This chapter describes the use of qualitative research designs and methods in expanding the knowledge base about human trafficking. An overview of the designs is presented, and the usual methods of data collection are described. Relevant disciplines were examined for recent theses and dissertations that relate to the topic. A few studies were selected for a brief description in order to give readers a sense of what is being studied in their own fields. Qualitative studies have merit on their own—that is, they are sufficient to tell a story without planning further study on the topic with that sample. Qualitative studies can also be the foundation for building theory. Human trafficking is such a complex phenomenon that both types of qualitative research are needed even as the search continues for best practices in prevention and intervention through quantitative designs.

Human Trafficking is the third most registered international crime worldwide after drug and weapon trafficking. Human trafficking is a booming international trade, making billions of dollars at the expense of millions of victims; who are robbed of their dignity and freedom. The key concept of human trafficking is ―exploitation of people against their free will. With the transnational operation called human trafficking, slavery remains alive and thriving. Trafficking in persons is a global issue. No country can claim that its borders are not affected in some way by trafficking. Trafficking in persons is the equivalent of modern-day slavery. Slavery is illegal throughout the world, it is a violation of human rights, and it is a crime. Reaching an idea of what exactly HUMAN TRAFICKING is demands a lot of perception. This is because every case and circumstances of human trafficking is exceptional in its own course. To substantiate this, in a general case of human trafficking it is seen that a person (who later on becomes the victim) is taken from their village or town or city to another place, based on false promises of employment in a promising sector (commonly domestic help or labourer) with a handsome pay. Now this pay is made to look more than what this person gets in his/her own region. Such lucrative deals are the base or the main reasons for trafficking to start off in a region in the first place. Nevertheless when they arrive at the destination, what welcomes them is a shock of reality. They either never get the job that they were promised in the first place. The pay that they were promised is below their imagination. And from thereon, the situation starts deteriorating. In many cases it is unacceptable. They are handed over to placement agencies where they are further sent to different houses as domestic help and to different industries for different kind of small scale labour jobs. Primarily if we see these circumstances is that of human smuggling. But since the recruiter makes misleading promises, this case is moulded into the shape of human trafficking. In transnational trafficking, it is commonly seen that those people who are taken away from their home country in the pretext of being given good jobs, their passports are taken away from them. And other such related personal documents are confiscated. There is no escape for these victims. They are held as hostages are drowned in huge debts which can cost them their lives, if they ever tried to escape. Therefore whilst giving a global perspective to Human Trafficking calls for understanding the concept of it as well as educating civilians as to how they must recognize and respond and tackle the traffickers and trafficking happening in their communities and periphery. Tracking down these intricate details of the dynamics of human trafficking is much more important than just haphazardly going forward with new laws and policies or whatsoever.

Part one examines the definitions of human trafficking. Part two shows data about human trafficking while part three investigates what are the main drivers as to why human trafficking exists and persists. This chapter will consider factors of human trafficking existence such as poverty, low status of women in society, as well who the victims of human trafficking are. Part four will give as an overview of Human Trafficking in Europe and in particular in Albania, Montenegro and Serbia have into consideration Tier classification. In part fifth a specific emphasis will be given the way how state parties report to the Committee of the Convention on the Elimination of all forms of Discrimination against Women (CEDAW) on Human Trafficking issue and how the CEDAW committee prepare the concluding observation on this topic. A sample on two countries Austria as Tier 1 and Serbia as Tier 2 is presented in the appendix 1 in the form of a table. The conclusion is that despite the campaigns to abolish slavery over two hundred years ago, slavery still exists in our society and today and it is called human trafficking. Human trafficking is an internationally organized crime which involves the trade of human beings for the purpose of sexual exploitation, forced labour, domestic servitude or for the removal of organs. Unfortunately, is worldwide estimated that this industry is one of the most profitable one after drug trafficking.

Human Trafficking is the third most registered international crime worldwide after drug and weapon trafficking. It is the major crime in India also. In India, poverty, lack of education, urbanization, low valuation of girls etc. are identified as the main causes of human trafficking. The government of India as well as West Bengal and several NGOs try to combat trafficking but it is unstoppable. Legal fight against human trafficking in India is inadequate. So, to fight out this social crime, growing awareness is extremely necessary. Side by side, literacy rate should also be increased as a preventive measure to this crime. This research article focuses on three bases i) Global Basis ii) Indian Basis and iii) Basis of West Bengal in recent time perspective.

Slavery and forced labour have been accepted to be against humanity. These practices are expressly prohibited by the Federal Constitution in Malaysia. Although the prohibition of human trafficking is not expressly mentioned in the Constitution, it could be regarded as one of the most heinous crimes according to the letter, intent and spirit of the constitution. This is related to the fact that human trafficking is much associated with modern day slavery and therefore is against the ideology of the Malaysian nation and acceptable norms of the international community and Islamic law and Shariah values. The paper will explore the available international human rights and the laws governing human trafficking in Malaysia. The research is based on the current situation and cases of human trafficking in Malaysia.

The international legal definition of forced labour

According to the ILO Forced Labour Convention, 1930 (No. 29) , forced or compulsory labour is:

"all work or service which is exacted from any person under the threat of a penalty and for which the person has not offered himself or herself voluntarily."

This definition consists of three elements:

• Work or service  refers to all types of work occurring in any activity, industry or sector including in the informal economy.
• Menace of any penalty  refers to a wide range of penalties used to compel someone to work.
• Involuntariness: The terms “offered voluntarily” refer to the free and informed consent of a worker to take a job and his or her freedom to leave at any time. This is not the case for example when an employer or recruiter makes false promises so that a worker take a job he or she would not otherwise have accepted.

Convention No. 29, in Article 2(2) , also provides for exceptions to the definition of forced labour by specifically referring to five situations in which compulsory labour may be imposed: 

• work of a purely military character exacted in virtue of compulsory military service;
• normal civic obligations;
• work or service exacted from any person as a consequence of a conviction in a court of law, carried out under the supervision of a public authority;
• work exacted in cases of emergency, such as wars or natural calamities; and
• minor communal services in the direct interest of the community involved.

Each of these exceptions is subject to the observance of certain conditions that define their limits. If these limits are not respected, this can amount to a situation of compulsory labour imposed by the State.

The Abolition of Forced Labour Convention No. 105  adopted by the ILO in 1957 primarily concerns forced labour imposed by state authorities. It prohibits specifically the use of forced labour:

• as punishment for the expression of political views,
• for the purposes of economic development,
• as a means of labour discipline,
• as a punishment for participation in strikes,
• as a means of racial, religious or other discrimination.

“Forced labour”, “human trafficking” (also called “trafficking in persons”) and “slavery” are terms that are often used interchangeably. However, while these concepts do have significant overlap, they are conceptually distinct and each has a clear definition in international law.

What is trafficking in persons? 

The definition of trafficking in persons, provided by the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime, 2000 (UN Protocol), in Article 3(a), encompasses three elements:

• Acts : Recruitment, transportation, transfer, harbouring or receipt of persons. 
• Means : The means that are used to accomplish one of the prohibited acts; namely, the use of threat or of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person.
• Purpose : Whether this act, using the above means, was conducted for the purpose of exploitation. The UN Protocol provides that “exploitation” includes “at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs”. 

What is slavery?

“Slavery” is defined under Article 1(1) of the League of Nations Convention to Suppress the Slave Trade and Slavery (the Slavery Convention), 1926, as “the status or condition of a person over whom any or all of the powers attaching to the right of ownership are exercised”. Slavery is an institution of complete ownership, in which an individual is subjected to the full control of the slave owner who can make decisions for this individual on education (attending school or not), work (type and conditions) or even private life (who to marry). The prohibition of slavery in international law has achieved “jus cogens” status, meaning that all states accept it as a principle that cannot be derogated from. Nevertheless, and although slavery is prohibited by law in most countries, the practice or its vestiges remain in certain countries. In most cases, people subjected to slavery will find themselves in a situation of psychological, economic and social dependence. They have no option than work for their “master” and will fall under the definition of forced labour provided by the Convention No. 29.

Based on the definitions provided by the related international treaties, there is a significant overlap between forced labour, human trafficking and slavery. It is important for stakeholders involved in developing and implementing NAPs to understand these concepts and their precise scope.

The Forced Labour Convention (No. 29), adopted in 1930, contains the definition of forced labour and provides that it should be punished as a crime. This is one of the most ratified ILO standards.

The Abolition of Forced Labour Convention (No. 105), adopted in 1957,  deals with state-imposed forms of forced labour. This is one of the most ratified ILO standards. 

The Protocol to the Forced Labour Convention, (P029), adopted in 2014, requires ratifying countries to take effective measures to prevent forced labour, protect victims and ensure their access to justice.

Forced labour and slavery are not a thing of the past. They have ancient roots in history and still exist today in many different forms. In fact, there are more people in slavery today than at any other time in history. Almost 50 million people around the world were victims of modern slavery in 2021, including about 28 million in forced labour, and 22 million in forced marriages. If they all lived together in a single city, it would be one of the biggest cities in the world.

Forced labour has grown in recent years. A simple comparison with the previous estimates indicates an increase of 2.7 million in the number people in forced labour between 2016 and 2021, which translates to a rise in the prevalence of forced labour from 3.4 to 3.5 per thousand people in the world.

Forced labour affects in one way or another every country in the world; it is a truly global problem. Statistics on prevalence are highly significant since they indicate the level of risk that people face in different regions. Asia and the Pacific is host to more than half of the global total (15.1 million), followed by Europe and Central Asia (4.1 million), Africa (3.8 million), the Americas (3.6 million), and the Arab States (0.9 million). But this regional ranking changes considerably when forced labour is expressed as a proportion of the population. By this measure, forced labour is highest in the Arab States (5.3 per thousand people), followed by Europe and Central Asia (4.4 per thousand), the Americas and Asia and the Pacific (both at 3.5 per thousand), and Africa (2.9 per thousand).

Forced labour affects all population groups, young and old, male and female. But some groups are more vulnerable than others. 

Women and girls in forced labour are much more likely than their male counterparts to be in domestic work, while men in forced labour are much more likely to be in the construction sector. Women are more likely to be coerced through wage non-payment and abuse of vulnerability, and men through threats of violence and financial penalties. Women are also more likely than men to be subjected to physical and sexual violence and threats against family members.

Migrant workers face a higher risk of forced labour than other workers. The forced labour prevalence of adult migrant workers is more than three times higher than that of adult non-migrant workers. This figure makes clear that when migrant workers are not protected by law or are unable to exercise their rights, migration is irregular or poorly governed, or where recruitment practices are unfair or unethical, migration can lead to situations of vulnerability to forced labour.

Most forced labour occurs in the private economy. Eighty-six per cent of forced labour cases are imposed by private actors – 63 per cent in the private economy in sectors other than commercial sexual exploitation and 23 per cent in forced commercial sexual exploitation. State-imposed forced labour accounts for the remaining 14 per cent of people in forced labour.

Forced labour is a huge business. An ILO study estimated that forced labour generates annual profits of over US$ 150 billion, which is as much as the combined profits of the four most profitable companies in the world. The annual profits generated per victim of forced labour are far, far higher in developed economies and the European Union than they are anywhere else in the world.

Human trafficking is a widespread and growing crime in the world. Trafficking by its nature involves movement from one place to another and in most cases, it comprises crossing international borders. Although the estimation of victims of trafficking stretches to 2 450 000, the number of prosecutions is less than 5 000. This indicates the challenges faced by many countries in the investigation and prosecution of trafficking cases. Transnational human trafficking is committed in different places, making investigation and prosecution very complex. This paper examines how investigation and prosecution can be carried out when the criminal acts are committed in different countries. It also examines how the issue of jurisdiction is entertained. Furthermore, it addresses who can be termed as &ldquo traffickers&rdquo in dealing with human trafficking issues. Ethiopia is facing a big problem in fighting human trafficking. Like most countries, the issue of human trafficking is closely related to women. Ethiopia uses the criminal justice system as a tool to eradicate women trafficking. The investigation and prosecution of trafficking cases face many problems which have a direct impact on the country‟s efforts to overcome human trafficking. Thus, this research will contribute significantly by highlighting deficits in the criminal justice system as it deals with the investigation and prosecution of women trafficking issues and by making recommendations with regards to them.

The global hegemon, the United States encompasses roughly 57,000 to 63,000 of the roughly 45.8 million slaves present across the world today (Walk Free Foundation 2016a). This dissertation research uses the theoretical lens of Human Security as a unique approach in that it is people-centered, focusing on the individual, rather than the more traditional theories in international relations that emphasize the state as the central actor. This dissertation focuses on the understudied area of human trafficking into and within the United States. More specifically, the objective of this research examines the movement of trafficked persons via air and details actions to be taken to combat human trafficking.

Although the world relies upon aerial commerce to enable globalization and interdependence, these same transportation systems and flows that carry persons and goods for legal commerce and trade can also be used as an avenue for illegal commerce, including trafficking of human. Thus, the researcher surveyed aviation personnel in various sectors of the industry, government organizations, non-government organization and victims/survivors via an online survey platform and utilized social media to reach potential survey participants. The sample size used for this study was 10,065 and the study received 578 participants.

The data collection procedures and results used in this dissertation were designed to identify gaps in security safeguards that further enable human trafficking via aircraft. The author presents strategies that can be adopted to reduce, if not eliminate, human trafficking into and within the United States via air. The researcher identified eleven opportunities for future research and discusses the limitations. The studied reveals seven key findings: definition of human trafficking is not known in totality, the level of human trafficking awareness, the number of human trafficking cases identified, the characteristics of the typical respondent, aviation sectors place a slightly different areas of emphasis of human trafficking that is understudied, understudied areas of human trafficking were different than that of the typical respondent, and the absence of human trafficking regulations and training. Finally, the study introduces a comprehensive-holistic human trafficking training curriculum entitled, “Operation Safe House: Human Trafficking Training for Aviation Professionals.”

Few studies have examined the experiences of sexually trafficked victims and survivors in the United States.

As the population increases it is important to understand how sexually trafficked victims and survivors cope with trauma, experience recovery, and respond to therapy. Research indicates that factors of hope and resilience play a vital role in the way individuals cope with trauma and experience recovery (Masten & Narayan, 2012).

This study examined factors of hope and resilience of 12 sexually trafficked victims and survivors, ages 14 to 21. Interviews were conducted and a mixed-methods design was employed to establish common themes related to how sex trafficking victims comprehend and experience hope and resilience within their lives.

Significant quantitative and qualitative results were found in this study. Six significant qualitative themes were derived from the interviews describing various ways that participants experienced hope and resilience. The themes included (a) Need for positive attachment (b) Positive Self-Portrayal (c) Introspection (d) Adaptability (e) Need for money, and (f) Desire for change.

Additionally, participants also completed the Connor-Davidson Resilience Scale, the Children’s Hope Scale or Adult Hope Scale, and the Hopkins Symptom Checklist-25. Quantitative results indicate a strong positive correlation between depression and anxiety ( r = .52, p < .01), a strong positive correlation between hope and resilience ( r = .70, p < .04), and a strong negative correlation between resilience and anxiety ( r = -.63, p < .03).

The implications of this study may be used to direct clinical focus when working with victims and survivors, placing emphasis on the importance of developing hope and resilience throughout the rehabilitation process.

Human sex trafficking is the harboring, recruiting, or transporting of a person for purposes of prostitution. Traffickers use social networking sites to lure victims in a process called "grooming." Past research suggests that sexual victimization online could be associated with online risky behaviors, offline risky behaviors (e.g., substance abuse), poor academic performance, and problems at home, among others. The purpose of this study was to identify those psychosocial constructs that increase an individual's likelihood of becoming a victim of online HST. The likelihood of victimization was estimated by examining participants' reactions to realistic vignettes representing messages from strangers. This study hypothesized that executive dysfunction, participation in offline and online risk behaviors, and poor self-esteem would predict the likelihood of victimization. The results from the 168 young, female participants showed that marijuana use, online risk behavior, and self-esteem were found to predict this outcome. Executive dysfunction did not predict victimization likelihood.

Punnichy RCMP seize meth, cocaine, fentanyl, and cannabis during drug trafficking investigation

On April 19, 2024 at approximately 3:45 p.m., Punnichy RCMP received a report of potentially-armed individuals travelling in a vehicle.

Officers responded immediately. Punnichy RCMP located the suspect vehicle parked in front of a residence on George Gordon First Nation. Officers approached the vehicle, and as a result of investigation, located and seized approximately 14 grams of methamphetamine, approximately four grams of fentanyl, a machete, drug trafficking paraphernalia, and a sum of cash inside of it.

Two adult males and an adult female were arrested at the scene.

30-year-old Joshua Fayant from George Gordon First Nation is charged with:

• two counts, possession for the purpose of trafficking, Section 5(2), Controlled Drugs and Substance Act;
• one count, possession of a weapon for a dangerous purpose, Section 88(2), Criminal Code; and
• one count, fail to comply with probation order, Section 733.1(1), Criminal Code.

20-year-old Tylena Favel from Kawacatoose First Nation is charged with:

• one count, possession of a weapon for a dangerous purpose, Section 88(2), Criminal Code;
• one count, resists/obstruct peace officer, Section 129(a), Criminal Code; and
• 5 counts, fail to comply with release order condition, Section 145(5)(a), Criminal Code.

The other adult male arrested at the scene was later released without charge.

As a result of continued investigation, on April 20, 2024 Punnichy RCMP and Saskatchewan RCMP's Critical Incident Response Team executed a search warrant at a residence in Punnichy as part of a drug trafficking investigation.

Officers located and seized approximately 114 grams of methamphetamine, approximately 25 grams of cocaine, approximately 17 grams of fentanyl, over 100 grams of cannabis, drug trafficking paraphernalia, a crossbow, a throwing star, numerous knives, and a sum of cash.

An adult male and an adult female were arrested at the scene.

37-year-old Quentin Desjarlais from Punnichy is charged with:

• three counts, possession for the purpose of trafficking, Section 5(2), Controlled Drugs and Substance Act;
• one count, possession of cannabis for the purpose of selling, Section 10(2), Cannabis Act;
• one count, unauthorized possession of firearm/prohibited weapon or restricted weapon, Section 91(3), Criminal Code;
• six counts, possess weapon contrary to order, Section 117.01(3), Criminal Code;
• one count, possession of property obtained by crime less than $5000, Section 354(1)(a), Criminal Code; and
• three counts, fail to comply with release order, Section 145(5)(a), Criminal Code.

24-year-old Shaylon Mooswa from Punnichy is charged with:

• three counts, possess weapon contrary to order, Section 117.01(3), Criminal Code;
• one count, possession of cannabis for the purpose of selling, Section 10(2), Cannabis Act; and

Joshua Fayant, Tylena Favel, Quentin Desjarlais, and Shaylon Mooswa appeared in Regina Provincial Court on April 22, 2024
