Congressional Rules, Leadership, and Committee Selection

Every two years, at the beginning of each Congress, the House of Representatives is responsible for adopting rules that govern the procedure and process of the chamber, while the Senate uses its traditional rules and procedures. The adoption of these rules is necessary for sessions of Congress to run as smoothly as possible. Standing rules also dictate how party leadership and committee membership are selected. This is a basic guide to rules and procedures in both chambers of Congress.

Rules and Procedures in the House

At the beginning of each Congress, the House of Representatives must vote on a new rules package to determine the rules that will govern the body for the next two years. Before these rules are adopted, the House operates based on general parliamentarian rules. The House usually adopts the rules of the previous Congress and makes amendments the body feels are necessary. The rules package lays out the guidelines for the daily procedure in the House, how the chamber passes legislation, and other rules of decorum.

The House Committee on Rules is among the oldest standing committees and is the mechanism by which the Speaker maintains control of the House Floor. The House Rules Committee has two types of jurisdiction–special orders and original jurisdiction. Special orders, or special rules, determine the rules of debates on a matter or measure on the Floor and are the bulk of the Committee’s work. Original jurisdiction refers to changes being made to the standing rules. The Rules Committee can create or change almost any rule as long as a majority of the House agrees.\

Reporting a special rule to the House Committee on Rules is a process that begins with the committee of jurisdiction requesting a hearing by the Rules Committee. The Rules Committee then holds a hearing in which Members of Congress from the committee of jurisdiction can make their case.

Rules and Procedures in the Senate

Unlike the House of Representatives, the Senate, as a continuing body, does not have to adopt or readopt its rules with each new Congress. A set of standing rules govern proceedings in the Senate in conjunction with a body of precedents created by rulings of presiding officers or by votes of the Senate, a variety of established and customary practices, and ad hoc arrangements the Senate makes. The standing rules guarantee rights to senators, however, these rights are sometimes foregone by senators in the interest of conducting business more quickly.

One rule that separates the Senate from the House is the use of cloture to end a filibuster. Senators can prolong voting on bills by debating at length or using other delaying tactics, but a cloture vote by 60 out of the 100 senators can end the debate and force a vote on the bill.

The Senate Committee on Rules and Administration is responsible for upholding the rules of the Senate floor, the administration of Senate buildings, the credentials and qualifications of senators, and the development and implementation of strategic plans to improve the operations of the Senate. The committee has jurisdiction over any matters relating to the rules and procedures of the Senate rules and regulations. Unlike its counterpart in the House, the Senate Rules and Administration Committee does not need to develop a rules package for each new Congress.

Selection of House and Senate Leadership

Leadership in the House is decided by internal party elections. These elections typically take place behind closed doors via secret ballot in November following the general election. Leadership elections also determine the chairs of the Democratic Caucus and the Republican Conference and the chairs of the two parties’ campaign committees. The parties also elect their nominees for Speaker of the House. The Speaker is elected by a simple majority in a vote put to the entire House of Representatives.

In the Senate, leadership consists of the president pro tempore, the majority and minority leaders, conference chairs, policy committee chairs, conference secretaries, and campaign committee chairs. These positions are elected or appointed by their separate parties.

The vice president of the United States serves as the president of the Senate, but the president pro tempore presides over the Senate in the absence of the vice president. The president pro tempore is traditionally, but not always, the most senior member of the majority party in the Senate who is elected to the role by the chamber. Responsibilities of the president pro tempore include appointing the director of the Congressional Budget Office with the Speaker of the House, making appointments to various national commissions and advisory boards, and receiving reports from certain government agencies.

The Democratic leader in the Senate serves as chair of the party conference, but the Senate Republicans divide those duties, electing one person to serve as conference chair and another to serve as leader.

Selection of Committees in the House and Senate

Both parties in both chambers use steering committees, also known as committees on committees, to determine leadership and membership of committees. The Republican Steering Committee and the Democratic Steering and Policy Committee are selected during meetings in November and December after an election. The steering committees then make recommendations to the Republican Conference and Democratic Caucus respectively on committee chairs, ranking minority members, and general committee assignments.

In the House, once the steering committees make recommendations to their parties, the relevant party caucus approves the recommendations of the selection committee. Then the House approves the recommendations of the caucuses, which are brought before the House as privileged resolutions.

Traditionally, though not exclusively, committee chairs have been selected by seniority, so that the longest-serving Members of the committee from the majority and minority parties become the chair and ranking member, respectively, of the committee. Members of the House are typically limited to service on two committees and four subcommittees, with exceptions for particular committees.

In the Senate, the committee assignment process is guided by Senate rules as well as party rules and practices. The Senate governs committee operations through its Standing Rules XXIV-XXVIII.

Senators are formally elected to standing committees by the entire membership of the Senate, but in practice, each party conference is largely responsible for determining which of its members will sit on each committee. Just as they do in the house, steering committees from both parties make recommendations on committee leadership and assignments. In both party conferences, the floor leader has the authority to make some committee assignments, which can provide the leader with a method of promoting party discipline through the granting or withholding of desired assignments. The number of seats a party holds in the Senate determines its share of seats on each committee.

Senate rules divide committees into three categories based on their importance: Class A, Class B, and Class C. Each senator may serve on no more than two Class A committees and one Class B committee, unless granted special permission. There are no limits to service on Class C committees.

In both chambers, the Republican party has term limits on committee leadership roles.

This lesson plan introduces students to the pivotal role that Congressional committees play in the legislative process, focusing on how their own Congressional representatives influence legislation through their committee appointments. Students begin by reviewing the stages of the legislative process, then learn how committees and subcommittees help determine the outcome of this process by deciding which bills the full Congress will consider and by shaping the legislation upon which votes are finally cast. With this background, students research the committee and subcommittee assignments of their Congressional representatives, then divide into small groups to prepare class reports on the jurisdictions of these different committees and their representatives' special responsibilities on each one. Finally, students consider why representation on these specific committees might be important to the people of their state or community, and examine how the committee system reflects some of the basic principles of American federalism.

  • When a bill ... is introduced in the House, [it is assigned] to the House committee having jurisdiction.
  • If favorably considered, it is reported to the House either in its original form or with recommended amendments.
  • If ... passed by the House, it is messaged to the Senate and referred to the committee having jurisdiction.
  • In the Senate committee the bill, if favorably considered, may be reported in the form it is received from the House, or with recommended amendments.
  • The approved bill ... is reported to the Senate and, if passed by that body, returned to the House.
  • If one body does not accept the amendments to a bill by the other body, a conference committee comprised of Members of both bodies is usually appointed to effect a compromise.

Point out to students the important role that Congressional committees play in this process. Public attention usually focuses on the debate over legislation that occurs on the floor of the House and Senate, but in order for a bill to reach the floor on either side, it must first be approved by a committee, which can also amend the bill to reflect its views on the underlying issue. Congressional committees, in other words, largely control the legislative process by deciding which bills come to a vote and by framing the language of each bill before it is debated.

Provide students with background on the organization and operation of Congressional committees, using resources available through the U.S. Congress  website. A schedule of Congressional committee hearings can be used to identify topics currently under consideration. 

  • Although committees are not mentioned in the Constitution, Congress has used committees to manage its business since its first meetings in 1789.
  • Committees enable Congress to divide responsibility for its many tasks, including legislation, oversight, and internal administration, and thereby cope effectively with the great number and complexity of the issues placed before it.
  • There are today approximately 200 Congressional committees and subcommittees in the House and Senate, each of which is responsible for considering all matters that fall within its jurisdiction.
  • Congress has three types of committees: (1) Standing Committees are permanent panels with jurisdiction over broad policy areas (e.g., Agriculture, Foreign Relations) or areas of continuing legislative concern (e.g., Appropriations, Rules); (2) Select Committees are temporary or permanent panels created to consider a specific issue that lies outside the jurisdiction of other committees or that demands special attention (e.g., campaign contributions); (3) Joint Committees are panels formed by the House and Senate together, usually to investigate some common concern rather than to consider legislation, although joint committees known as Conference Committees are formed to resolve differences between House and Senate versions of a specific measure.
  • Many committees divide their work among subcommittees, upon which a limited number of the committee members serve. Subcommittees are responsible for specific areas within the committee's jurisdiction and report their work on a bill to the full committee, which must approve it before reporting the bill to its branch of Congress.
  • Party leaders determine the size of each committee, which average about 40 members in the House and about 18 members in the Senate, and determine the proportion of majority and minority committee members. The majority party always has more seats on a committee and one of its members chairs the committee. Each party also determines committee assignments for its members, observing rules that have been adopted to limit the number and type of committees and subcommittees upon which one member can serve.
  • Each committee's chairperson has authority over its operation. He or she usually sets the committee's agenda, decides when to take or delay action, presides at most committee meetings, and controls the committee's operating budget. Subcommittee chairpersons exercise similar authority over their smaller panels, subject to approval by the committee chair.
  • The work of Congressional committees begins when a bill that has been introduced to the House or Senate is referred to the committee for consideration. Most committees take up only a small percentage of the bills referred to them; those upon which the committee takes no action are said to "die in committee." The committee's first step in considering a bill is usually to ask for written comment by the executive agency that will be responsible for administering it should it become law. Next, the committee will usually hold hearings to gather opinions from outside experts and concerned citizens. If the committee decides to move forward with the bill, it will meet to frame and amend the measure through a process called markup. Finally, when the committee has voted to approve the bill, it will report the measure to its branch of Congress, usually with a written report explaining why the measure should be passed.
  • Once a bill comes to the floor of the House or Senate, the committee that reported it is usually responsible for guiding it through debate and securing its passage. This can involve working out parliamentary strategies, responding to questions raised by colleagues, and building coalitions of support. Likewise, if the House and Senate pass different versions of a bill, the committees that reported each version will take the lead in working out a compromise through a conference committee.

Activity 1. Research the committees and subcommittees

Begin by viewing the Library of Congress video on Congressional Committees . Have students research the committees and subcommittees upon which their Congressional representatives serve, using library resources or the resources available through the U.S. Congress  website.

  • To help students find out who your Congressional representatives are, use the U.S. Congress  website to search by state.
  • Click on the name of each representative for a profile, including a photograph, which lists the representative's committee assignments.
  • The U.S. Congress  website page provides information pertaining to sponsored and cosponsored legislation, member websites, and allows users to track legislation.
  • To find out which committees and subcommittees a representative serves on, use the U.S. Congress Committee Reports page .
  • For an overview of Congressional committees and their jurisdictions, use the  U.S. Congress Committee Reports page .

Congressional Committee Activity:

Divide the class into small groups and have each group prepare a report on one of the committees (or subcommittees) upon which one of your Congressional representatives serves, including the size of the committee, its jurisdiction, and whether your representative has a leadership post on the committee. Encourage students to include as well information about legislation currently before the committee. They can find this information using library resources or through the  U.S. Congress Committee Reports page . 

After students present their reports, discuss how committee assignments can affect a Congressional representative's ability to effectively represent his or her constituents.

  • Do your representatives have seats on committees with jurisdiction over issues that have special importance for your state or community? If so, how might their presence on these committees help assure that Congress takes action on questions of local interest?
  • Do your representatives have seats on committees with jurisdiction over important legislative activities, such as budget-making or appropriations? If so, how might their presence on these powerful committees help assure that your community's views receive careful Congressional consideration?

After exploring these questions, have students debate the extent to which a Congressional representative's committee vote may be more influential than his or her vote on the floor of the House or Senate. Which vote has more impact on legislation? In this regard, have students consider President Woodrow Wilson's observation that "Congress in session is Congress on public exhibition, whilst Congress in its committee-rooms is Congress at work."

Activity 2. How do Congressional committees reflects some of the fundamental principles of federalism?

Conclude by having students consider how the structure and function of Congressional committees reflects some of the fundamental principles of federalism. For a broad discussion of federalism, have students read The Federalist No. 39 , in which James Madison highlights the Constitution's provisions for a federal, as distinguished from a national, form of government.

Have students imagine, for example, that they are members of a Congressional committee that is considering a bill with special importance for the people of your community.

  • How would they balance their responsibilities to their constituents with their responsibilities to the nation as a whole?
  • To what extent is this a question each Congressional representative must answer individually?
  • To what extent is it a question that the mechanisms of our government answer through the legislative process?

Ch. 3 – The Legislative Branch

After reading this section, you should be able to answer the following questions:

  • What criteria do members use when seeking congressional committee assignments?
  • What are the prestige committees in the House and Senate?
  • What is the function of investigative committees?

In 1885, Woodrow Wilson famously observed, “Congress in session is Congress on public exhibition, whilst Congress in its committee-rooms is Congress at work.” [1] This statement is no less true today. Committees are the lifeblood of Congress. They develop legislation, oversee executive agencies and programs, and conduct investigations.

There are different types of committees that are responsible for particular aspects of congressional work. Standing committees are permanent legislative committees. Select committees are special committees that are formed to deal with a particular issue or policy. Special committees  can investigate problems and issue reports. Joint committees are composed of members of the House and Senate and handle matters that require joint jurisdiction, such as the Postal Service and the Government Printing Office. Subcommittees handle specialized aspects of legislation and policy.

Committee Assignments

Members seek assignments to committees considering the overlapping goals of getting reelected, influencing policy, and wielding power and influence. They can promote the interests of their constituencies through committee service and at the same time help their chances at reelection. Members from rural districts desire appointments to the Agriculture Committee where they can best influence farm policy. Those most interested in foreign policy seek appointment to committees such as the House Foreign Relations and Senate International Affairs Committees, where they can become embroiled in the pressing issues of the day. Power or prestige committee assignments in the House include Appropriations, Budget, Commerce, Rules, and Ways and Means. The most powerful committees in the Senate are Appropriations, Armed Services, Commerce, Finance, and Foreign Relations.

Table 1. Congressional Committees

Most House members end up getting assigned to at least one committee that they request. In the House, committee assignments can be a ticket to visibility and influence. Committees provide House members with a platform for attracting media attention as journalists will seek them out as policy specialists. Senate committee assignments are not as strongly linked to press visibility as virtually every senator is appointed to at least one powerful committee. The average senator serves on eleven committees and subcommittees, while the average House member serves on five.

Service on powerful subcommittees can provide a platform for attracting media attention. In 1955, the Senate Subcommittee on Juvenile Delinquency staged three days of hearings in New York City as part of its investigation into allegations brought by Senator Estes Kefauver (D-TN), a subcommittee member, that violent comic books could turn children into criminals. The press-friendly hearings featured controversial speakers and slides of comic strips depicting a machine gun–toting woman character named “Frisco Mary” blowing away law enforcement officials without remorse that were circulated widely in the media. Kefauver anticipated that the press generated by these hearings would help him gain publicity for a bid to get on the 1956 Democratic presidential ticket. He lost the presidential nomination battle but ended up the vice presidential candidate for the losing side. [2]

Committee Work

Committees are powerful gatekeepers. They decide the fate of bills by determining which ones will move forward and be considered by the full House and Senate. Committee members have tremendous influence over the drafting and rewriting of legislation. They have access to experts and information, which gives them an advantage when debating bills on the floor. [3]

Committee chairs are especially influential, as they are able to employ tactics that can make or break bills. Powerful chairs master the committee’s subject matter, get to know committee members well, and form coalitions to back their positions. Chairs can reward cooperative members and punish those who oppose them by granting or withholding favors, such as supporting pork barrel legislation that will benefit a member’s district. [4]

Most committee work receives limited media coverage. Investigative hearings are the exception, as they can provide opportunities for high drama.

Committee Investigations

Conducting investigations is one of the most public activities in which congressional committees engage. During the Progressive Era of the 1890s through 1920s, members could gain the attention of  muckraking journalists by holding investigative hearings to expose corruption in business and government. The first of these was the 1913 “Pujo hearings,” in which Rep. Arsene Pujo (D-LA) headed a probe of Wall Street financiers. High-profile investigations in the 1920s included an inquiry into the mismanagement of the Teapot Dome oil reserves. During the Great Depression of the 1930s, Congress conducted an investigation of the stock market, targeting Wall Street once again. Newspapers were willing to devote much front-page ink to these hearings, as reports on the hearings increased newspaper readership. In 1950, Senator Kefauver held hearings investigating organized crime that drew 30 million television viewers at a time when the medium was new to American homes. [5]

The Senate convened a special committee to investigate the Watergate burglaries and cover-up in 1973. The burglars had been directed by President Richard Nixon’s reelection committee to break into and wiretap the Democratic National Committee headquarters at the Watergate building complex. The Watergate hearings became a national television event as 319 hours of the hearings were broadcast and watched by 85 percent of American households. Gavel-to-gavel coverage of the hearings was broadcast on National Public Radio. The senators who conducted the investigation, especially Chairman Sam Ervin (D-NC) and Senator Howard Baker (R-TN), became household names. The hearings resulted in the conviction of several of President Nixon’s aides for obstruction of justice and ultimately led to Nixon’s resignation. [6]

The Senate Watergate hearings in 1973 were a major television and radio event that brought Congress to the attention of the entire nation.

In 2002, the House Financial Services Committee held thirteen hearings to uncover how Enron Corporation was able to swindle investors and drive up electricity rates in California while its executives lived the high life. Prior to the hearings, which made “Enron” a household word, there was little press coverage of Enron’s questionable operating procedures.

Enduring Image: The House Un-American Activities Committee and Hollywood

Following World War II, chilly relations existed between the United States and the Communist Soviet Union, a nation that had emerged as a strong power and had exploded an atomic bomb. [7] The House Un-American Activities Committee (HUAC), which was established in 1939 to investigate subversive activities, decided to look into allegations that Communists were threatening to overthrow American democracy using force and violence. People in government, the labor movement, and the motion picture industry were accused of being communists. Especially sensational were hearings where Hollywood actors, directors, and writers were called before the HUAC. It was not uncommon for people in Hollywood to have joined the Communist Party during the Great Depression of the 1930s, although many were inactive at the time of the hearings. HUAC alleged that film “was the principle medium through which Communists have sought to inject their propaganda.” [8]

Those accused of being communists, nicknamed “reds,” were called before the HUAC. They were subject to intense questioning by members of Congress and the committee’s counsel. In 1947, HUAC held hearings to investigate the influence of Communists in Hollywood. The “Hollywood Ten,” a group of nine screenwriters, including Ring Lardner, Jr. and Dalton Trumbo, and director Edward Dmytryk, were paraded before the committee. Members of Congress shouted to the witnesses, “Are you now or have you ever been a member of the Communist Party?” They were commanded to provide the names of people they knew to be Communists or face incarceration. Some of the Hollywood Ten responded aggressively to the committee, not answering questions and making statements asserting their First Amendment right to free expression. Blinding flashbulbs provided a constant backdrop to the hearings, as photographers documented images of dramatic face-offs between committee members and the witnesses. Images of the hearings were disseminated widely in front-page photos in newspapers and magazines and on television.

The HUAC hearings immortalized the dramatic image of the congressional investigation featuring direct confrontations between committee members and witnesses.

The Hollywood Ten refused to cooperate with HUAC, were cited for contempt of Congress, and sent to prison. [9] They were blacklisted by the leaders of the film industry, along with two hundred other admitted or suspected communists, and were unable to work in the motion picture industry. Pressured by personal and financial ruin, Edward Dmytryk eventually gave in to HUAC’s demands.

Commercial films have perpetuated the dramatic image of congressional hearings made popular by the HUAC investigations. Films released around the time of the hearings tended to justify the actions the HUAC, including Big Jim McClain (1952) and On the Waterfront (1954). The few films made later are more critical. Woody Allen plays a small-time bookie who fronts for blacklisted writers in The Front (1976), a film depicting the personal toll exacted by the HUAC and blacklisting. In Guilty by Suspicion (1991), Robert DeNiro’s character refuses to name names and jeopardizes his career as a director. One of the Hollywood Ten (2000), graphically depicts film director Herbert Biberman’s experience in front of the HUAC before he is jailed for not cooperating.

What the 21 McCarthy holdouts got in committee assignments

WASHINGTON — The 21 House Republicans who initially blocked Rep. Kevin McCarthy from winning the speakership had demanded big changes to House rules, but they also wanted more influence on the congressional committees that will set the GOP agenda over the next two years.

While not every holdout got exactly what he or she had asked for, some won plum committee assignments from McCarthy, R-Calif., and his allies after they helped him secure the speaker's gavel , a process that took 15 rounds of voting.

As part of his deal with detractors, McCarthy named three conservative rabble rousers — Reps. Chip Roy of Texas, Ralph Norman of South Carolina and Thomas Massie of Kentucky — to the influential Rules Committee, which decides how exactly bills come to the House floor.

Here's what we know so far:

  • Rep. Andy Biggs of Arizona , a former head of the Freedom Caucus and one of the five so-called Never Kevins , will keep his spots on the powerful Judiciary and Oversight committees. He was also named chairman of Judiciary's subcommittee on Crime and Federal Government Surveillance. Biggs changed his vote to "present" on the final ballot for speaker, helping push McCarthy over the finish line.
  • Rep. Dan Bishop of North Carolina , one of 13 holdouts who flipped to back McCarthy on the 12th ballot, will continue to serve on both the Judiciary and Homeland Security committees. McCarthy also named Bishop to Judiciary's new subcommittee on the "Weaponization of the Federal Government."
  • Rep. Lauren Boebert of Colorado , a vocal McCarthy critic who voted "present" on the 14th and 15th ballots, was awarded a seat on the Oversight and Accountability Committee, which plans to launch numerous investigations into the Biden administration. She will continue to serve on the Natural Resources panel, on which she served in the previous Congress.
  • Freshman Rep. Josh Brecheen of Oklahoma , who flipped to McCarthy on the 12th ballot, won seats on the Homeland Security Committee and Budget committees.
  • Rep. Mike Cloud of Texas , who also flipped to McCarthy on the 12th ballot, won a new seat on the powerful Appropriations Committee, which controls federal spending. McCarthy also named him to the new select committee investigating the origins of the Covid pandemic.
  • Rep. Andrew Clyde of Georgia , another lawmaker who flipped to McCarthy on the 12th ballot, will serve for the first time on Appropriations.
  • Freshman Rep. Eli Crane of Arizona , who voted "present" on the 15th ballot, will serve on the Homeland Security Committee.
  • Rep. Byron Donalds of Florida , who was nominated to run against McCarthy for speaker and flipped to him on the 12th ballot, was named by McCarthy as the "speaker's designee" on the influential Steering Committee, which decides which lawmakers get committee gavels and seats. Donalds also won a coveted spot on the Financial Services Committee, a top panel known on Capitol Hill as an "A" committee.
  • Rep. Matt Gaetz of Florida , perhaps the most vocal McCarthy foe during the speaker fight, who flipped to "present" in the 14th round, will continue to serve on the Judiciary panel and was appointed by McCarthy to the new weaponization subcommittee .
  • Rep. Bob Good of Virginia , one of the Never Kevins who flipped to "present" in the last round of voting, will serve on the Budget and Education and Workforce committees.
  • Rep. Paul Gosar of Arizona , who flipped to McCarthy on the 12th ballot, was reinstated by Republicans on two committees —Oversight and Natural Resources panels — after Democrats removed him two years ago for posting threats to lawmakers on social media. He was named chairman of the Natural Resources subcommittee on Oversight and Investigations.
  • Rep. Andy Harris of Maryland , who flipped to McCarthy on the 13th ballot, will continue to serve on the Appropriations panel. Harris, a physician, will be the chairman of the Agriculture, Rural Development, Food and Drug Administration subcommittee.
  • Freshman Rep. Anna Paulina Luna of Florida , who flipped to McCarthy on the 12th ballot, won a seats on the Oversight and Natural Resources panels.
  • Rep. Mary Miller of Illinois , who flipped to McCarthy on the 12th ballot, will remain on the Agriculture Committee.
  • Rep. Ralph Norman of South Carolina , one of the Never Kevins who flipped to McCarthy on the 12th ballot, was named by the speaker as one of nine Republicans on the Rules Committee. Norman also will remain on the Financial Services panel, which he joined in June, and will serve on the Budget Committee too.
  • Freshman Rep. Andy Ogles of Tennessee , who flipped to McCarthy on the 12th ballot, also won a seat on Financial Services.
  • Rep. Scott Perry of Pennsylvania , the chairman of the far-right House Freedom Caucus who brokered a deal between conservatives and McCarthy, will remain on the Foreign Affairs Committee. A subject of Jan. 6 investigations , Perry won a new seat on the Oversight committee.
  • Rep. Matt Rosendale of Montana , a Never Kevin who flipped to "present" on the final ballot, will continue to serve on Natural Resources.
  • Rep. Chip Roy of Texas , who along with Perry helped negotiate a deal with McCarthy, was tapped to serve on the Budget committee and the influential Rules Committee. Roy will also keep his seat on the Judiciary panel.
  • Freshman Rep. Keith Self, R-Texas , who flipped to McCarthy on the 12th ballot, will serve on the Foreign Affairs panel.
  • Rep. Victoria Spartz of Indiana , who flipped from "present" to vote for McCarthy on the 12th ballot, will continue to serve on the Judiciary panel.

In addition to committee assignments, McCarthy had made other concessions to his right flank.

In the package of rules changes McCarthy and the Freedom Caucus negotiated for the 118th Congress was a provision allowing a single lawmaker to force a floor vote to oust McCarthy as speaker. They also agreed to make it harder to raise federal spending, taxes and the debt ceiling, and to create select committees to investigate the Chinese Communist Party and the "weaponization of the federal government."

Some Freedom Caucus members who stuck with McCarthy from the very start also did well for themselves. Rep. Marjorie Taylor Greene, R-Ga., a McCarthy ally whom Democrats stripped of her committee assignments two years ago, won seats on the Oversight and Homeland Security committees.

Meanwhile, Rep. Warren Davidson of Ohio, a Freedom Caucus member who nominated McCarthy on the fifth ballot , was named chairman of the Financial Services subcommittee on Housing and Insurance.

Speaker Johnson moves on foreign aid, possibly triggering vote to oust him

The house freedom caucus has already panned the proposal, which includes a separate vote on border security that was intended to mollify hard-right members.

House Speaker Mike Johnson is plowing ahead on a foreign aid plan that has roiled his conference and prompted two Republicans to push an effort to oust him from the chamber’s top job .

But instead of the complex four-part plan he floated this week, Johnson now intends to try to pass five bills — one each for aid to Ukraine, Israel, and Indo-Pacific allies, as well as a GOP wish list of foreign policy priorities and a fifth stand-alone bill to address widespread Republican demands to strengthen the southern U.S. border. GOP leadership announced that the House would stay in session until Saturday to consider the bills.

The new approach is risky and is already blowing up on the speaker, whose six-month-old hold on the gavel is being threatened by a promise by Rep. Marjorie Taylor Greene (R-Ga.) to invoke a “motion to vacate” to topple Johnson (R-La.) if he puts Ukraine aid on the floor, something to which many hard-right Republicans object.

Greene said Wednesday night she wouldn’t interrupt the process on the aid package by bringing up the move to oust Johnson. But she also refused to commit to doing so afterwards.

At a Wednesday evening news conference, Johnson was visibly emotional when asked about why he had opted to try to pass the foreign aid package at this moment.

“Listen, my philosophy is you do the right thing and you let the chips fall where they may. … If I operated out of fear over a motion to vacate, I would never be able to do my job,” he said. “This is a critical time right now. … I can make a selfish decision and do something that’s different. But I’m doing here what I believe to be the right thing.”

The stakes are indeed high for the speaker as he works to navigate a bitterly divided Republican conference. Some members are loudly opposed to Ukraine aid without first securing the U.S. border, while others believe that aid, along with money for Israel, is a critical national security priority; in addition, some Republicans question the speaker’s leadership style. For Johnson, it’s a Catch-22: Consider aid to Ukraine, and a move to wrest his gavel is bound to follow.

Demoralized Republicans exited a four-hour meeting of Johnson and his allies Tuesday night, before the release of the latest proposal, having failed to chart a path on foreign aid that would be carried by Republicans instead of reliant on Democrats. Multiple people familiar with the meeting, who spoke on the condition of anonymity to discuss internal dynamics, said the session enlightened them and Johnson about the consequences of moving the foreign aid package: It could all lead to his ouster from the job.

“The battle lines were very clear at the end,” one Republican said. “It was very clear [the motion to vacate] will be brought if the speaker’s plan proceeds.”

Even so, Johnson acted, telling Republicans in a text to colleagues Wednesday morning that after “significant Member feedback and discussion” this week, the House would move ahead with his plan, with some significant changes. He released the text of legislation on aid for Ukraine , Israel , Indo-Pacific allies , border security , and other foreign policy priorities Wednesday.

But in signs of trouble late Wednesday, the House Rules Committee failed to approve the border security bill because three Republicans on the panel — Reps. Chip Roy (R-Tex.), Thomas Massie (R-Ky.), and Ralph Norman (R-S.C.) — refused to support it, meaning the panel adjourned without action. Democrats have no interest in backing the GOP border proposal.

The three separate bills that fund military aid for Israel, Ukraine and Taiwan largely mirror the $95 billion Senate-passed national security supplemental . The House legislation turns a portion of the aid, the money sent directly to Ukraine, into a loan and is endorsed by former president Donald Trump . It also includes just over $9 billion in humanitarian aid for Gaza, the West Bank, Ukraine and other places in need, which Democrats have demanded as a condition of any support from them.

Johnson signaled Wednesday evening that there would probably be an amendment to the package to strip the humanitarian aid, which he said he has “concerns” with.

House Minority Leader Hakeem Jeffries (D-N.Y.) called Wednesday evening for Republicans to put the foreign aid package on the floor, but didn’t commit Democratic support for the measures.

“The time has come for the House of Representatives to act and act decisively,” Jeffries said. “We can either confront Russian aggression in defense of democracy or we can allow the pro-Putin extreme MAGA Republicans to appease” the Russian leader.

Jeffries said Democrats will “evaluate” the process and the final product, including amendments, before making a determination about how to move forward.

Nonetheless, the speaker’s proposal received a major boost from President Biden on Wednesday afternoon. Biden said he “strongly” supports the proposal and encouraged the House and the Senate to swiftly send it his way.

“I will sign this into law immediately to send a message to the world: We stand with our friends, and we won’t let Iran or Russia succeed,” he said in a statement that is likely to influence Democrats to back the plan and amplify GOP outrage against it.

Even if the House manages to pass the foreign aid package, any changes would trigger another Senate vote that is already stirring controversy.

Some GOP senators are staunchly opposed to Ukraine aid, too. At a closed-door meeting of the conservative House Republican Study Committee on Tuesday, Sen. J.D. Vance (R-Ohio) and Stephen Miller, a former Trump adviser, riled up the anti-Ukraine faction to use every hurdle possible to block consideration of Johnson’s plan.

Leaving the meeting, Rep. Debbie Lesko (R-Ariz.) said she is “very frustrated” with Johnson and recently expressed that sentiment with him. She echoed many hard-line Republicans who have encouraged Johnson to tie the border security bill to the other four national security items to force Democrats’ hand on the issue.

“He’s not listening to us,” she said.

Johnson needs every vote he can get. Republicans have an extremely slender House majority that they hope will be expanded by voters in November, improving their chances of advancing a conservative agenda. The GOP currently has a two-vote majority, meaning that if Democrats don’t back Johnson’s plan or support a challenge to his speakership, they would need only three Republicans to sink him on either front.

But that margin would narrow to two Republicans after Rep. Mike Gallagher (R-Wis.) resigns. He was supposed to do so this Friday but now is expected to leave after the foreign aid bill comes to the floor.

“The congressman has the flexibility to stay and support the aid package on Saturday,” his office said Wednesday.

Meanwhile, all eyes are on Greene and Rep. Thomas Massie (R-Ky.), the two public supporters of the move to eject Johnson. Once Greene decides to act, she could introduce the motion under special rules giving the House 48 hours to vote on it.

In some ways, it’s a no-win situation for Johnson.

Some of his members are becoming increasingly frustrated with Johnson’s leadership style, noting he has released plans and then seemed to reconsider them afterward — a turnabout that is deterring some of those initially rooting for his speakership to succeed.

Others want Johnson to be more aggressive in forcing the hand of Democrats, while still others who want to aid foreign allies wish the speaker would advance the Senate proposal because they don’t think Republicans will unite around anything.

Asked whether Johnson would put the Senate package on the floor if all else fails, one Republican ally turned critic of the speaker said, “He doesn’t have the guts to.”

Instead, Republicans who want to govern have grown more willing to sign on to a Democratic discharge petition that would force a vote on the Senate bill if the petition clinches 218 signatures. Currently, just one Republican and 194 Democrats have signed on. But some Republicans are waiting until Johnson’s plan fails before signing on to the motion.

A large number of Republicans are upset over how his foreign aid plan is structured — they may move to prevent the clearing of several procedural hurdles before the package can be sent to the floor. Democrats, who support the meat of the foreign aid bills, are still wary of throwing their weight behind the GOP package because they fear policies they oppose will be added through amendments.

The hard-right flank has signaled it will oppose the entirety of Johnson’s plan. The House Freedom Caucus quickly panned the proposal even though it includes, according to the speaker’s office, the “core components of H.R. 2,” a harsh immigration bill restricting migrants from entering the United States.

“Speaker Johnson is surrendering the last opportunity we have to combat the border crisis. This flies in the face of every promise Republicans have told you,” the group said.

In a Monday meeting, several chairs of national security committees tried to provide intelligence about the situation abroad, only to be challenged by members with a more isolationist worldview. Johnson has indicated his previous opposition to Ukraine aid as a rank-and-file member changed since he became speaker because he receives intelligence briefings more frequently.

Johnson isn’t getting much Republican support even for a border bill that appears to be crafted to win it — members have demanded that the U.S. border be secured before funding is sent to Ukraine and other allies. Republicans did have a chance to consider a tough bipartisan security bill earlier in the year, but declined to do so as Trump vocally attacked it.

The four national security bills probably will need Democratic support because of the large number of Republicans who don’t want to fund Ukraine aid. Those are expected to be considered together by the House Rules Committee, which structures how bills are considered on the House floor.

Johnson has instructed the Rules Committee to separately review the border security proposal in a way that will allow Republicans to amend it on the floor. This has greatly irritated many Republicans, who view the speaker’s move as dooming the proposal, and has inspired dozens to protest the eventual rule vote.

“To have a separate vote that has no leverage in it to once again show Republicans would like to secure the border wall … yeah, that’s a joke,” said Freedom Caucus Chairman Bob Good (R-Va.).

Russia Maps Show 25% of Moscow Without Power Amid Winter Freeze 'Emergency'

Russian President Vladimir Putin has ordered the nationalization of an ammunition plant in Moscow after a mechanical failure caused tens of thousands of Muscovites to lose heat and water amid freezing temperatures beginning last week.

On January 4, a heating main burst at the Klimovsk Specialized Ammunition Plant in the town of Podolsk, which is around 30 miles south of central Moscow. Since then, tens of thousands of Russians are reported to have no heating in their homes in the Moscow region amid subzero temperatures.

Affected areas include the cities of Khimki, Balashikha, Lobnya, Lyubertsy, Podolsk, Chekhov, Naro-Fominsk, and Podolsk, a map published by a Russian Telegram channel and shared on other social media sites shows.

Other Russian media outlets reported that in Moscow, residents of Balashikha, Elektrostal, Solnechnogorsk, Dmitrov, Domodedovo, Troitsk, Taldom, Orekhovo-Zuyevo, Krasnogorsk, Pushkino, Ramenskoye, Voskresensk, Losino-Petrovsky, and Selyatino are also without power.

That means that in total, more than a quarter of Moscow's cities have been hit with power outages and a lack of heating.

Newsweek has contacted Russia's Foreign Ministry for comment via email.

Many residents have taken to publishing video appeals on social media to complain about their freezing conditions. In one clip, people living in Moscow say that they are left with no choice but to warm their homes with gas stoves, heaters, and "whatever else we can find." Others said they are lighting fires in the streets to keep warm.

Andrei Vorobyov, governor of the Moscow region, announced on Tuesday that Putin ordered the ammunition plant to be nationalized because two of its owners have been "located abroad." He didn't name the individuals.

"We received the right to take control of this boiler house within the framework of an emergency," Vorobiev said, adding that the plant's boiler room was managed "very poorly" and there was "virtually no qualified competent personnel."

Russia's Investigative Committee has opened a criminal case over Klimovsk Specialized Ammunition Plant not meeting safety requirements.

On Tuesday, the committee said that because of the incident, the deputy head of Podolsk's administration, the head of the plant's boiler house, and the general director of the ammunition plant had been detained.

Residents of Selyatino have described the situation as "some kind of struggle for survival," Russian Telegram channel ASTRA reported.

Power outages have also struck St. Petersburg, Rostov, Volgograd, Voronezh, Primorsky Territory, and Yekaterinburg.

Witness Claims Matt Gaetz Attended Drug-Fueled Party With Underage Girl In Statement To Lawmakers, Report Says

The House Ethics Committee has obtained a sworn statement from a woman who said she attended a drug-fueled party where Rep. Matt Gaetz, R-Fla., and the then-underage girl he was accused of having sex with were also present, ABC News reported Friday, citing sources familiar with the probe that stems from a closed Justice Department investigation into Gaetz.

The woman reportedly told the committee MDMA and cocaine were present at the party that allegedly took place in the summer of 2017, but her statement did not address Gaetz’s conduct at the party or his interactions with the then-underage girl, ABC reported.

The woman reportedly told the committee the then-underage girl Gaetz was accused of having sex with—allegations he has repeatedly denied—was naked at the party, where other adult men in addition to Gaetz were present and rooms were available for sexual activity.

An unnamed spokesperson for Gaetz told ABC he has not used drugs since he was sworn into Congress in 2017 and said he did not attend the 2017 party.

Key Background

The Justice Department began investigating Gaetz in 2020 as part of its probe into his former friend Joel Greenberg, who pleaded guilty in 2021 to six federal charges, including sex trafficking of a minor. Greenberg reportedly told investigators Gaetz paid a 17-year-old for sex and to travel across state lines with him. The Justice Department declined to bring charges against Gaetz due to credibility issues with key witnesses. The House Ethics Committee announced in 2021 it was also investigating Gaetz for allegations of illicit drug use, using campaign funds for personal expenses, bribery and sharing inappropriate videos with other members on the House floor. Gaetz’s office has firmly denied all of the allegations against him, calling them “blatantly false” and alleging they “have not been validated by a single human being willing to put their name behind them” in a statement after the ethics probe was made public in 2021.

Former House Speaker Kevin McCarthy, R-Calif., has accused Gaetz of leading the effort to remove him because McCarthy refused to kill the ethics committee probe. “I’ll give you the truth why I’m not speaker, it’s because one person, a member of Congress wanted me to stop an ethics complaint because he slept with a 17-year-old,” McCarthy told C-SPAN in an interview last week.

What To Watch For

Gaetz was recently subpoenaed by the then-underage woman he was accused of having sex with as part of a civil defamation suit Gaetz’s friend and former Florida state Rep. Chris Dorworth brought against her and Greenberg. His deposition in the case is scheduled for June.
