But if in a motivation business letter, a candidate can show his/her creativity, the military document must balance the seriousness of the position — be clear, understandable, and logically constructed.

Cover Letter for Military Position

The military cover letter should have a clear structure and official format. It has to be short enough, but informative and must disclose the central resume information (but do not repeat it). Here is a  perfect structure for military cover letter examples : 

  • Your contact information  (name, home address, email address, and phone number). 
  • Date. 
  • Employer’s information  (recruiter name, company/agency name, address). 
  • Introduction paragraph.  Describe why you are writing and what position you want to take. Why do you want to work in this organization, and what do you like about it. Try to attract the attention of the reader from the first 2-3 sentences. 
  • Body.  You should formulate an association between your background and the company’s requirements. Mention directly related military experience and/or education, summarize them. Do not forget to notify the relevant skills (better hard ones) or professional accomplishments. Write additional information about the agency or about respected employees who work there (if you have).

Some Advice to Get Noticed with Military Cover Letter 

Before sending your cover letter to military recruiters or directly to the employer, read these tips and several times proofread your paper.

  • Research the company you are applying to. To give a definite answer about why you want to work in this agency and this position, you need to have more detailed information.
  • If you have military connections and/or recommendations, write about them. Ask your former commander to write you a letter of recommendation or permission to indicate his/her name with positive feedback. It will 100% increase your chances.
  • No military jargon. The recruiter who will read your letter may not be related to the military industry. It means you have to explain your army skills in plain language.
  • Address the reader by name. If you do not know who will read your resume and cover letter, try to find out. Show your ability to seek information and perseverance.

Drafting a Defence – tips and examples

This factsheet should be used when you have been served with a Claim and Statement of Claim. If you want to defend the claim, you need to file a Defence.

You have 28 days from the date you were served with the claim to file your Defence. This may seem like plenty of time. However, your Defence may be the single most important court document that you draft in the proceedings, so you should start preparing as soon as possible to ensure there is enough time to obtain any advice or assistance you might require.

It is up to you to make sure that your Defence is filed in the registry by the due date. If you do not file a Defence by the due date, the plaintiff may be entitled to act as though you have decided not to defend the claim, and obtain default judgment in their favour without any further notice to you.

If you have been served with court documents that seem similar to a claim and Statement of Claim, but are titled “originating application” and “affidavit”, you only need to file a notice of address for service. You are not required to file a Defence at this stage.

Before we get started

In this factsheet, “UCPR” means  Uniform Civil Procedure Rules 1999 . 

The UCPR is the formal rules that set out how civil court claims must be conducted, from the start of the proceedings in court right through to what to do when the court has made final orders after the trial. If you ever need to know what the next step is in your court proceedings, or how to complete a particular step, you can look it up in the UCPR.

The UCPR is kept updated online under the  Supreme Court Act .

The format of the Defence must also comply with the UCPR. You can access a Defence form from the Queensland Courts Website.

Drafting a Defence

The first thing to consider is whether you want to defend the claim. There are some circumstances where you may agree that you owe the plaintiff the whole of the amount being claimed. If so, it may be cheaper to negotiate payment of the debt, rather than defending the claim.

If you do want to defend the claim, you need to complete two court forms:

  • UCPR Form 6  A Notice of Intention to Defend:  This form lets the plaintiff know that you intend to resist their claim. It also provides your contact details for future communication.
  • UCPR Form 17  The Defence:  This is where you set out the reasons why you are defending the claim – why the plaintiff should not be awarded the damages they are after.

This factsheet will help you complete the Defence.

Step 1: Respond to the allegations

The most important task of your Defence is to respond to the allegations made by the plaintiff in the Statement of Claim.

To commence proceedings, the plaintiff has filed two court documents – a Claim (Form 2), and a Statement of Claim (Form 16). When drafting your Defence, you need to respond to the Statement of Claim, which will be the longer of the two documents.

The Statement of Claim should be drafted as a series of numbered paragraphs, sometimes with sub-paragraphs. View each of those numbered paragraphs as a separate allegation that you must respond to. To make your Defence easy to read, and to help ensure you respond to all of the paragraphs, you can respond to each paragraph in turn using the same numbering as in the Statement of Claim.

For each of the allegations in the Statement of Claim, you must say whether the allegation is:

True (or admitted), for example:

False (or denied), for example:

Not admitted, for example:

If you do not respond to an allegation, the court can assume that you have admitted the allegation, so it is important to make sure you have addressed all of the allegations  ( rule 166 UCPR ) .

If you are satisfied that an allegation is true, you should admit the allegation.

You can often admit a lot of the allegations in a Statement of Claim and still draft a successful Defence.

If you do not admit the allegation, the plaintiff can assume that it is contested and will set about gathering evidence to prove the allegation. This may have adverse consequences for you, and could make the proceedings unnecessarily lengthy.

If you believe an allegation is untrue, you should deny the allegation.

If you deny an allegation, you must include reasons why – that is, your alternative version of the key facts. A better defence would be:

Non admissions

You only have a short amount of time to prepare your Defence and many of the allegations in the Statement of Claim may be outside your knowledge at this point. You can take the third option for those allegations – a non admission. For example:

Once again, you need to provide a reason why the allegation is not being admitted. If it is because you have not completed your investigations, you have an obligation to set about investigating the allegation and you should amend your Defence in due course to clarify your position.

Rule 166 of the UCPR sets out the obligations that you will have if you plead a non admission in your Defence.

Step 2: Make sure you have argued a Defence

If you have responded to all of the allegations, you are most of the way there. However, it is also important to make sure that you have put forward your reason as to why the plaintiff should not be entitled to the damages claimed.

If you think that you need to include more key facts in order to properly set out your Defence, simply add additional, numbered paragraphs to the end of your Defence. This must include any material facts you will rely on to defend the claim at trial that you have not already included. You must not take the other party by surprise at trial – all of the key facts you want to rely on must be included in your Defence ( UCPR rule 149). For example:

There may also be particular types of defences that you could be required to particularise, such as the defences of performance of a contract, contributory negligence or waiver (to name just a few). Check rule 150 of the UCPR to ensure that there are no additional matters that you need to specifically plead in your Defence.

At the same time, you must also be succinct – your Defence must be as brief as the key facts allow. If your Defence is unreasonably long, it could make the proceedings lengthy and difficult to defend, or you may find that parts of your Defence are “struck out”. Rule 149 of the UCPR provides more information about this.

Step 3: Filing and service

“Filing” a document means placing a copy of the document on the court’s file, which is held at the court’s registry. The contact details of each court registry are available on the  Queensland Courts Website.

Keep both your notice of intention to defend and your Defence together – those 2 documents combined make up your Defence.

You are required to file your Defence (along with your notice of intention to defend) in the same court registry where the plaintiff’s claim has been filed. And remember, you must do this within 28 days of the date that you were served with the plaintiff’s claim.

You can file your Defence:

  • In person: by taking two copies of your Defence to the registry in person; or
  • By post: by sending two copies of your Defence, with a reply-paid self-addressed envelope, to the registry to be filed (it is up to you to ensure the documents are received by the court registry on time).

You do not need to pay any fees when filing your Defence.

The registry will stamp and retain one of the copies of your Defence. This will be kept on the court’s file. The registry will also stamp the second copy and return that to you.

You must then serve a copy of the Defence on the plaintiff (and on any other parties, such as other defendants). You must serve the Defence as soon as possible. You can do this in person or by sending the stamped Defence to the plaintiff at the contact details shown on the plaintiff’s claim. If the plaintiff has solicitors, you should send the Defence to the solicitors. If there are other parties to serve, make enough copies for them. Make sure you keep a copy of the Defence for your own future reference.

How to fill out the student-loan forgiveness application for defrauded borrowers

In August, a federal judge granted preliminary approval in the Sweet v. Cardona class action lawsuit, setting the stage to wipe out roughly $6 billion in student-loan debt for more than 200,000 borrowers. If you went to one of the 150 schools listed in the class action, you may qualify for full or partial student-loan forgiveness under a program called " borrower defense to loan repayment ."

To get your loans forgiven, you must fill out a borrower defense application by November 3, 2022.

"It's a daunting process," says Sonia Lewis, AKA The Student Loan Doctor , who has helped over 20,000 people navigate their federal student loans. "We do have an on-demand class to help people through this process, but anyone can do it themselves," she adds.

If you submitted a borrower defense application before June 22, 2022, you are already a part of the class. But if you attended one of the named schools and have not yet applied for borrower defense, there's still time.

Your loans will be put in forbearance while you wait for a decision

Those who submit borrower defense applications from now until November 3 will receive a decision from the Department of Education in three years. "Once the application has been received and processed," says Lewis, "borrowers will be placed into an administrative forbearance while the government reviews the application."

While your loans are in forbearance, interest will accumulate, and may capitalize at the end of the forbearance period (meaning your interest will be added to your principal balance and any new interest will grow on that larger balance). Making interest-only payments during the forbearance period will help you avoid this.

Lewis encourages people to apply to other forgiveness programs and "be prepared for repayment come January 2023." She says borrowers typically receive correspondence saying that their borrower defense application has been received. After that, administrative forbearance kicks in and you don't need to make any payments until they reach a decision. "Borrowers should continue to pay on their loans while waiting for a response that their application has been received."

Here's a simple three-step process that Lewis recommends to help you get your borrower defense application approved faster.

1. Start filling out the borrower defense application on studentaid.gov

First, you need to start filling out the borrower defense application , which can be found at studentaid.gov . You'll need the following information:

  • Your name, address, date of birth, Social Security number, and other contact information
  • The name and address of the school you attended
  • Transcripts
  • Enrollment agreements
  • Promotional materials from your school
  • Communications with school officials or employees
  • Student manual
  • Course catalog
  • Legal documents, and more

Lewis says that where most people get lost is when the form asks for the reason you deserve a refund in the first place. 

2. Google '[your school name] vs. Department of Education'

"This part is like passing a test," says Lewis. "Type in a Google search for '[your school name] vs. the Department of Education.'" From there, the official Department of Education announcement will list all the reasons the school is being sued in the first place.

For example, for ITT Tech, the Department of Education website says, "ITT engaged in widespread and pervasive misrepresentations related to the ability of students to get a job or transfer credits, and lying about the programmatic accreditation of ITT's associate degree in nursing."

3. Copy the exact language listed in the lawsuit to your application, if it applies

Once you've Googled the details of the lawsuit, Lewis says you need to copy and paste that exact wording into the application. "Nine times out of 10, this applies to most students who graduated from those schools because it was a universal thing."

Section 4 of the borrower defense application has a few places where you can paste this information. There are 10 parts to Section 4:

  • Admissions selectivity: Relevant if the school you went to made false claims about the number of people they were admitting, or how hard it was to get into the school, just to name a few examples
  • Representations to third party: Relevant if the school you went to misrepresented or falsely stated their ranking on any "Best Schools" list
  • Urgency to enroll: If your school told you that you had limited time to enroll in your program
  • Educational services: If your school misrepresented or lied about your teachers' qualifications, or the institution's accreditation status
  • Employment prospects: If your school misrepresented or made false claims about their job-placement rates
  • Program cost and nature of the loan: If your school failed to explain the total cost of the program and what kind of loans you were taking out to pay for tuition
  • Transferring credits: If your school gave false information about your ability to transfer credits to and from another school
  • Career services: If your school failed to provide the career services that you were promised
  • Judgment (these last two sections only apply to borrowers who received a Direct Loan between July 1, 2017 and July 1, 2020)
  • Breach of contract

Within each section, there are also text boxes where you can explain your situation. For the ITT Tech example, you would write "ITT lied about the programmatic accreditation of ITT's associate degree in nursing" in the text box under educational services, and "ITT engaged in widespread and pervasive misrepresentations related to the ability of students to get a job or transfer credits" in the boxes under the employment services and transferring credits sections.

Lewis says, "You're going to take that information and retype it because that's probably exactly what happened to you," adding that the exact language might make it easier for the people processing the applications to process your responses.

If you're skeptical about starting the application, Lewis says, "These schools were in contempt for illegal practices. They're giving back money for a lot of these schools, like a check in the mail if you attended."

  • Try not to focus on your work circumstances too much, as the registrar may start to get the idea that a “license to possess a firearm for business purposes” would be better suited and they might refuse your self-defense license accordingly.
  • Are you a vulnerable person? If you are a lady with a small frame, or an older person, or someone with a physical disability, then you should mention that too. This demographic is an easy target for criminals because they are not easily able to defend themselves.

3. Explain why you need this specific handgun for self-defense.

Now that you have explained to the registrar why you need a firearm for self-defense, you now need to convince them that the firearm for which you are applying will fulfill that role. You might be tempted to think that your choice of firearm is none of their business, but this kind of attitude will not help you get approval.

Assuming that you bought the correct firearm, explain to the registrar why you chose that particular firearm for self-defense. This is also an opportunity to show the registrar that you are serious about obtaining a firearm and that you have done your research on the matter. Explain why you chose the particular caliber, make, and model.

Be sure to emphasize the firearms safety features, this will put the registrar at ease that the firearm is indeed safe, and it shows that you are a safety conscience person.

Here is a short example of how I explained this in my most recent self defense firearm motivation that was approved.

4. If you have an existing handgun, explain why you cannot use that particular firearm for self-defense.

Second to “failed to convince the registrar”, another reason for refusal often seen is that the applicant already owns a firearm that can fulfill the role for which a new license is being applied for.

With that in mind, it is important to explain to the registrar that you are not able to, or willing to use any existing handgun that you may own for the purpose of self-defense. Point out why exactly you will not be using your existing handgun for self-defense. Reasons will include the fact that the handgun may be too large, the wrong caliber (too large or too small), and that it will have been licensed to be used for sport shooting or hunting only.

When I applied for my most recent self-defense firearm, I already owned another 9mm, and this is how I explained to the registrar why I can and won’t use that firearm for self-defense.

5. Explain why you are fit to carry a firearm for self-defense.

Now you need to explain to the registrar why you are mentally stable, and responsible enough to carry a firearm.

Start off by telling the registrar your entire history with firearms. When did you first start shooting? Who taught you to shoot and safely handle and store firearms? Point out that you have no history of being negligent with a firearm and that you have always been careful with them. It will also help to mention any involvement in sport shooting and memberships of any sport shooting clubs. This will help to demonstrate that you have experience with the safe handling and storage of firearms.

I have been shooting with my father since I was a child, and have continued that hobby into my adulthood as a dedicated sport shooter, and this is how I demonstrated that in my self-defense license application.

6. Give details about your proficiency training and competency certificate.

Up until now, you have had your say with regards to the need for a firearm for self-defense, explained why the specific firearm is suitable for the purpose you are applying and your circumstance, that you are responsible and mentally stable. The next part is where you get a bit more technical.

Proficiency training information and certificates

In this section explain to the registrar that you have done the proficiency training according to the requirements of the Firearms Control Act. You will give them the information about your training, such as the training provider, course number, certificate number, date, contact details, and anything else you think will be relevant.

Competency certificate

You should have applied for a competency certificate prior to applying for your license to possess a firearm.

In this section, you need to provide information about your SAPS competency certificate, which is obtainable from your DFO at your local police station. Make sure you mention your competency certificate number and attach a copy of the certificate to your motivation letter.

7. Explain how and where you will be storing the handgun when not in use.

One of the biggest concerns the Central Firearm Registry has is that of lost and stolen firearms ending up in the hands of criminals, and rightly so. The majority of firearm-related crime is committed with lost or stolen firearms, many of which were lost by SAPS themselves, but that is irrelevant to our application.

Here the goal is to convince the registrar that you have taken all the steps to make sure the firearm is always safe, even when not in your possession. Start by describing the safe that you have had installed, and be sure to explain that it complies with the relevant SABS standards as required by the police. To make sure your safe complies, be sure to read my article: “ What are the gun safe requirements for South Africa? “

But don’t end it there, go ahead and give the registrar more reasons to feel at ease by mentioning if you have made any other security precautions. These might include alarm systems, security cameras, armed response, dogs, walls, electric fencing, and lighting.

It’s also worth mentioning that you maintain a good relationship with your neighbors.

This is how I did that in my self-defense application.

8. Conclude the letter with a declaration.

This is the last section in your motivation letter, so be sure to leave it on a good note. Have a sincere but neutral tone as you conclude the letter. Assure the registrar that you have no criminal record (assuming that’s true), and if true, that you have never been accused or found guilty of any offense, inside or outside the borders of South Africa. Go a step further and say that you have never been accused, charged, or found guilty of any offense that can declare you unfit to possess a firearm as for the Firearms Control Act. Also, state that you have no record of any liquor or substance abuse.

Assure the registrar that you have sober habits and lead a healthy and responsible lifestyle. If you have been a firearm owner in the past, be sure to let the registrar know as that shows that you have a proven track record of being a responsible firearm owner.

Offer to put forward family, friends, colleagues, etc. as character references (in addition to the character references required by SAPS in your application), and invite the registrar to contact you directly if they need to clarify anything instead of simply refusing the license as lack of motivation.

After you have dated and signed the letter, include a small section at the end with the title: “REQUEST FOR A PRIOR NOTICE AND THE OPPORTUNITY TO MAKE REPRESENTATIONS BEFORE THE DECISION IS MADE” . What you are requesting here is that if the registrar decides to refuse the license, that they contact you with such intent before officially refusing the application, giving you a chance to respond accordingly. It is not proven that it makes any difference, however, it is worth requesting and could save you the trouble of having to appeal a decision that could have been in your favor if you had an opportunity to provide more information or documents.

With that said, make sure that the contact information you gave is up to date should the registrar need to contact you.

“Lack of motivation” or “Failed to convince the registrar” are two of the most commonly used reasons for declining firearm license applications. This is why the motivation letter is so important. You need to completely convince the registrar that you truly need a firearm for self-defense. What’s more, you need to make sure that you back up all your claims with evidence, and avoid hearsay at all costs.

While writing a motivation letter, put yourself in the shoes of the registrar who has the power to approve or decline your firearm license application. Pretend that you are the registrar, and you are looking for any excuse to decline your application.

To make sure you cover all your bases, and to make your letter easy to read, be sure to make sub-headings for each section of your motivation, namely:

  • Introduction.
  • The need for the handgun for self-defense.
  • Why you need this specific handgun for self-defense.
  • If you have any existing handguns, be sure to explain why they are not suitable for self-defense.
  • Explain why you are fit to possess a firearm.
  • Give information about your proficiency training and your competency certificate.
  • Explain how and where you are going to store the firearm and other security measures that you have implemented to prevent the firearm from being stolen. For example, alarm, armed response, guard dogs, etc.
  • Conclude the letter with a respectful declaration.

Throughout the letter, your tone should be firm but highly respectful . You want to avoid sounding arrogant at all costs. After all, you are at the mercy of the registrar and want to give him/her the best impression possible. You want to sound like the law-abiding citizen that you claim to be.

Hi Natascha, is the Beretta already licensed to your name? If it is, then absolutely mention that it is too big to carry and that is why you are applying for a smaller weapon. If the Beretta is not yet licensed to your name, then don’t bother, however you should still explain to the CFR why you need this specific handgun for self-defense – Caliber, size, reliability, etc.

Hi Achilles, thank you for the useful info on the blog. I have licenses for 2 handguns Colt Gold Cup 45 National Match for large bore target shooting. To be renewed after 10 years, still valid but need renewal now. Colt Python 357, self-defence. Unfortunately I did not realize that validity expired after 5 years, while all others (2 hunting rifles) have a validity of 10 years. Hi Paula, glad I could offer some help. While a motivation letter is not necessarily a requirement, I have heard multiple reports of renewals declined because of a lack of motivation. Is this constitutional? I don’t think it is, but why risk it? It can be as easy as simply attaching a copy of your original motivation letter and readjusting it to your current circumstances.

Written Statement of Defense Meaning

A written statement of defense is a written statement by a defendant formally admitting or denying the facts on which the plaintiff’s claim is based and the material facts on which the defendant intends to rely on in his/her defense of the suit. A written statement of defense must contain the following;

  • The name and place of the court in which the suit has been filed.
  • The name of the parties
  • Case number
  • Title of the document example; WRITTEN STATEMENT OF DEFENCE OF THE DEFENDANT
  • A statement in the concise form of the material facts on which the defendant relies on his defense but not the evidence by which he intends to prove those facts.
  • A prayer that the suit be dismissed struck out, etc depending on the case.
  • verification clause.
  • Signature of the defendant or his representative.
  • Signature of the court registry officer
  • Stamp of the court.

It should be noted that before you respond to a plant you must observe the following;

  • You must be certain that you have clearly understood the content and form of the Plaint.
  • You must be certain of the nature of the claim and its legal basis of it.
  • You must examine whether you are in a position to respond and raise any preliminary objection .
  • You must observe whether the plaint has any course of action.
  • You must consider whether you have any difference to the allegation raised by the plaintiff’s plant.

Though it is not a must, the legal Effects of not filing a Written Statement of Defense may include that; the court will proceed to hear the case ex-parte and provide an ex-parte judgment. which will bind the defendant. Further, failure to reply to the matters alleged in the plaint may render the particular facts of the plaint to be admitted

The effects of filling the defective written statement of defense include that; the court may order the defendant to amend any defect and refile the written statement of defense afresh. A written statement of defense may become defective when it violates the relevant provisions of the law that governs pleadings . For example, when the written statement lacks a verification clause.
