Concern is growing about a burgeoning online market for essays that students can buy and turn in as their own work. And schools are trying new tools to catch it.

As the recent college admissions scandal is shedding light on how parents are cheating and bribing their children's way into college, schools are also focusing on how some students may be cheating their way through college. Concern is growing about a burgeoning online market that makes it easier than ever for students to buy essays written by others to turn in as their own work. And schools are trying new tools to catch it.

It's not hard to understand the temptation for students. The pressure is enormous, the stakes are high and, for some, writing at a college level is a huge leap.

"We didn't really have a format to follow, so I was kind of lost on what to do," says one college freshman, who struggled recently with an English assignment. One night, when she was feeling particularly overwhelmed, she tweeted her frustration.

"It was like, 'Someone, please help me write my essay!' " she recalls. She ended her tweet with a crying emoji. Within a few minutes, she had a half-dozen offers of help.

"I can write it for you," they tweeted back. "Send us the prompt!"

The student, who asked that her name not be used for fear of repercussions at school, chose one that asked for $10 per page, and she breathed a sigh of relief.

"For me, it was just that the work was piling up," she explains. "As soon as I finish some big assignment, I get assigned more things, more homework for math, more homework for English. Some papers have to be six or 10 pages long. ... And even though I do my best to manage, the deadlines come closer and closer, and it's just ... the pressure."

In the cat-and-mouse game of academic cheating, students these days know that if they plagiarize, they're likely to get caught by computer programs that automatically compare essays against a massive database of other writings. So now, buying an original essay can seem like a good workaround.

"Technically, I don't think it's cheating," the student says. "Because you're paying someone to write an essay, which they don't plagiarize, and they write everything on their own."

Her logic, of course, ignores the question of whether she's plagiarizing. When pressed, she begins to stammer.

"That's just a difficult question to answer," she says. "I don't know how to feel about that. It's kind of like a gray area. It's maybe on the edge, kind of?"

Besides she adds, she probably won't use all of it.

Other students justify essay buying as the only way to keep up. They figure that everyone is doing it one way or another — whether they're purchasing help online or getting it from family or friends.

"Oh yeah, collaboration at its finest," cracks Boston University freshman Grace Saathoff. While she says she would never do it herself, she's not really fazed by others doing it. She agrees with her friends that it has pretty much become socially acceptable.

"I have a friend who writes essays and sells them," says Danielle Delafuente, another Boston University freshman. "And my other friend buys them. He's just like, 'I can't handle it. I have five papers at once. I need her to do two of them, and I'll do the other three.' It's a time management thing."

The war on contract cheating

"It breaks my heart that this is where we're at," sighs Ashley Finley, senior adviser to the president for the Association of American Colleges and Universities. She says campuses are abuzz about how to curb the rise in what they call contract cheating. Obviously, students buying essays is not new, but Finley says that what used to be mostly limited to small-scale side hustles has mushroomed on the internet to become a global industry of so-called essay mills. Hard numbers are difficult to come by, but research suggests that up to 16 percent of students have paid someone to do their work and that the number is rising.

"Definitely, this is really getting more and more serious," Finley says. "It's part of the brave new world for sure."

The essay mills market aggressively online, with slickly produced videos inviting students to "Get instant help with your assignment" and imploring them: "Don't lag behind," "Join the majority" and "Don't worry, be happy."

"They're very crafty," says Tricia Bertram Gallant, director of the Academic Integrity Office at the University of California in San Diego and a board member of the International Center for Academic Integrity.

The companies are equally brazen offline — leafleting on campuses, posting flyers in toilet stalls and flying banners over Florida beaches during spring break. Companies have also been known to bait students with emails that look like they're from official college help centers. And they pay social media influencers to sing the praises of their services, and they post testimonials from people they say are happy customers.

"I hired a service to write my paper and I got a 90 on it!" gloats one. "Save your time, and have extra time to party!" advises another.

"It's very much a seduction," says Bertram Gallant. "So you can maybe see why students could get drawn into the contract cheating world."

YouTube has been cracking down on essay mills; it says it has pulled thousands of videos that violate its policies against promoting dishonest behavior.

But new videos constantly pop up, and their hard sell flies in the face of their small-print warnings that their essays should be used only as a guide, not a final product.

Several essay mills declined or didn't respond to requests to be interviewed by NPR. But one answered questions by email and offered up one of its writers to explain her role in the company, called EduBirdie.

"Yes, just like the little birdie that's there to help you in your education," explains April Short, a former grade school teacher from Australia who's now based in Philadelphia. She has been writing for a year and a half for the company, which bills itself as a "professional essay writing service for students who can't even."

Some students just want some "foundational research" to get started or a little "polish" to finish up, Short says. But the idea that many others may be taking a paper written completely by her and turning it in as their own doesn't keep her up at night.

"These kids are so time poor," she says, and they're "missing out on opportunities of travel and internships because they're studying and writing papers." Relieving students of some of that burden, she figures, allows them to become more "well-rounded."

"I don't necessarily think that being able to create an essay is going to be a defining factor in a very long career, so it's not something that bothers me," says Short. Indeed, she thinks students who hire writers are demonstrating resourcefulness and creativity. "I actually applaud students that look for options to get the job done and get it done well," she says.

"This just shows you the extent of our ability to rationalize all kinds of bad things we do," sighs Dan Ariely, professor of psychology and behavioral economics at Duke University. The rise in contract cheating is especially worrisome, he says, because when it comes to dishonest behavior, more begets more. As he puts it, it's not just about "a few bad apples."

"Instead, what we have is a lot ... of blemished apples, and we take our cues for our behavior from the social world around us," he says. "We know officially what is right and what's wrong. But really what's driving our behavior is what we see others around us doing" or, Ariely adds, what we perceive them to be doing. So even the proliferation of advertising for essays mills can have a pernicious effect, he says, by fueling the perception that "everyone's doing it."

A few nations have recently proposed or passed laws outlawing essay mills, and more than a dozen U.S. states have laws on the books against them. But prosecuting essay mills, which are often based overseas in Pakistan, Kenya and Ukraine, for example, is complicated. And most educators are loath to criminalize students' behavior.

"Yes, they're serious mistakes. They're egregious mistakes," says Cath Ellis, an associate dean and integrity officer at the University of New South Wales, where students were among the hundreds alleged to have bought essays in a massive scandal in Australia in 2014.

"But we're educational institutions," she adds. "We've got to give students the opportunity to learn from these mistakes. That's our responsibility. And that's better in our hands than in the hands of the police and the courts."

Staying one step ahead

In the war on contract cheating, some schools see new technology as their best weapon and their best shot to stay one step ahead of unscrupulous students. The company that makes the Turnitin plagiarism detection software has just upped its game with a new program called Authorship Investigate.

The software first inspects a document's metadata, like when it was created, by whom it was created and how many times it was reopened and re-edited. Turnitin's vice president for product management, Bill Loller, says sometimes it's as simple as looking at the document's name. Essay mills typically name their documents something like "Order Number 123," and students have been known to actually submit it that way. "You would be amazed at how frequently that happens," says Loller.

Using cutting-edge linguistic forensics, the software also evaluates the level of writing and its style.

"Think of it as a writing fingerprint," Loller says. The software looks at hundreds of telltale characteristics of an essay, like whether the author double spaces after a period or writes with Oxford commas or semicolons. It all gets instantly compared against a student's other work, and, Loller says, suspicions can be confirmed — or alleviated — in minutes.

"At the end of the day, you get to a really good determination on whether the student wrote what they submitted or not," he says, "and you get it really quickly."

Coventry University in the U.K. has been testing out a beta version of the software, and Irene Glendinning, the school's academic manager for student experience, agrees that the software has the potential to give schools a leg up on cheating students. After the software is officially adopted, "we'll see a spike in the number of cases we find, and we'll have a very hard few years," she says. "But then the message will get through to students that we've got the tools now to find these things out." Then, Glendinning hopes, students might consider contract cheating to be as risky as plagiarizing.

In the meantime, schools are trying to spread the word that buying essays is risky in other ways as well.

Professor Ariely says that when he posed as a student and ordered papers from several companies, much of it was "gibberish" and about a third of it was actually plagiarized.

Even worse, when he complained to the company and demanded his money back, they resorted to blackmail. Still believing him to be a student, the company threatened to tell his school he was cheating. Others say companies have also attempted to shake down students for more money, threatening to rat them out if they didn't pay up.

The lesson, Ariely says, is "buyer beware."

But ultimately, experts say, many desperate students may not be deterred by the risks — whether from shady businesses or from new technology.

Bertram Gallant, of UC San Diego, says the right way to dissuade students from buying essays is to remind them why it's wrong.

"If we engage in a technological arms race with the students, we won't win," she says. "What are we going to do when Google glasses start to look like regular glasses and a student wears them into an exam? Are we going to tell them they can't wear their glasses because we're afraid they might be sending the exam out to someone else who is sending them back the answers?"

The solution, Bertram Gallant says, has to be about "creating a culture where integrity and ethics matter" and where education is valued more than grades. Only then will students believe that cheating on essays is only cheating themselves.

Essay cheating: How common is it?

A BBC investigation has found that prominent YouTube stars are encouraging students to buy essays.

Passing off a custom-made essay as your own is a form of plagiarism known as contract cheating.

It involves a student ordering an essay, usually through a website, for a fee.

But it could also be friends or family members writing an essay on a student's behalf.

Companies offering these sort of services are known as essay mills.

The fee will usually depend on the essay subject, length and deadline.

Some essay mills - including EduBirdie - claim that the essays they provide are "100% plagiarism free". But even if the essay you buy doesn't necessarily contain copied material, the act of submitting it as your own is itself a form of plagiarism - according to the Quality Assurance Agency (QAA), which monitors standards in UK higher education.

A student caught doing this could face serious penalties - including expulsion.

EduBirdie says that there is disclaimer on its site which suggested that the work it provided should only be used as a sample or a reference.

What's the scale of contract cheating?

The QAA told Reality Check that it believes contract cheating is on the rise.

In its 2016 report, the agency said leaflets advertising essay services had been handed out on campuses. There were also reports of adverts appearing on university notice boards.

One UK essay writing company boasts that it has helped more than 25,000 students over the past 15 years.

But we don't know how many of those students who used the service went on to submit the essays as their own.

The QAA also referred Reality Check to a 2016 Times investigation. Based on Freedom of Information requests, the newspaper unearthed 50,000 cases of cheating in UK universities over the previous three years.

This works out at 17,000 per year, or 0.7% of students.

The problem with this number, which the QAA acknowledges, is that it includes all forms of cheating - not just contract cheating.

But even if we did know how many students were caught contract cheating, we still wouldn't know how many cases went undetected.

For that we have to rely on survey data, where students are asked if they have ever cheated by submitting an essay written by someone else.

The most recent UK study was carried out in 2012 and found that 29.5% of participants agreed that they had "submitted work taken wholly from an internet source (free or paid) as your own".

Elsewhere, the QAA cites a 2014 study from Saudi Arabia, which found that 22% of students reported having paid someone to write an essay.

Prof Phil Newton, from Swansea University, is an expert on contract cheating. He says that with surveys of this nature, there's always a likelihood that respondents may not give accurate answers - especially if they are owning up to deviant behaviour.

So, we have to treat survey data with a degree of scepticism.

Are these services legal?

At the moment there's nothing, legally speaking, to stop websites selling essays.

In fact many websites contain disclaimers that say students shouldn't pass off the essays as their own and that they should only be used as study aids.

That said, in March 2018, the Advertising Standards Agency (ASA) upheld a complaint about claims appearing on a UK essay mill website.

The ASA said the website gave the misleading impression that "consumers would be able to submit purchased essays as their own without repercussion".

But even if legislation was brought in, the QAA says it is unlikely to solve the problem.

It says many of these websites are offshore and even if they were closed down they can easily re-emerge.

So what can be done about it?

Contract cheating can be very difficult to spot. As the essays are bespoke they're unlikely to be picked up by software which some universities use to detect plagiarism.

Last October, guidance was issued to institutions on how to deal with contract cheating.

  • Have fewer assessments by essays
  • Block essay writing websites from IT systems
  • Get familiar with student writing styles and try to spot any changes
  • Have clear procedures to report suspected cheating
  • Support struggling students with their writing skills

Why do students do it?

There are many reasons - it could be as simple as laziness or a lack of confidence in writing ability.

In April, Prof Newton, along with colleagues, published a study into contract cheating in Australia.

The study focused on students who had asked either friends or family members to write essays on their behalf.

The researchers found that were three factors which increased the likelihood of contract cheating.

  • Students who spoke a language other than English
  • A dissatisfaction with their learning environment
  • Where students perceived there were opportunities to cheat

Essay mills are now illegal - Skills Minister calls on internet service platforms to crack down on advertising

Skills Minister Alex Burghart has written to internet service platforms to make sure they know that essay mills - which facilitate cheating by helping academic writing, often by appearing to be legitimate - have been made illegal and to call on their support in making sure they can no longer advertise online. Here you can read that letter.

The Skills and Post-16 Education Bill has become law. Through this act, the Government has legislated for landmark reforms that will transform post-16 education and skills, including criminalising essay mills.

As you may know, Essay Mills are online platforms that facilitate contract cheating. Contract cheating happens when a third party completes work for a student which is passed off by the student as their own work. Many essay mill companies use marketing techniques which indicate they are offering ‘legitimate’ academic writing support for students. Reports also indicate that some essay mills seek to blackmail students who use these services. It is right that we have legislated against these insidious crimes.

It is now a criminal offence to provide or arrange for another person to provide contract cheating services for financial gain to students taking a qualification at a post-16 institution or sixth form in England, enrolled at a higher education provider in England and any other person over compulsory school age who has been entered for a regulated qualification at a place in England.

Similarly, it is now an offence for a person to make arrangements for an advertisement in which that person offers, or is described as being available or competent, to provide or arrange for another person to provide a cheating service. Importantly, the offence centres around the act of advertising to students, and for the offence to be committed it does not need to be seen by its target demographic.

There is now a strengthened, collaborative effort across the sector to tackle essay mills and we want you to be part of this campaign. Platforms such as yourself play an integral role in helping us to make the most effective use of the legislation; marketing and advertising are the lifeblood of any successful industry. We are aware that high numbers of essay mills have used your platform to promote their services to students in the past, paying for advertising to promote their companies. Essay mills are now illegal entities, and you should not carry their advertising. It is no longer a moral question; you will be facilitating an illegal activity. I ask you to do everything in your power to prevent the advertising these unscrupulous practices.

Removing essay mill access to online marketing will seriously hamper their efforts to target vulnerable students and I implore you to do so following the introduction of this legislation. We must now all work together to capitalise on it.

I hope that in writing to you today I have underlined the urgency of this issue and the important role that companies like yours play in stamping out essay mills once and for all and am sure I can be confident in your support.

Cheating, Inc.: How Writing Papers for American College Students Has Become a Lucrative Profession Overseas

Tuition was due. The rent was, too . So Mary Mbugua, a university student in Nyeri, Kenya, went out in search of a job. At first, she tried selling insurance policies, but that only paid on commission and she never sold one. Then she sat behind the reception desk at a hotel, but it ran into financial trouble.

Finally, a friend offered to help her break into “academic writing,” a lucrative industry in Kenya that involves doing school assignments online for college students in the United States, Britain and Australia. Ms. Mbugua felt conflicted.

“This is cheating,” she said. “But do you have a choice? We have to make money. We have to make a living.”

Since federal prosecutors charged a group of rich parents and coaches this year in a sprawling fraud and bribery scheme , the advantages that wealthy American students enjoy in college admissions have been scrutinized. Less attention has been paid to the tricks some well-off students use to skate by once they are enrolled.

Cheating in college is nothing new, but the internet now makes it possible on a global, industrial scale. Sleek websites — with names like Ace-MyHomework and EssayShark — have sprung up that allow people in developing countries to bid on and complete American homework assignments.

Although such businesses have existed for more than a decade, experts say demand has grown in recent years as the sites have become more sophisticated, with customer service hotlines and money-back guarantees. The result? Millions of essays ordered annually in a vast, worldwide industry that provides enough income for some writers to make it a full-time job.

The essay-for-hire industry has expanded significantly in developing countries with many English speakers , fast internet connections and more college graduates than jobs, especially Kenya, India and Ukraine. A Facebook group for academic writers in Kenya has over 50,000 members .

After a month of training, Ms. Mbugua began producing essays about everything from whether humans should colonize space (“it is not worth the struggle,” she wrote) to euthanasia (it amounts to taking “the place of God,” she wrote). During her best month, she earned $320, more money than she had ever made in her life. The New York Times is identifying Ms. Mbugua by only part of her name because she feared that the attention would prevent her from getting future work.

It is not clear how widely sites for paid-to-order essays, known as “contract cheating” in higher education circles, are used. A 2005 study of students in North America found that 7 percent of undergraduates admitted to turning in papers written by someone else, while 3 percent admitted to obtaining essays from essay mills. Cath Ellis, a leading researcher on the topic, said millions of essays are ordered online every year worldwide.

“It’s a huge problem,” said Tricia Bertram Gallant , director of the academic integrity office at the University of California, San Diego. “If we don’t do anything about it, we will turn every accredited university into a diploma mill.”

When such websites first emerged over a decade ago, they featured veiled references to tutoring and editing services, said Dr. Bertram Gallant, who also is a board member of the International Center for Academic Integrity, which has worked to highlight the danger of contract cheating . Now the sites are blatant.

“You can relax knowing that our reliable, expert writers will produce you a top quality and 100% plagiarism free essay that is written just for you, while you take care of the more interesting aspects of student life ,” reads the pitch from Academized, which charges about $15 a page for a college freshman’s essay due in two weeks and $42 a page for an essay due in three hours.

“No matter what kind of academic paper you need, it is simple and secure to hire an essay writer for a price you can afford,” promises EssayShark.com. “Save more time for yourself.”

In an email, EssayShark’s public relations department said the company did not consider its services to be cheating, and that it warned students the essays are for “research and reference purposes only” and are not to be passed off as a student’s own work.

“We do not condone, encourage or knowingly take part in plagiarism or any other acts of academic fraud,” it said.

A representative for UvoCorp, another of the companies, said its services were not meant to encourage cheating. “The idea behind our product design is to help people understand and conform to specific requirements they deal with, and our writers assist in approaching this task in a proper way,” the representative said in an email. “According to our policies, customers cannot further use any consultative materials they receive from us as their own.”

Representatives for Academized and Ace-MyHomework did not return emails and phone calls seeking comment.

A major scandal involving contract cheating in Australia caused university officials there to try to crack down on the practice. A similar effort to confront the industry has emerged in Britain, but not in the United States.

Contract cheating is illegal in 17 states, but punishment tends to be light and enforcement rare . Experts said that no federal law in the United States, or in Kenya, forbids the purchase or sale of academic papers, although questions remain about whether the industry complies with tax laws .

“Because American institutions haven’t been whacked over the head like Australian schools were, it’s easier to pretend that it’s not happening,” said Bill Loller, vice president of product management for Turnitin, a company that develops software to detect plagiarism . “But it’s absolutely happening .”

Mr. Loller said he had worked with some colleges that have students who have never shown up for class or completed a single assignment. “They’ve contracted it all out,” he said.

Contract cheating is harder to detect than plagiarism because ghostwritten essays will not be flagged when compared with a database of previously submitted essays; they are generally original works — simply written by the wrong person . But this year, Turnitin rolled out a new product called Authorship Investigate, which uses a host of clues — including sentence patterns and a document’s metadata — to attempt to determine if it was written by the student who turned it in.

Some of the websites operate like eBay, with buyers and sellers bidding on specific assignments. Others operate like Uber, pairing desperate students with available writers. Either way, the identities and locations of both the writers and the students are masked from view, as are the colleges the assignments are for .

Still, in some of the assignments that Ms. Mbugua provided to The Times, names of colleges that the essays were meant for became clear. One assignment asked students to write about a solution to a community problem, and the essay Ms. Mbugua provided described difficulties with parking around Arizona State University. “Students could always just buck up and take the walk,” the paper said.

Bret Hovell, a spokesman for Arizona State University, said the school was not able to determine whether the essay had been turned in.

In Kenya, a country with a per capita annual income of about $1,700, successful writers can earn as much as $2,000 a month, according to Roynorris Ndiritu, who said he has thrived while writing academic essays for others.

Roynorris Ndiritu , 28, who asked that only part of his name be used because he feared retribution from others in the industry in Kenya, graduated with a degree in civil engineering and still calls that his “passion.” But after years of applying unsuccessfully for jobs, he said, he began writing for others full time. He has earned enough to buy a car and a piece of land, he said, but it has left him jaded about the promises he heard when he was young about the opportunities that would come from studying hard in college.

“You can even get the highest level of education, and still, you might not get that job,” he said.

In interviews with people in Kenya who said they had worked in contract cheating, many said they did not view the practice as unethical.

As more foreign writers have joined the industry, some sites have begun to advertise their American ties, in a strange twist on globalization and outsourcing. One site lists “bringing jobs back to America ” as a key goal. American writers, who sometimes charge as much as $30 per page, say that they offer higher-quality service, without British spellings or idioms that might raise suspicion about an essay’s authorship.

Ms. Mbugua, the Kenyan university student, worked for as little as $4 a page. She said she began carrying a notebook, jotting down vocabulary words she encountered in movies and novels to make her essays more valuable.

Ms. Mbugua, 25, lost her mother to diabetes in 200 1, when she was in the second grade. She vowed to excel in school so that she would one day be able to support her younger brother and sister.

A government loan and aunts and uncles helped her pay for college. But she also worked, landing in an office of 10 writers completing other people’s assignments , including those of American students. The boss stayed up all night, bidding for work on several sites, and then farmed it out in the morning .

“Any job that is difficult, they’re like, ‘Give it to Mary,’” she said.

There were low points. During summer break , work slowed to a trickle. Once, she agonized so much over an American history paper about how the Great Depression ended that she rejected the job at the last minute, and had to pay an $18 fine.

But Ms. Mbugua said she loved learning, and sometimes wished that she were the one enrolled in the American universities she was writing papers for. Once, when she was asked to write an admissions essay for a student in China who was applying to the Eli Broad College of Business at Michigan State University, she said she dreamed of what it would be like to go there herself.

Eventually, Ms. Mbugua said, she decided to strike out on her own, and bought an account from an established writer with UvoCorp. But UvoCorp forbids such transfers, and Ms. Mbugua said the account she had purchased was shut down.

Now Ms. Mbugua finds herself at a crossroads, unsure of what to do next. She graduated from her university in 2018 and has sent her résumé to dozens of employers. Lately she has been selling kitchen utensils.

Ms. Mbugua said she never felt right about the writing she did in the names of American students and others.

“I’ve always had somehow a guilty conscience,” she said.

“People say the education system in the U.S., U.K. and other countries is on a top notch,” she said. “I wouldn’t say those students are better than us,” she said, later adding, “We have studied. We have done the assignments.”

But how prevalent is it? Newly released data from a popular plagiarism-detection company is shedding some light on the problem.

And it may not be as bad as educators think it is.

Of the more than 200 million writing assignments reviewed by Turnitin’s AI detection tool over the past year, some AI use was detected in about 1 out of 10 assignments, while only 3 out of every 100 assignments were generated mostly by AI.

These numbers have not changed much from when Turnitin released data in August of 2023 about the first three months of the use of its detection tool, said the company’s chief product officer, Annie Chechitelli.

“We hit a steady state, and it hasn’t changed dramatically since then,” she said. “There are students who are leaning on AI too much. But it’s not pervasive. It wasn’t this, ‘the sky is falling.’”

The fact that the number of students using AI to complete their schoolwork hasn’t skyrocketed in the past year dovetails with survey findings from Stanford University that were released in December. Researchers there polled students in 40 different high schools and found that the percentage of students who admitted to cheating has remained flat since the advent of ChatGPT and other readily available generative AI tools. For years before the release of ChatGPT, between 60 and 70 percent of students admitted to cheating, and that remained the same in the 2023 surveys, the researchers said.

Turnitin’s latest data release shows that in 11 percent of assignments run through its AI detection tool that at least 20 percent of each assignment had evidence of AI use in the writing. In 3 percent of the assignments, each assignment was made up of 80 percent or more of AI writing, which tracks closely with what the company was seeing just 3 months after it launched its AI detection tool .

Experts warn against fixating on cheating and plagiarism

However, a separate survey of educators has found that AI detection tools are becoming more popular with teachers, a trend that worries some experts.

The survey of middle and high school teachers by the Center for Democracy and Technology, a nonprofit focused on technology policy and consumer rights, found that 68 percent have used an AI detection tool, up substantially from the previous year. Teachers also reported in the same survey that students are increasingly getting in trouble for using AI to complete assignments. In the 2023-24 school year, 63 percent of teachers said students had gotten in trouble for being accused of using generative AI in their schoolwork, up from 48 percent last school year.

Some experts warn that fixating on plagiarism and cheating is the wrong focus.

This creates an environment where students are afraid to talk with their teachers about AI tools because they might get in trouble, said Tara Nattrass, the managing director of innovation and strategy at ISTE+ASCD, a nonprofit that offers content and professional development on educational technology and curriculum.

“We need to reframe the conversation and engage with students around the ways in which AI can support them in their learning and the ways in which it may be detrimental to their learning,” she said in an email to Education Week. “We want students to know that activities like using AI to write essays and pass them off as their own is harmful to their learning while using AI to break down difficult topics to strengthen understanding can help them in their learning.”

Shift the focus to teaching AI literacy, crafting better policies

Students said in the Stanford survey that is generally how they think AI should be used: as an aid to understanding concepts rather than a fancy plagiarism tool.

Nattrass said schools should be teaching AI literacy while including students in drafting clear AI guidelines.

Nattrass also recommends against schools using AI detection tools. They are too unreliable to authenticate students’ work, she said, and false positives can be devastating to individual students and breed a larger environment of mistrust. Some research has found that AI detection tools are especially weak at identifying the original writing of English learners from AI-driven prose.

“Students are using AI and will continue to do so with or without educator guidance,” Nattrass said. “Teaching students about safe and ethical AI use is a part of our responsibility to help them become contributing digital citizens.”

AI detection software actually uses AI to function: these tools are trained on large amounts of machine- and human-created writing so that the software can ideally recognize differences between the two.

Turnitin claims that its AI detector is 99 percent accurate at determining whether a document was written with AI, specifically ChatGPT, as long as the document was composed with at least 20 percent of AI writing, according to the company’s website.

Chechitelli pointed out that no detector or test—whether it’s a fire alarm or medical test—is 100 percent accurate.

While she said teachers should not rely solely on AI detectors to determine if a student is using AI to cheat, she makes the case that detection tools can provide teachers with valuable data.

“It is not definitive proof,” she said. “It’s a signal that taken with other signals can be used to start a conversation with a student.”

As educators become more comfortable with generative AI, Chechitelli said she predicts the focus will shift from detection to transparency: how should students cite or communicate the ways they’ve used AI? When should educators encourage students to use AI in assignments? And do schools have clear policies around AI use and what, exactly, constitutes plagiarism or cheating?

“What the feedback we’re hearing now from students is: ‘I’m gonna use it. I would love a little bit more guidance on how and when so I don’t get in trouble,” but still use it to learn, Chechitelli said.

Where Global Governance Went Wrong—and How to Fix It

International agreements have not balanced our freedoms in the way that they should..

Global governance, never really settled, has recently been having an especially hard time. Everyone believes in a rules-based system, but everyone wants to make the rules and dislikes it when the rules work against them, saying that they infringe on their sovereignty and their freedom. There are deep asymmetries, with the powerful countries not only making the rules but also breaking them almost at will, which raises the question: Do we even have a rules-based system, or is it just a facade? Of course, in such circumstances, those who break the rules say they only do so because others are, too.

The current moment is a good illustration. It is the product of longstanding beliefs and power relations. Under this system, industrial subsidies were a no-no, forbidden (so it was thought) not just by World Trade Organization rules, but also by the dictates of what was considered sound economics. “Sound economics” was that set of doctrines known as neoliberal economics, which promised growth and prosperity through, mostly, supposedly freeing the economy by allowing so-called free enterprise to flourish. The “liberal” in neoliberalism stood for freedom and “neo” for new, suggesting that it was a different and updated version of 19 th -century liberalism.

In fact, it was neither really new nor really liberating. True, it gave firms more rights to pollute, but in doing so, it took away the freedom to breathe clean air—or in the case of those with asthma, sometimes even the most fundamental of all freedoms, the freedom to live.

“Freedom” meant freedom for the monopolists to exploit consumers, for the monopsonists (the large number of firms that have market power over labor) to exploit workers, and freedom for the banks to exploit all of us—engineering the most massive financial crisis in history, which required taxpayers to fork out trillions of dollars in bailouts, often hidden, to ensure that the so-called free enterprise system could survive.

The promise that this liberalization would lead to faster growth from which all would benefit never materialized. Under these doctrines that have prevailed for more than four decades, growth has actually slowed in most advanced countries. For instance, real growth in GDP per capita (average percent increase per annum) according to data compiled by the St. Louis Fed, was 2.5% from 1960 to 1990, but slowed to 1.5% from 1990 to 2018. Instead of trickle-down economics, where everyone would benefit, we had trickle-up economics, where the top 1 percent and especially the top 0.1 percent, got a larger and larger slice of the pie.

These are illustrations of British political theorist Isaiah Berlin’s dictum that “total liberty for wolves is death to the lambs”; or, as I have sometimes put it less gracefully, freedom for some has meant the unfreedom of others—their loss of freedom.

Just as individuals rightly cherish their freedom, countries do, too, often under the name “sovereignty.” But while these words are easily uttered, there is too little thought about their deeper meanings. Economics has weighed into the debate about what freedom and sovereignty mean, with John Stuart Mill’s contribution in the 19th century ( On Liberty ), and Milton Friedman’s and Friedrich Hayek’s works in the mid-20th ( Capitalism and Freedom and The Road to Serfdom ).

But contrary to what Hayek and Friedman asserted, free and unfettered markets do not lead to efficiency and the well-being of society; that should be obvious to anyone looking around. Just think of the inequality crisis, the climate crisis, the opioid crisis, the childhood diabetes crisis, or the 2008 financial crisis.  These are crises created by the market, exacerbated by the market, and/or crises which the market hasn’t been able to deal with adequately.

Economic theorists (including me) have shown that whenever there is imperfect information or imperfect markets (that is to say, always), there is a presumption that markets are not efficient. Even a very little bit of imperfection can have big effects.

The problem is that much of the global economic architecture designed over recent decades has been based on neoliberalism—the kinds of ideas that Hayek and Friedman put forward. The system of rules that evolved from there must be fundamentally rethought.

From an economist’s perspective, freedom is the “freedom to do,” meaning the size of the opportunity set of what a person can do, or the range of the choices that are available.

Someone on the verge of starvation has no real freedom—she does what she must to survive. A rich person obviously has more freedom to choose. “Freedom to do” is also constrained when an individual is harmed. Obviously, if an individual is killed by a gunman or a virus, or even hospitalized by COVID-19, he has lost freedom in a meaningful sense, and we then have a dramatic illustration of Berlin’s dictum: Freedom for some—the freedom to carry guns, or to not be masked, or to be unvaccinated—may entail a large loss of freedom for others.

The same principle applies to the international arena. The rules-based trade system consists of a set of rules intended to expand the freedoms of all in a meaningful way by imposing constraints. The idea that constraints can be freeing, while seemingly self-contradictory, is obvious: Stoplights force us to take turns going through intersections, but without this seeming constraint, there would be gridlock and no one would be able to move.

All contracts are agreements about constraints—with one party agreeing to do or not do something in return for another person making other promises—with the belief that in doing so, all parties will be better off. Of course, if one party cheats and doesn’t deliver on its promise, then that party gains at the expense of others. And there is always the temptation to do so, which is why we require governments to enforce contracts, so that promises mean something. No government could enforce all contracts, and the so-called free market would crash if all participants were grifters.

But while there are similarities between discussions of freedom at the individual level and the country level, there are also a couple of big differences. Most importantly, there is no global government to ensure that the powerful countries obey an agreement, as we are seeing today in the case of U.S. industrial subsidies. The World Trade Organization (WTO) generally forbids such subsidies and especially disapproves of some of the provisions—such as requiring domestic manufacturing (“Made in America”)—in legislation passed recently by the U.S. Congress, including the CHIPS and Science Act .

No one power or group can uphold the international order anymore—and that means much more geopolitical uncertainty ahead.

Moreover, within democratic countries, the role of power in the making and enforcement of the rules is often obscure; we know that inequalities in wealth and income get translated into inequalities in political power, which determines who gets to design the rules and how they are enforced. An imbalance of power means that the powerful within a country determine the rules in ways that benefit them, often at the expense of the weak.

Still, the democratic context means that every once in a while, power is checked—as it was when the antitrust laws were passed in the United States in the latter part of the 19th century, or the Wagner Act was passed during the New Deal of the 1930s, giving workers more power.

In an international setting, power is even more concentrated, and democratic forces are even weaker. What has happened in the past few years illustrates this. The United States was at the center in constructing the rules-based system, in both designing the rules and how they were to be enforced, including dispute resolutions through the WTO’s Appellate Body.  But when the rules—such as those concerning industrial subsidies—were inconvenient, it decided to ignore them, knowing that there was little, if anything, that any country could or would do about it. So much for the rules-based system.

And the United States’ confidence that nothing could or would be done was reinforced by the fact that it had effectively defenestrated the Appellate Body, because that Body had made decisions it didn’t like, and the U.S. thought that the Body was guilty of overreaching, going beyond what it was entitled to do. But rather than going back to the WTO and clarifying what the Body’s role should be, the U.S. simply hamstrung any adjudication within the WTO. The situation would be like suspending the U.S. Supreme Court while figuring out how to bring the justices back to a reasonable theory of jurisprudence.

This imbalance of power has played out repeatedly in recent years. When developed countries attempted to implement industrial policies—even mild policies, such as Brazil’s effort to provide capital to aerospace corporation Embraer at reasonable interest rates through that country’s development bank (as opposed to the outlandishly high rates then prevailing in its financial markets)—they were attacked . When Indonesia tried to ensure that more of the added value associated with its rich nickel deposits remained in Indonesia, it was attacked .

Even worse, when more than 100 countries proposed a waiver of intellectual property related to COVID-19—in the spirit of the compulsory licenses already seemingly part of the WTO framework, but given the urgency of the moment, a less bureaucratic process was of the essence—they were denied. The result: vaccine apartheid , where the advanced countries had all the vaccines they wanted, and the developing countries had almost zero access. This almost surely resulted in thousands of unnecessary deaths and tens of thousands of unnecessary hospitalizations in the poorer countries.

These are obviously no small matters in the well-being of citizens in around the world, especially not for developing countries and emerging markets. Nor are they small matters in geoeconomics and geopolitics. The neoliberal rules forbidding subsidies effectively meant that developing countries couldn’t catch up to the advanced countries; the rules condemned them to being commodity producers, reserving the higher value-added production for the advanced countries.

This tariff structure has been rightly criticized as a crucial tool in the preservation of colonial trade patterns—aided and abetted by other unfair aspects of the trade regime, such as escalating tariffs. As economist Ha-Joon Chang has put it , the advanced countries “kicked away the ladder” from which they themselves had used.

It should be clear, too, that there are geopolitical consequences in refusing to play by the rules. The United States and the advanced countries are losing support for some of the most important issues requiring global cooperation, including climate change , global health, and the support needed to resolve the conflict in Ukraine as well as Washington’s apparent battle for democracy and hegemony with China.

The global south may yet steer the ship of international rules back on course. When the United States was the hegemon, it could do as it wanted, but its influence is now being challenged. China has provided more infrastructure than the United States has; early on in the pandemic, both China and Russia seemed more generous in providing vaccines.

Washington told the developing countries to open their doors to its multinationals, but when those countries asked that the rich corporations pay the taxes they owed, the United States was not supportive—reforms under an Organization for Economic Cooperation and Development initiative called BEPS (Base Erosion and Profit Shifting) generated sparse revenues for the poorer countries, and in return, the developing countries were asked to forego digital taxation. When, accordingly, the African Union asked for a change in venue of the discussions of global tax reform to the United Nations, the United States not only opposed it , but also tried to strong-arm others to do so. Last November, the United States lost the vote overwhelmingly at the U.N.

So whither goes global governance? In the absence of rules, the law of the jungle prevails. While the United States might win that fight, it would simultaneously lose the cooperation it needs so badly in a host of arenas. Overall, it would lose.

It is in the interests of the United States to abandon the corporate-driven rules-based system and work instead to create a set of at least basic rules that would reflect common interests. For instance, instead of the comprehensive so-called free trade agreements, such as the Trans-Pacific Partnership , that were really managed trade agreements (and managed specifically in the interests of Big Pharma and some of the big polluters), the United States should have narrow agreements—say, a green agreement to share knowledge and technology, promote sustainable forests, and work together to save the planet.

We need agreements that do more to constrain the large countries—whose actions can hurt the global economy—and do less to constrain the small, whose actions have little global consequences.

For instance, we need rules that would constrain the European Union and the United States from using monetary policy in ways that benefit their economies at the expense of others, as the United States has repeatedly done. Today, even the United States recognizes that investment agreements (such as NAFTA’s infamous Chapter 11 ) that allow corporations to sue states actually exert constraints on sovereignty without commensurate benefits. A key difference between NAFTA and the trade agreement that succeeded it is the effective dropping of Chapter 11. But the United States should go further, strengthening the ability of any government party to an agreement to sue corporations when terms of the agreement have been violated.

To win the hearts and minds in the new cold war brewing between the United States and China, the United States needs to do more. Washington needs to use the money it has to provide assistance to the poor, and the power that it possesses to construct rules that are fair. Nowhere is that more evident than in response to the debt crisis that the United States faces today and the recent pandemic, another of which the world will almost surely face in the future.

With most sovereign debt contracts written in the United States, Washington has the power to change the legal framework governing these contracts in ways that make the resolution of crises—where countries can’t pay back what they owe—faster and better. This approach would address the “too little, too late” problem by which one crisis is followed by another, which has plagued the world for so long. With more creditors entering the field, debt resolution is becoming ever more difficult. There are important proposals currently before the New York legislature (where most of the money is raised), but support from the Biden administration would be enormously helpful.

The world has just gone through a terrible pandemic, and the recognition that there will be another has spurred work on a proposed pandemic preparedness treaty. Unfortunately, under the influence of Big Pharma, there are no provisions in the treaty for the kind of intellectual property waiver that the world so badly needs, let alone the technology transfer that would allow the production of all the products—protective gear, vaccines, and therapeutics—necessary to fight the next disease that strikes.

The freedom to live is the most important freedom that we have. Our global agreements have not balanced our freedoms in the way they should. Better global agreements can benefit all countries, though not necessarily all people within them: Such agreements would constrain the power of the exploiters to exploit the rest of us, thereby making a dent on their bottom line, but they would benefit society more generally.

Striving to create global agreements that are fair and generous to the poor would, I believe, be in the United States’ self-interest—in its “enlightened” self-interest, taking into account the new geoeconomics and geopolitics. It was never in the United States’ self-interest to pursue a corporatist global agenda, even when it was the hegemon. But it is especially not so today.

The Lawyer Defending Idaho’s Abortion Ban Irritated the One Justice He Needed on His Side

Justice Amy Coney Barrett famously provided the crucial fifth vote to overturn Roe v. Wade in 2022. So if you are arguing in favor of an abortion ban, you probably don’t want to alienate Barrett—by, say, condescendingly dismissing her concerns when she points out that your legal theory doesn’t make any sense. Yet that is what Joshua Turner did on Wednesday while defending Idaho’s draconian abortion restrictions, and much to Barrett’s evident irritation. Turner—who represented the Idaho solicitor general’s office in the second major abortion case to come before the high court after it promised us in its Dobbs opinion that the court was out of the abortion business in 2022—might just have lost his case by repeatedly mansplaining his self-contradictory position to Barrett and the other three women justices. In his toneless, dispassionate telling, his entirely incomprehensible position was just too complex for them to understand. And so he just kept repeating it, over and over. These justices, including Barrett, sounded increasingly fed up with his chin-stroking dissembling on an issue that’s literally life-or-death for pregnant women in red states. If the court’s male members noticed Turner’s dismissive attitude toward their colleagues, they didn’t care. The gender divide on the court has never been so revealing.

Perhaps because Dobbs was a threat to unknown future women, whereas real women are now being left to hemorrhage, lose the functioning of their reproductive organs, or be popped onto helicopters to receive out-of-state stabilizing care, none of the life-and-death harms being experienced in red states around the country feel very theoretical to anyone who has thought about pregnancy in a serious way. Yet, for male justices more worried about harms to the spending clause , nothing about potentially lethal pregnancies warranted even a moment’s pause.

Wednesday’s case, Moyle v. United States , revolves around a clash between Idaho law and a 1986 federal statute called the Emergency Medical Treatment and Labor Act (or EMTALA). Idaho’s abortion ban has no exception for the health of the patient; rather, it criminalizes abortion unless it’s “necessary to prevent the death of the pregnant woman.” EMTALA, meanwhile, requires virtually all hospitals to provide stabilizing treatment for any condition that “could reasonably be expected” to put the patient’s health “in serious jeopardy,” as well as any condition that could seriously impair bodily functions or organs.

The Biden administration argues there’s a conflict between Idaho law and EMTALA: Where Idaho allows termination only when the patient is at the brink of death, EMTALA mandates intervention earlier, to stabilize the patient before she is literally dying, including situations in which she is facing organ damage, infertility, or other serious harms. So the administration sued the state, and a federal judge issued an injunction compelling Idaho to allow emergency abortions to preserve a patient’s “health.” Now SCOTUS must decide whether the federal statute limits the ability of states like Idaho to criminalize abortions that are health-sparing but not necessarily lifesaving. And that means slipping into their white coats and stethoscopes and explaining to America’s emergency physicians how to do their jobs without risking two to five years in prison and a loss of licensure for making poor guesses about what stabilizing care involves.

Turner, representing Idaho on Wednesday, made a hodgepodge of his state’s arguments that are frankly difficult to harmonize. He seemed to make three central claims: First, that EMTALA does not mandate any particular standard of care (despite prescribing one pretty clearly); second, that even if it did, Idaho’s law would comport with that standard (even though it criminalizes abortion as stabilizing treatment); and third, that abortion is never a standard of care under Idaho law. Except for when it is, which is when it’s necessary to save a patient’s life. Which is a narrower standard than what EMTALA mandates. Which is irrelevant, because, according to Turner, EMTALA doesn’t mandate anything at all. But also, that there is a difference between the care demanded by EMTALA and Idaho, but also that there is no difference, but also that physicians shouldn’t sweat this because beneficent prosecutors probably won’t jail them on the basis of a close call.  

Confused? So were the justices. Progressive Justices Elena Kagan, Ketanji Brown Jackson, and Sonia Sotomayor all took turns trying to draw out a single scrap of consistent logic from Turner’s rhetorical detritus. Kagan pressed him to admit that EMTALA sets forth an “objective standard” of care—the stabilization of a patient—that sometimes includes abortion. He refused. She sounded aghast. Does the statute, she asked, at least require states to permit abortions for ectopic pregnancies, which will cause death if not terminated? No, Turner responded, adding: “That understanding is a humble one with respect to the federalism rule of states.” To which Kagan in turn responded: “It may be too humble for women’s health.”

Jackson questioned Turner’s insistence that EMTALA does not require anything that Idaho prohibits, rebuking his strange declaration that the state’s trigger ban simply defers to the “medical judgment” of state legislatures rather than doctors. And Sotomayor pummeled Turner with real stories, all ripped from the headlines, of women denied abortions and then forced to bleed out in agony, then asked him whether these women would be allowed to terminate under Idaho law. When Turner refused to give a yes-or-no answer, Barrett finally stepped in. “I’m kind of shocked, actually,” she told Turner, “because I thought your own expert had said below that these kinds of cases were covered. And you’re now saying they’re not?” Turner responded that he wasn’t, to which Barrett retorted: “Well, you’re hedging. I mean, Justice Sotomayor is asking you, ‘Would this be covered or not,’ and it was my understanding that the legislature’s witnesses said that these would be covered.” Turner told her, in short, not quite —the witnesses said that, in “exercising their medical judgment, they could in good faith determine that lifesaving care was necessary.” Barrett sounded irritated. “But some doctors might reach a contrary conclusion, I think is what Justice Sotomayor is asking you,” she told him. “If they reached the conclusion that the legislature’s doctors did, would they be prosecuted under Idaho law?”

Turner said no, but Barrett wasn’t convinced. “What if the prosecutor thought differently?” she went on. “What if the prosecutor thought, well, I don’t think any good-faith doctor could draw that conclusion, I’m going to put on my expert?” Remarkably, Turner told her that’s “the nature of prosecutorial discretion”—meaning prosecutors might well bring charges anyway. At that point, doctors would have to defend their decision in court while facing a two-to-five- year prison sentence. (And ER doctors also face lawsuits if they defer lifesaving care.) So in Idaho you can pretty much just decide how to end your career, while spinning the wheel until someone sues you. No wonder physicians are bolting from the state.

Barrett was, to put it mildly, not satisfied. Later, when Turner tried to blame the Department of Justice for launching this case, she again put him in his place. “Well, hold on a second,” she said. “You’re here because there’s an injunction precluding you from enforcing your law. And if your law can fully operate because EMTALA doesn’t curb Idaho’s authority to enforce its law …” But she couldn’t finish her thought, because Turner interrupted her. It was one of many interruptions she would face from the Idaho attorney. And as the morning went on, she was less and less indulgent of his let-me-explain-this-like-you’re-a-toddler style of argument. When Turner accused the solicitor general of taking an overly aggressive litigation posture, Barrett declined to engage, instead sharply informing him: “OK, well, I would like to hear the solicitor general’s response to that,” and moving on. When she called out one of his silliest claims—that the Justice Department demanded emergency abortions to treat a “mental health condition”—Barrett sounded fed up. Turner hemmed and hawed, butchering the statute so badly that she had to step in to remind him of what it actually said.

When Solicitor General Elizabeth Prelogar had her turn at the lectern, she faced a barrage of questions from Justices Clarence Thomas and Neil Gorsuch about whether Congress had run afoul of the spending clause when it passed EMTALA, an issue that was not briefed and should not be in the case. Samuel Alito, who brought all of his dictionary-wielding and woman-erasing skills from his star turn in Dobbs to bear, devoted his time to defending the “unborn child” who—in his view—was the real goal of EMTALA’s drafters, laying the groundwork for fetal personhood arguments that were too radioactive even for Turner to take on. Alito hectored Prelogar about her grasp of preemption, her reading of text, and her understanding of the term “unborn child,” casting her as some drunk lunatic who had staggered into court without any comprehension of the law.

Throughout the day doctors were referenced as “he” whereas every nurse was a “she.” Women were, as Alito conceded, “individuals,” but man, oh man, are they ever whiny and demanding. Alito also breathlessly cited Ronald Reagan as the deity who signed EMTALA and would never have wanted it to undermine the precious rights of “unborn children.” And a little “temporary” organ damage, he mused, might not be so bad if suffered for the benefit of a fetus. The task fell to Kagan to remind everyone that in the few months that Idaho has enforced its near-total ban, six women have already been airlifted to other states to receive emergency abortions that are criminal under Idaho law. Real women, flown out in great pain and at great expense, to get treatment that is objectively recognized as the standard of care.

It’s not clear where this case will land: Chief Justice John Roberts and Justice Brett Kavanaugh asked a handful of breezy questions but didn’t tip their hands. It’s odd, though, that Wednesday’s arguments didn’t fully break through the news cycle (as tomorrow’s in the Donald Trump immunity case surely will). As Turner conceded, none of this madness will stop at Idaho; at least five other states, including Texas, have nearly identical bans. But for anyone who listened to these arguments, the symmetry was striking: Turner could spew whatever nonsense he wanted, ignoring serious questions from female interlocutors or evading them because they were invisible to him—just as the pregnant women who will get sicker and lose blood and be turned away at hospitals are invisible to the state he represents.
