A pharmacist can either run his or her pharmacy business as a Partnership, a Limited Company or as a Sole Proprietorship.

Please keep in mind that:

  • In order for your Pharmacy business to be run as a Limited Company or Sole Proprietorship, the Superintendent Pharmacist, must be the majority shareholder in the business and must have proof of said majority shareholding in the form of an affidavit.
  • The premises for your Pharmacy can only either be registered as a Retail Pharmacy business or as a Wholesale Pharmacy business NEVER as both. If you wish to operate both, you will have to apply for the registration of two separate premises. Each must have its own designated Superintendent Pharmacist.
  • The registration after approval, will automatically expire on the 31st of December in the year it was issued. If you do not renew it before or by the 31st of December, your premises registration will become null and void.

Requirements For Your Pharmacy’s Premises

  • The floors and walls of your Pharmacy’s premises, must be made of waterproof and washable materials.
  • The ceiling must be covered with a finish that is non-flaking and that also allows for easy cleaning.
  • Your Pharmacy’s premises must be of a permanent nature.
  • It must be well lit and ventilated.
  • The Pharmacy’s premises must ONLY be used for your Pharmacy business.
  • It must be secure and also protected against water leakage of any kind, pest infestation and bad or sever weather conditions.
  • It must have sufficient space for the efficient execution of all the necessary operations in your Pharmacy.
  • There must be a separate administrative office for the Pharmacist, where prescriptions, purchase records as well as other administrative records will be maintained. It must be situated where the Pharmacist will have a full view of the dispensary.
  • There must be absolutely no overcrowding of the staff and customers at your Pharmacy. This will ensure that the flow of work will continue to be efficient.
  • Over-the-counter drugs must be separated from the Pharmacy only drugs.
  • It must have enough space for the proper storage of cleaning equipment.
  • Psychotropic and narcotic drugs shall be kept in a secure space that is lockable and also fixed.
  • The storage facility must be temperature controlled in order to cater for chemicals and drugs that sensitive certain conditions.
  • All drugs, chemicals and other products must protected from heat, excessive light and moisture.
  • Your dispensary must be at least 8 feet by 10 feet with the General shop area being not smaller than 10 feet by 10 feet.
  • The premises must have running water that is portable as well as adequate waste disposal system(s).
  • It must have good toilet facilities.

How To Apply For Your Pharmacy Premises Registration

Before starting your application, do ensure that you have the following ready:

  • Copies of the Superintendent Pharmaceutical Technologist’s academic certificate. This must also include a copy of a Diploma certificate in Pharmacy.
  • A Copy of the Superintendent Pharmaceutical Technologist’s Enrolment Certificate issued by the Pharmacy & Poisons Board, Kenya.
  • The resignation letter by the Superintendent Pharmaceutical Technologist’s, addressed to his or her previous employer.
  • The Letter of appointment by your Pharmacy business. It must be addressed to the Superintendent Pharmaceutical Technologist.
  • The Floor plan for the Dispensing Room.
  • The Floor plan for the Dispensary.
  • Two (2) coloured passport sized photographs.
  • The Floor plan for the Consultation room.
  • The completed Premises Registration application form. The Application forms is obtainable at the Pharmacy and Poisons Board offices along Lenana Road in Nairobi. It can also be obtained, free of charge, from the nearest branch of the Pharmaceutical Inspectorate Department.

For sole proprietorship you will additionally be needing a Copy of the Certificate of registration of your Pharmacy company name (Form BN/3), from the Registrar of Companies, Attorney General’s office.

For partnerships you will additionally be required to provide a Copy of Certificate of registration of company name (Form BN/3) from the Registrar of companies, Attorney General’s office. You will also need an affidavit.

Please keep in mind that the application for the registration of your Pharmacy premises must be done in writing. Upon putting your application together, the duly signed form along with other relevant documents must be submitted to the nearest Pharmacy and Poisons Board office.

Guidelines For Operating Your Pharmacy Business

  • All records for narcotic drugs must be retained for a minimum of five (5) years and for a minimum of two (2) years for other drugs.
  • You must maintain a patient/prescription recording system that is adequate and suitable. Said patient/prescription must include a prescription record ledger that is up to date and well indexed. A computerized system, patient profile card, or any other approved recording system, can also be added.
  • All Pharmacy records must be available for inspection by the pharmaceutical inspectorate at any time.
  • All records of your stocks include the batch number, source or supplier, quantity received and expiry date, must be maintained.
  • The Pharmacy must not dispense any prescription or sell any Pharmacy-only medicine when the in-house pharmacist is not available.
  • The sale of pharmacy-only medicine and the dispensing of prescriptions must be done under the supervision of the pharmaceutical technologist or pharmacist.
  • The dispensing of prescription-only medicine must only be carried out in compliance with a valid prescription that must be written by a registered Dental Surgeon, Veterinary Surgeon or Medical Practitioner.
  • Your Pharmacy must have and use suitable dispensing labels and containers. Said containers must also be capable of keeping dispensed medicine or drugs in a usable and safe condition.

Required Application Forms For A Retail Pharmacy Business

  • Form 4. This is the application for the Registration of Premises.
  • Annex 1. This is the confidential questionnaire set aside for the Pharmacy’s premises.
  • Form 27. This is the application for annual practice license.

Costs Of Retail Pharmacy Application

Below are the costs of the Retail Pharmacy Application:

  • Annual Practice License – 2,500 Kenyan Shillings.
  • Premises Registration – 5,000 Kenyan Shillings.

Please keep in mind that the above costs apply to both Pharmaceutical Technologists and Pharmacists who a looking to start their own Retail Pharmacy business.

As soon as your application forms and documents have been received, said documents will be evaluated. Upon evaluation you the applicant will then be advised on whether or not, your application was successful. This will be done via writing.

The Pharmacy and Poisons Board during the application evaluation, might also decide to arrange an interview with you the applicant by the Practice Committee of the Board. Once you pass the interview, an inspection of your Pharmacy company’s proposed premises will also be conducted by a pharmaceutical inspector. This will be done in order to further assess the suitability of the premises for use with regards to Pharmacy. The report from the inspection, will also be presented in the prescribed inspection form.

Next the Pharmacy and Poisons Board will either proceed to issue a certificate of registration of premises under part II of the Pharmacy and Poisons Act, Cap 244 Laws of Kenya or in the case of an unsuccessful applicant, advise you the applicant in writing, clearly stating the reason(s) why your application was not successful. You will also be allowed to go over your application, revise and then submit again for consideration.

If you the applicant is able to revise the application and meet all the requirements after resubmitting, your license will be issued with no delay.

If you however still do not meet all the requirements, the proposed premises for your Pharmacy business, will remain unregistered. Furthermore, the file for your application will be closed exactly six (6) months from the date of your initial application.

That these will become more pronounced with the Fourth Industrial Revolution and impact all aspects of the socio-economic and political context of Kenyans cannot be overstated. For the Pharmacy and Poisons Board (PPB), this marks a major turning point for working collaboratively with its stakeholders to drive and embed sustainable innovations in the practice of pharmacy as well as manufacture and trade in health products and technologies. The Board was established in 1957 to guarantee health security and well-being of all Kenyans. It is among the Government of Kenya agencies responsible for delivering the highest standards of health as a basic human right for all Kenyans. This is a key Bill of Rights provision enshrined in the Constitution of Kenya, 2010. Over the years, the Board has continually evolved to deliver on its broad functions. In the present plan period, the Board will focus on the use of modern regulatory science; internationalisation and collaboration; and effective stewardship that is customer-centric to revitalise the pharmaceutical sector and guarantee quality, safety, efficacy and cost- effectiveness of health products and technologies in a dynamic global world.

Pharmaceutical business is one of the most profitable business ventures in the world, and in Kenya. In a single day, the average profit of a single chemist in Nairobi is Ksh 4,000-Ksh20, 000, sometimes it can go up to Ksh 50,000-which means you can make a cool Ksh 1 million per month.

But how do you set up a chemist?

The first thing to do is ensure you have a diploma or degree in pharmacy..you cannot operate a chemist without having qualifications in pharmacy from a recognized academic institution in Kenya.

If you possess the outlined qualification, proceed to Pharmacy and Poisons Board for a license. Then go to your county offices for trading license.

A license and set up capital will require Ksh 600,000-Ksh 2 million.

If you don’t possess relevant qualification, you can partner with someone with the qualification. This requires that you draft a partnership deed and register your partnership company.

Besides, you can register a Pharmaceutical company, which require more licenses.

Below we provide details of how you to start a pharmaceutical company in Kenya.

MINIMUM REQUIREMENTS AND STANDARDS OF PRACTICE

The minimum requirements for premises and standards of practice are contained in the Pharmacy and Poisons Board guidelines for Good Wholesaling and Retail Practices for Pharmaceuticals (see separate document).

HOW TO MAKE AN APPLICATION FOR REGISTRATION OF PREMISES

An application for registration of premises shall be made in writing and upon completion of the prescribed forms. The

PPB/Prem & Wholesale v1.0.doc xduly completed application forms are to be submitted accompanied by the documents prescribed in these guidelines (see the checklists) or any other documents as may be deemed necessary or as may be prescribed by the Board.

Application forms are available at the Pharmacy and Poisons Board offices along Lenana Road in Nairobi. The forms can be obtained, free of charge, from the Pharmaceutical Inspectorate Department.

The requisite application forms for retail pharmacy run by a registered pharmacist are:

  • Form 4 (Application for Registration of Premises)
  • Annexe 1 ( Confidential questionnaire designated for premises to be run by pharmacist)

iii.        Form 27(application for annual practice licence) – This is to be filled where the superintendent pharmacist does not yet hold a valid annual practice licence.

The requisite application forms for wholesale pharmacy are:

  • Annexes 1 ( Confidential questionnaire designated for premises to be run by pharmacist)

iii.        Form 6- Application for a Wholesale Dealer’s Licence

  • Form 27(Application for Annual Practice Licence) – This is to be filled where the superintendent pharmacist does not yet hold a valid annual practice licence.
  • The applicant will specify if, in addition, they intend to carry out the business as importers and or exporters.

  • A wholesale Dealer SHALL BE required to abide with the Good Distribution Practices guidelines set by the Board. Failure to abide by the guidelines may lead to necessary disciplinary action being taken against the affected person(s).

The requisite application forms for retail pharmacy run by an enrolled pharmaceutical technologist are:

  • Form 30 (Application for Registration of Premises for a Pharmaceutical Technologist)
  • Annexe 2( Confidential questionnaire designated for premises to be run by a pharmaceutical technologist)

iii.        Form 29(Application for Licence Practice to Practice as a Pharmaceutical Technologist) – This is to be filled where the superintendent pharmaceutical technologist does not yet hold a valid practice licence.

The completed application form together with the relevant documents indicated in the checklist should be submitted in person to the address below.

Upon submission of the application documents the applicant shall pay a non- refundable application fees as stipulated below (current fees) or as may be prescribed by the Board.

CURRENT APPLICATION FEES STRUCTURE

Retail Pharmacy (applies to both premises for a pharmacist and premises for a pharmaceutical technologist)

  • Annual practice licence Kshs. 2500
  • Premises registration fee Kshs. 5000

Wholesale Pharmacy

iii.        Wholesale dealer’s licence           Kshs. 5000.

PROCESSING OF APPLICATIONS

Upon receipt of the duly filled application forms and documents, the same will be evaluated and the applicant advised in writing on whether the application was successful or not. In conducting the evaluation, the Board may arrange an interview for the applicant (superintendent) by the Practice Committee of the Board. If the interview is successful, an inspection of the proposed company’s premises will be conducted by a pharmaceutical inspector to assess the suitability for the intended business. The inspection report will be presented in the prescribed inspection form.

Having considered all factors and matters relating to the application the Board will either

  • Issue a certificate of registration of premises under part II of the Pharmacy and Poisons Act, Cap 244 Laws of Kenya; or PPB/Prem & Wholesale v1.0.doc xiii
  • Advise the applicant in writing, in case of an unsuccessful application, and clearly state the reason the application was unsuccessful.

In the case of an unsuccessful application, the applicant will be given further opportunity to revise and comply. Where the applicant is able to revise the application and comply with the requirements a licence will be issued: otherwise the premises shall remain unregistered and the file will be closed after about 6 months from the date of initial application.

Nothing in these guidelines shall make it lawful to carry out the business in premises which are not registered even when an application is under process but the license has not yet been issued.

VALIDITY OF REGISTRATION CERTIFICATE AND/ OR WHOLESALE DEALER’S LICENCE

The Certificate for Registration of Premises (Form 33) expires on the 31st day of December of the year it is issued. The Wholesale Dealer’s Licence (Form 7) expires on the 31st day of December of the year it is issued

The Certificate for Registration of Premises for a Pharmaceutical Technologist’s Practice (Form 31) expires on the 31st day of December of the year it is issued.

The above expiry dates will apply irrespective of the actual date of issue of the license in question.

RENEWAL OF LICENSES

All licenses issued by the Board and expiring on the 31st day of December of the year it is issued will be renewable annually. Application for renewal of licences will be made to the Board in writing by filling the forms stipulated in part 6 above. be necessary to fill the annexes except in a situation where there are changes in details that may require variation of license.

Notwithstanding licenses having been issued the previous year, the application for renewal shall be evaluated every time and the Board shall not be obliged to renew the licenses except for applications which as per the prevailing conditions at the time of application still meet the requirements. Premises which, after re-assessment, are deemed to have become unsuitable for carrying on the business will not have their registration renewed and the previous one would automatically become void.

The requisite forms for renewal are to be filled and application fees paid beginning October and not later than 31st December every year in order to facilitate timely processing of the licenses.

PENALTY FOR LATE RENEWAL:

Any application for renewal of licenses that is lodged later than 31st December will attract a penalty for late application and this will be in the form of a percentage of the standard application fees as may be prescribed by the Board. Currently the penalty is 10% and is levied on a monthly incremental basis from January onwards.

This business plan has six main sections and I’d recommend that you start by scribbling your ideas for each on a separate blank piece of paper.

Once you get your ideas worked out, you can create one cohesive document.

How to Write a Business Plan in Kenya

  • Production and Delivery 

Let’s look at each of these pages, shall we?

Page #1. Overview

The first page of your business plan will be an overview.

It is going to give a basic understanding of what your company does and the structure of your business.

Now, on that first overview page of your business plan, you want to include 

  • Your business structure
  • Location, that is where you do business and also
  • A brief description of exactly what your company actually does.

The next piece of information for your company’s overview is your business’s mission, which is really important.

Here is why;

The business mission is the driving force behind your business plan in Kenya.

It is what all your plans are focused on achieving and if you don’t have a mission’s like trying to make plans to reach a goal without having the goal.

So make sure you don’t skip this step.

The final component of the overview page is your chart of accountability.

This chart describes who is accountable for which of the major tasks involved in running the business.

And the three main areas of accountability in most businesses are 

  • Sales operations
  • Finances 

Page #2. Message

If you want your business to be successful, you MUST have a clear idea of;

  • What message you are working to communicate to your customers, 
  • Who are those customers
  • How do you fit into their lives and

Here are the questions that you will want to answer on this page of your business plan

  • What problem does your company solve for your customers
  • What result does your company create for those customers
  • How does your company create those results
  • Who does your company serve

  • What is your company’s step by step plan for creating those results for the customer or what is your proprietary system

This both helps to answer the question of what sets you apart from your competition

It also shows your customers how you are going to create those results that you are promising.

By making this clear, you are instilling confidence in your ability to create the results.

Page #3. Marketing

Let’s talk about the third page of your business plan.

This page focuses on marketing and generating sales.

First, you will want to define your target market by their demography and psychographics.

Demographics are attributes such as their age, income, where they live.

On the other hand, psychographics has to do with their interests, desires, and fears.

Here, you will also want to include an estimated size of your target market .

More importantly, where you have identified that you can find groups of those target customers.

Here is a little big hint;

If you haven’t yet figured out where you can find groups of those customers be it online or off, you are probably going to have trouble successfully marketing your product or service.

So if you come to this part in the business plan and don’t know what to put here, stop and do some digging.

Make sure that YOU can find this customer you have defined here. 

If you can’t, you might want to consider redefining that target customer and pivoting your marketing position.

The final three pieces of information that you can include on this page of your business plan are

  • Your visibility strategy. This explains how people will first learn about your brand and your products 
  • Your lead generation strategy, which explains how you will establish contact with the people who have discovered your brand
  • Your conversion strategy, which is essentially your sales strategy. Explain how you will turn those leads you’ve generated into paying customers.

Here is a quick heads up;

As you are working through this business plan, it’s more than likely that you won’t know the answers to all of these questions.

And you won’t have all these things figured out yet.

I just want to let you know that that is completely alright.

And actually, one of the main purposes of writing your business plan is to become aware of things you haven’t thought about yet or haven’t figured out.

Because only once you are aware of what you don’t know, you will be able to think through it. 

Don’t put off writing the business plan in Kenya just because you don’t know everything yet.

Rather, write the business plan so that you can get very clear on exactly what you know and need to figure out.

Page #4. Product

To clarify, a product could be a physical product or a digital product or service.

I highly recommend that you choose just one product as your business’s primary product.

You might be selling several different things, so determine what your main product is that you are going to center your business’s marketing message around.

Many different parts of your business development will be much easier if you do have one product that is the focus.

Now, on this page of the business plan, start by identifying 

  • what that product is and then 
  • describing the result that the product creates.

Here’s a little SECRET;

What your business sells is really the result your product creates not the product itself.

After describing the results, describe the impact the product creates.

This is different than the result itself.

It’s instead how the customers’ life is affected by the result of the product.

For example;

If your product is a vacuum cleaner, then the result the product creates is clean floors.

But the impact of the product is that your prospect feels better about the state of their house.

Now they have a cleaner, healthier living environment and perhaps feel more confident inviting some company.

Once you have described those three things for your main product, you can move on to other products that your company sells and do the same.

Page #5. Goals

The final page of your business success plan has to do with your goals.

If you have looked at any examples of business plans in the past or read a guide on how to write a business plan in Kenya, you might have seen a section that focused on projections.

  • sales projections or
  • new customer acquisition projections, or 
  • market share projections 

And if you’ve tried to write a business plan in Kenya in the past and you tried to write this section, you may have found it very difficult.

Chances are that is because you are running a small business in Kenya or maybe you have just started your business.

Truth is, it is really difficult to make accurate projections or projections at all for that matter if you don’t have any data to base them on.

And that is why I’d recommend that instead of trying to create projections, you simply set goals if you are just starting your company or have only been in business for a couple of years.

You can decide exactly how long you want to make your goals for.

But a good place to start would be to set some one-year goals and also some five-year goals.

This way you know what you need to work on right now but you also know where you are aiming long term.

For each time frame, you can set whatever goals you’d like.

However, some that I might recommend;

  • number of sales total revenue 
  • Profit 
  • impact in terms of the number of customers who you help or how wide you spread your message and
  • Development, could be the extent to which you have advanced the product that you create and offer or to what extent you have built your company.

And of course, when setting goals, it is always important to set specific, measurable goals and a deadline for when you plan to reach them.
