, both sides will have more freedom than in opening statements as they work to persuade jurors of their interpretations of the facts that were presented at trial. While opening statements are restricted to evidence, the prosecution and the defense will use closing arguments to argue how and why the evidence, testimony and law support a specific verdict.

Closing arguments are expected to last for most or all of Tuesday and perhaps beyond. After closing arguments, the judge, Juan M. Merchan, will provide instructions to the 12 members of the jury that are meant to guide their deliberations. Lawyers on both sides tried to shape and, in some cases, limit the instructions during a conference with Justice Merchan last week.

From there, the case will be in the hands of the jurors, who will consider whether prosecutors proved beyond a reasonable doubt that Mr. Trump was guilty on all, some or none of the 34 felony counts with which he has been charged.

The charges stem from a $130,000 payment made by Mr. Trump’s former fixer and personal lawyer, Michael D. Cohen, in the days before the 2016 election to silence Stormy Daniels, a porn star who said she had sex with Mr. Trump a decade earlier. Prosecutors say Mr. Trump sought to cover up the sex scandal because he believed it would derail his campaign.

In 2017, after Mr. Trump had been elected and was in the White House, Mr. Cohen was reimbursed, and prosecutors have argued that Mr. Trump falsified business records to try to conceal the hush-money deal and the repayment.

The counts have been charged as felonies, because prosecutors say that the former president falsified business records to conceal a second crime . That, they have argued, was a violation of New York’s election law. (Prosecutors do not have to prove beyond a reasonable doubt that Mr. Trump committed the election crime.)

During deliberations, Mr. Trump is required to be at the courthouse in Lower Manhattan. After deliberations, which could last hours, days or weeks, the jurors can return a range of verdicts — guilty or not guilty on all counts; guilty of some and not others; and a failure to reach a verdict on some counts or even all.

If jurors can’t reach a decision at all, the judge would declare a mistrial — and prosecutors could bring the case again.

The jury’s verdict will be handed to Justice Merchan, who will review the decision before handing it back to the jury foreperson to read the outcomes out loud in the courtroom.

If Mr. Trump is found guilty of any count, he would be sentenced at a hearing scheduled for a later date. The 34 counts are all Class E felonies, the lowest level in New York State. They each carry a sentence of up to four years in prison.

If Mr. Trump were to be convicted of more than one count, Justice Merchan would likely impose a concurrent sentence, under which Mr. Trump served all prison time simultaneously. Mr. Trump could also be sentenced to probation.

Further, Mr. Trump would undoubtedly appeal any conviction, a process that could take months or longer.

(Reuters) - A senior member of a Russian think tank whose ideas sometimes become government policy has suggested Moscow consider a "demonstrative" nuclear explosion to cow the West into refusing to allow Ukraine to use its arms against targets inside Russia.

The proposal, by Dmitry Suslov, a member of the Moscow-based Council for Foreign and Defence Policy, was issued a day after President Vladimir Putin warned the West that NATO members in Europe were playing with fire by proposing to let Kyiv use Western weapons to strike deep inside Russia, something he said could trigger a global conflict.

Ukraine's leadership says it needs to be able to strike Russian forces and military targets inside Russia with long-range Western missiles to be able to defend itself and prevent air, missile and drone attacks, a view which has found some support among some Western countries but not yet with Washington.

Russia, which possesses the world's largest nuclear arsenal, has warned it would view such a step as a grave escalation that would pull NATO and the countries concerned into a direct conflict with Moscow, increasing the risk of nuclear war.

Suslov, a member of the Council for Foreign and Defence Policy, a think tank praised by Putin who has said the authorities sometimes pick up its policy ideas, said Russia needed to act to dissuade the West from crossing a red line.

"To confirm the seriousness of Russia's intentions and to convince our opponents of Moscow's readiness to escalate, it is worth considering a demonstrative (i.e. non-combat) nuclear explosion," Suslov wrote in business magazine Profil.

"The political and psychological effect of a nuclear mushroom cloud, which will be shown live on all TV channels around the world, will hopefully remind Western politicians of the one thing that has prevented wars between the great powers since 1945 and that they have now largely lost - fear of nuclear war."

Suslov is the latest Russian security expert and lawmaker to argue that Moscow should test a nuclear bomb to intimidate amid the Ukraine war, fuelling fears among Western security experts that Russia may be inching towards such a test.

Such a move, if it did happen, could usher in a new era of big power nuclear testing.

There was no immediate comment on Suslov's proposal from the Kremlin, which has said Russia's nuclear policy remains unchanged while signalling its displeasure with what it cast as increasingly aggressive Western rhetoric on arming Kyiv earlier this month by ordering tactical nuclear weapons drills.

NUCLEAR TEST?

Suslov suggested Russia also initiate strategic nuclear exercises, warn any country whose weapons are used by Kyiv to attack Russia that Moscow reserves the right to strike that country's targets anywhere in the world, and warn it could use nuclear weapons if that country then retaliates conventionally.

Putin in November signed a law withdrawing Russia's ratification of the global treaty banning nuclear weapons tests, a move he said was designed to bring Russia into line with the United States, which signed but never ratified the treaty.

Russian diplomats said at the time that Russia, which has not carried out a post-Soviet nuclear test, would not resume nuclear testing unless Washington does.

The Soviet Union last tested in 1990 and the United States in 1992. Only North Korea has conducted a test involving a nuclear explosion this century.

Russia warned Britain this month that it could strike British military installations and equipment both inside Ukraine and elsewhere if British weapons were used by Ukraine - with London's blessing - to strike Russian territory.

It issued the warning after British Foreign Secretary David Cameron said Kyiv had the right to use UK-supplied weapons to strike targets inside Russia.
