Mother's complaint against Colorado parental evaluator dismissed

Colorado’s Board of Psychologist Examiners dismissed a complaint filed against the license of Mark Kilmer, a high-profile parental evaluator who has said 90% of abuse allegations he hears in his work are false.

The complaint was filed by a mother who had Kilmer appointed as a parental responsibility evaluator in her divorce and custody case, and she’s also at the forefront of a class-action lawsuit against Kilmer that alleges he produces biased evaluations that favor abusive parents.

Evaluators are professionals hired to make recommendations about parental custody in court cases, and the cases commonly involve allegations of child abuse and intimate partner violence. Under the umbrella of these court-appointed personnel are parental responsibility evaluators and child-and-family investigators.

The Office of the State Court Administrator barred Kilmer from accepting new court appointments for parental evaluations in October, informing him that it had suspended him while the office investigated his suitability for the appointments.

He was terminated from the state's roster of eligible evaluators in November. In her complaint filed with the Department of Regulatory Agencies (DORA) alleging Kilmer violated practice standards, Lauren May Woodruff alleges Kilmer admitted during testimony in a February hearing for her case he had not notified the court of his suspension according to his own contract and practice standards.

Kilmer’s suspension and termination followed investigations into Colorado’s parental evaluation industry by The Denver Gazette and ProPublica. In a previous interview with ProPublica, Kilmer said he disbelieves 90% of the abuse allegations he hears during his evaluation work.

Also among Woodruff’s accusations: Falsifying and altering records as Kilmer conducted the parental responsibilities evaluation in her case. An accusation Kilmer didn’t disclose to the court or the attorney on her case that her ex-husband had fled to another state during the PRE (parental responsibility evaluation) process and ongoing DHS investigations against him, prolonging the cost of the evaluation and the litigation in Woodruff’s case.

Her allegations include that Kilmer didn’t interview Woodruff’s children at her home, while conducting two interviews at her ex-husband's home and failing to disclose he skipped scheduled home visits by Kilmer. He didn’t include in his evaluation reports made to the Department of Human Services by her children's therapists and other mandatory reporters about suspected abuse, according to the complaint.

Colorado’s Board of Psychologist Examiners, part of the Department of Regulatory Agencies, dismissed Woodruff’s complaint after little discussion Friday. Members said during the meeting’s public session Kilmer has denied the accusations against him.

Kilmer's psychologist license expires Aug. 31. 

The board voted to dismiss the complaint without publicly giving any reason, having apparently made their decision in the meeting’s executive session.

Woodruff expressed her frustration about the board’s decision in a text to the Denver Gazette. She said it seemed the members had only read media reports about the class-action lawsuit against Kilmer, rather than reviewing her complaint. Woodruff added dozens of people watching the board’s meeting Friday have also had complaints they filed with DORA dismissed.

“Kilmer’s response to the case had even negated his own court testimony on the matter, which was provided to DORA in the transcript," Woodruff wrote. "On its face the Board members should have moved for further investigation in the very least.”

In a letter to the Office of the State Court Administrator last fall, Kilmer denied any bias in his evaluation work.

“Most respectfully, if anyone attempts to insinuate or complain that I do not understand how to assess, diagnose and treat victims and/or perpetrators of violent crime in the U.S.A., or how to parent appropriately — then they are mistaken,” he wrote. “They do not know me. Or they are falsely accusing me. I wouldn’t know how to be gender-biased if I had to.”

He has not responded to previous requests for comment. The Denver Gazette reached out to Kilmer on Friday afternoon for comment.

Colorado's network of custody evaluators has historically had little practical oversight, accountability or opportunity for public scrutiny. Reports they submit to the court generally remain sealed, and the Department of Regulatory Agencies seems to rarely choose to investigate complaints made against evaluators' professional licenses.

Investigations by The Denver Gazette found judges have relied on inaccurate and biased reports by evaluators and put children at serious risk by giving custody to abusive parents. In these instances, custody evaluators have shown apparent prejudice against one parent — usually mothers — questioning their credibility without proof and making assumptions about parenting without firsthand investigation.

Dr. Kilmer is a monster

To get straight to the point, Dr. Kilmer is dishonest, manipulative, and unethical. His office manager and wife, Melanie Towers, isn’t much better. There’s already enough said on this matter, so let’s take a look at something else. Dr. Kilmer was granted eligibility to serve the Court under false pretenses. His initial application didn’t include an affidavit of mandatory consent and disclosure for CFI eligibility in the supporting documentation section. More so, Dr. Kilmer waited for seven months after starting the job to file his affidavit in an obvious attempt to avoid being flagged by the SCAO background check. At which point his filing only refers to a domestic protection order against him for what was in his own words a “false domestic violence allegation” despite CFI eligibility instructions clearly stating that further documentation was required. Why the lack of transparency? --Dr. Kilmer has a long history of domestic violence. He has been arrested for physically assaulting and harassing his ex-wife on multiple occasions. The so-called false allegations led Dr. Kilmer to a GUILTY plea in exchange for 2 year deferred judgments: Case #06M2373 (Known/Reckless Cause Injury - Domestic violence) & Case #06M3020 (Harassment). If you read the court pleadings then you’ll know that the slap on the wrist did not remotely fit the serious nature of his crimes. Dr. Kilmer responded “No” to a question from the SCAO background check regarding any history of denial/supervision of parental responsibilities. --Dr. Kilmer was denied parental responsibilities and his ex-wife was granted sole decision-making regarding their children during the divorce. The parent-coordinator/decision-maker expressed concern that Dr. Kilmer “lacked competence regarding parenting in a divorce situation.” The Colorado Family Courts (CFI) and Colorado State Board of Examiners are aware of the situation, but no one wants to own the mess. This needs to change.

I agree with the other reviewers that Dr. Kilmer should not be trusted to participate in a decision as important as how your children are raised. Dr. Kilmer was very up front about writing reports that are biased toward mothers (so if you are the mother maybe this is a good guy for you to use to screw your ex). Dr. Kilmer will tell you to bring all of your evidence early in the investigation, but will give you no indication of what the other party is alleging. In my case there were so many accusations from the other side, it was impossible to know what evidence to bring, so he made conclusions and decisions without all of the facts. Additionally, Dr. Kilmer doesn't seem to understand the damage that parental alienation can cause and was not able to recognize symptoms of severe depression in the mother. Dr. Kilmer relies on the testing data too much and didn't spend enough time with either party to accurately assess how the testing data could be interpreted. The report that Dr. Kilmer produced contain several blatant inaccuracies that ultimately impacted the fairness or appropriateness of his conclusions. I do think that Dr. Kilmer is a good person and wants to do the right thing, but he lacks the proper skills to conduct a fair and unbiased investigation. Dr. Kilmer's wife Melanie is his assistant and does most of the investigating which complicates the process because she makes statements and then retracts them when confronted. She like Dr. Kilmer seems to be a really good person, but ultimately her involvement in the process prevents Dr. Kilmer from being able to conduct a proper investigation. My advice is if you are working with these two, do not discuss the investigation with her. Insist on having your conversations only with Dr. Kilmer, and absolutely make sure that every email, receipt, text message, voice mail, post card, kids report cards, home videos, or whatever other things you have are brought in to Dr. Kilmer organized by category, so has he is reviewing all of the allegations your defense has been provided. I would also suggest that you bring every person that you can think of to tell Dr. Kilmer as much about your situation as possible. If you don't bring them in he won't call. In our investigation he only called 2 witnesses that were unbiased and both had damaging things to say about the other parent. Then he made conclusions based on the children's medical history without evidence from me or talking to the children's doctor. My opinion is that there are other, more qualified investigators, and if you can you should try to use one of them and avoid Dr. Kilmer.

Unfortunately Dr. Kilmer did not do a thorough review of our family nor did he give any direction. He not only did not do a complete report for our family, he purposefully excluded information from the report on the actions regarding the other parent and their alienation including calling the cops and having the children watch as the other parent was frisked by police. His " reporting" is biased and he is also part of the "good ole' boys" club. Be ware of him and do not put your family's lives in the hands of this man. He also "lost" information given to him, forgot to give information to the courts, and also filed his report late. He cannot be trusted nor can his wife (his assistant) be trusted. He found parental alienation but had no recommendations or solutions to resolve the alienation and even enabled the mother to further alienate during the examination process by scheduling testing and home visits during his parenting time. You have to know how to play the game and have deep pockets with this man or the outcome will not be in your favor. Do not go to this man if you want any help for your family.
