State officials applaud Broward's payout plan to charter schools. The final tab: undisclosed

Broward County Public Schools avoided potential sanctions from the Florida Board of Education on Wednesday.

The district has been under pressure from state officials to pay out an estimated $80 million to the county’s charter schools.

The dispute dates back to a tax referendum that voters approved in 2018 to raise hundreds of millions of dollars to boost teacher pay and safety initiatives. It was money voters designated to go overwhelmingly to the county’s traditional public schools, with a fraction paid out to charter schools.

At the time, public schools weren’t required to share tax referendum money with charter schools, which are funded with tax dollars but are privately run.

Since then, court cases and a new state law have made clear that tax referendum money must be shared with charters. And Florida Education Commissioner Manny Diaz, a former charter school executive and an ardent advocate for school choice, has been working to ensure charters are paid out what they claim they are owed.

This week, the Broward school board voted to approve a three-part payment plan with the county’s charter schools to dole out an undisclosed amount, beginning on July 10, 2024.

“Payment one — July 10, 2024. One third of the principal and interest then due and owed to all charter public schools,” Broward Board Chair Lori Alhadeff said, reading out the motion.

“Payment two — July 10, 2025. One half of the remaining balance of principal and interest then due and owed to all charter schools following the first payment with interest compounding at 1% per month, 12% annually. Three, payment three — July 10, 2026 the balance of all principal and interest then due and owed to all charter public schools.”

The motion passed 7-1, with Board Member Allen Zeman voting against and Board Member Torey Alston having recused himself and abstained from voting.

The district had been addressing the claims of the charter schools in court, but rushed to settle the dispute after Diaz and the state board of education threatened sanctions.

Broward officials were hard-pressed to demonstrate to state officials that the district is in compliance with state law , which requires that charter schools be funded “the same as students enrolled in other public schools in a school district”.

At a meeting in Tallahassee on Wednesday, the state board decided to table any action against Broward until its July meeting.

“I’m very happy to hear that the school district and the charter schools have come to a tentative agreement — certainly what we had hoped for,” said State Board of Education Chair Ben Gibson. “And certainly beats litigating this issue for years without our students in all our schools getting the funding that they’re entitled to.”

State officials say they’ll continue to keep tabs on the district.

“I give you our complete assurance that we will continue to monitor this,” the state Education Commissioner told Gibson, “and have the board apprised of it so that the board can continue its oversight.”

The board had been poised to consider whether Broward was “unwilling or unable” to comply with state law. Possible consequences outlined under state law include formally reporting the noncompliance to the state legislature or withholding state funding.

Broward watchers were also concerned the dispute could be used to justify the removal of more Broward school board members — as Gov. Ron DeSantis has done in the past .

For a period of time in 2022, a majority of the board was composed of DeSantis appointees, despite the board representing one of the most reliably Democratic-leaning counties in the state.

How will Broward’s new superintendent deal with school closures, financial crisis?

B roward County Public Schools got a new superintendent Tuesday after Peter Licata unexpectedly announced his resignation due to health concerns, and now his successor has inherited all the many issues faced by the sixth largest school district in the country.

What are these challenges exactly and how will Howard Hepburn , the new head administrator, tackle them?

His first few hours on the dais may have shed some light on that.

Fixing the ‘slow and complicated’ plans to close schools

The main problem in the Broward school district — and for Hepburn — remains the loss of millions of dollars because of shrinking student enrollment.

On Tuesday, the district’s chief financial officer, Judith Marte, said the loss of 4300 students over the next school year has translated to a loss of $39 million in state funding.

The Tuesday meeting was the day that Licata was supposed to have brought details about what could be done to downsize the district. At a meeting last month, he promised board members to provide a more concrete proposal, but instead he provided his resignation. Hepburn had already been working closely with Licata and Alan Strauss, the school district’s task-assigned chief strategy and innovation officer, on school closures. So the frustration board members felt after seeing how far the district was from having anything resembling a plan was aimed at Howard.

In the meeting, as district staffers said they plan to keep searching for specific plans to close or repurpose specific schools, the board pushed Hepburn to be more transparent and efficient. A board member called the process so far “too complicated” and “too slow.”

Hepburn said he will work to add more transparency and strengthen community input, and will bring details during the next board meeting on the topic.

“That May 14 workshop will include a lot of quantitative data that helps to defend the decision-making about why certain options were chosen, why certain school closures should be expected and also outlining next steps thereafter,” he said.

Broward charter schools’ debt settled

On March 27, the State Board of Education determined that the Broward County School Board was currently breaking state law and owes about $80 million to local charter schools.

The state board accused the local school board of not complying with a statute that requires the school district to proportionately share funds it collects from a discretionary tax with charter schools, which are schools financed by taxpayers but managed by private entities.

The funds at hand came from a 2018 voter-approved referendum. The charter schools sued the school district over it last fall.

The state asked the district in late March to show how it will start complying with the revenue-sharing requirements by April 17.

On Tuesday, the Broward School Board met in a closed-door session with the charter schools’ attorneys to negotiate a settlement for the debt. After the session, the School Board approved a payment plan spanning from 2024 to 2026.

The School Board will pay one third of the debt plus interest on July 10, 2024, then one half of the remaining balance plus interest on July 10, 2025, and the full balance remaining with interest on July 10, 2026. All charter schools in the county will benefit.

Board member Allen Zeman was the only board member who dissented, but didn’t say why. Board Member Torey Alston abstained from voting “out of an abundance of caution.”

On Wednesday, Hepburn will likely travel to Tallahassee to share the news with the top education officials in the state.

Dealing with a budget worth losing sleep over

The dwindling revenue from the drop in enrollment, the charter schools’ settlement and a decision to approve teacher raises in late February have all taken hits on the school district’s nearly $6 billion budget.

On Feb. 27, the Broward School Board agreed to use nearly $20 million of federal COVID-19 relief funds to increase teachers’ pay But because it’s a recurring expense and the district won’t get more federal dollars, the district needs to cut elsewhere.

On Tuesday, the board touched on the topic, and Marte said the board will have to make “difficult decisions” to keep their financials in check.

“I’m probably losing more sleep balancing this budget than I have since 2008, when we had the Great Recession,” she said. In 2008, Marte worked as the CFO for Miami Dade County Public Schools. She stayed in MDCPS for nearly 15 years and has served the Broward school district for a combined total of six years since.

“I’m not sleeping well,” she said, “and I dare say most of my staff isn’t either.”

Still, Marte said Hepburn has participated in the process even though he headed academics, so he could transition into that overseeing role easier than others.

“Dr. Hepburn has been intimately involved with working through the budget with me in a partnership level that academics historically in my experience hasn’t been involved. He’s been a tremendous thought partner. And he’s helped craft some of what we present as difficult decisions, but decisions that have to be made.”

Bible controversy leads to process review?

During Tuesday’s unpredictable meeting, Hepburn also dealt with the contentious issue of book challenges in schools.

Currently, the Broward school district allows any Broward resident to object to material used in public schools.

The process starts with them filling out a form detailing the objection. Then the director of the district’s Innovative Learning Department convenes a Superintendent’s Review Committee to review the objection. The committee uses a rubric to decide whether the material breaks any policies or laws, and then submits a recommendation to the superintendent. The superintendent then decides to follow through with the recommendation or not, and passes it on to the School Board.

Because the district received an objection to the Bible last year, an SRC met in December to discuss the objection and decided to leave the book in schools. Licata ask the board to approve that, and the board did. But the topic attracted a lot of public speakers who complained about other material and the process itself.

Toward the end of the discussion, Board Member Brenda Fam asked Hepburn to share his opinion on it.

“I won’t specifically provide an opinion, but I will confer that we have a specific process; our team follows through with that process,” Hepburn said. “When that information comes to me, I look at it with a fine-tooth comb, and support or do something different based on the recommendation.”

“Would you agree with me that that process has failed?” Fam volleyed back.

“Let me say this, we’ll review the process,” he said. “I’ve heard the feedback from the people in the audience on both sides of the issue. We’ll use a fine-tooth comb and review the process and make sure it’s working for everybody.”

Florida Statue 1001.41 outlines that the school board shall determine policies and programs consistent with state laws and rules deemed necessary for the efficient operation and general improvement of the district school system. The School Board of Broward County, FL is the body which determines all questions of general policy to be employed for the administration of the District schools. Such matters of general policy shall be expressed through rules, which must be in conformity with the applicable provisions of the Federal and State constitutions, laws, and administrative rules of The Florida State Board of Education.

To ensure compliance with this statute, the School Board, has adopted the following policies itemized on this webpage. The School Board has devoted the District’s talents and resources towards enhancing the opportunity for each students to reach their highest potential. While our vision is to educate today’s students to succeed in tomorrow’s world, each rule (policy) will be reviewed and/or revised within five (5) years of the policy’s last review. This ensures that they continue to be relevant regarding the needs of the District and comply with current requirements of The School Board’s governing laws and rules.

At least fourteen (14) calendar days after the final adoption vote on the proposed rule (policy), any rule (policy) that was approved without changes by the School Board shall be uploaded to this webpage. These documents have been categorized and reformatted to PDF for use on the Internet; physical appearance may differ from that of the certified versions thereof on file in the Office of the Deputy Superintendent, Chief of Staff. All policies and rules of the School Board will be available for public inspection and copying at no more than actual cost through the Office of the Deputy Superintendent, Chief of Staff. A copy of the compiled rules (policies) shall be available for inspection by contacting the Office of the Chief of Staff during normal business hours.

The tale of the Broward County School Board in the last two years has been one of state interference, politically motivated chaos, and of a select few individuals holding the district hostage. Their weapon of choice? Threats of a state takeover, removing board members who disagree with the governor from office, and financial penalties that would further punish the students of Broward County Public Schools.

In September 2022, an official on the State Board of Education called for the removal of the superintendent at the time, Dr. Vickie Cartwright, due to her enforcement of a mask mandate that the school board had directed her to enforce. Just months later, a Desantis-appointed majority on the school board voted to fire her . Two years later, history repeats itself. On March 27, 2024, Superintendent Peter Licata, General Counsel Marilyn Batista, and Board Chair Lori Alhadeff appeared before the State Board of Education, and this time, a member of that board called for the firing of Batista. The offense? She was doing her job to protect the legal interests of the district, something she was directed to do by the school board just two weeks prior. Days later, Desantis-appointed School Board Member Daniel Foganholi (who, as of this writing, according to the Broward Supervisor of Elections Office, is registered to vote in Coral Springs, not in the district he is supposed to represent and is running for office in) put an item on the agenda to fire Batista.

The issue at hand was Commissioner of Education Manny Diaz’s demand that Broward Schools pay tens of millions of dollars to charter schools even though there was and is active litigation between the Broward Schools and a number of charter schools over those funds. Why would the commissioner involve the Florida Department of Education in an active lawsuit, presumably trying to overrule the courts? One might wonder if it has anything to do with his long history of working for and receiving hefty campaign donations from charter schools. Not long after the Desantis-appointed commissioner sent his letters, a Desantis-appointed School Board member, Torey Alston, (who, as of this writing, according to the Broward Supervisor of Elections Office, is registered to vote in Fort Lauderdale, not in the district he is supposed to represent) brought an item before the board to pay all charter schools the money they believe they’re owed, again ignoring the litigation the district was involved in. It appears easy for the Desantis-appointed commissioner and the Desantis-appointed board members to make politically motivated decisions because they don’t have to answer to the constituents of Broward County. It appears that they only have one person to answer to, and that certainly isn’t the voters.

The students and employees of Broward County Public Schools are suffering as a result of this circus. The district continues to sink deeper into power battles and chaos, and Broward’s students, teachers and staff deserve better than a politically charged minefield. It is time for the school board to be an agent of change, not an agent of chaos. It is time for them to focus on real issues impacting the district instead of a few individuals’ political ambitions. From the mental health crisis our youth are facing to the financial pressure under-enrollment is placing on the school district, Broward deserves a board that is student-focused, not a few individuals doing the bidding of whatever Tallahassee regime is in power and making political appointments.
