HKU Theses on Amazon and other online retailers

The University believes in promoting knowledge exchange and knowledge sharing and encouraging the flow of knowledge between the University and the community for mutual benefit. This is enshrined in the University’s Intellectual Property Rights Policy . As a key knowledge exchange strategy, the University has an open access policy under which graduates’ theses are placed in its institutional repository, the HKU Scholars Hub , for open access.

Authors of theses retain all proprietary rights (such as patent rights) and the right to use in future works. Access to and downloading of the Scholars Hub theses are intended for non-commercial purposes only.

Since February this year, a number of graduates’ theses were found to have been put up for sale on Amazon and other online bookstores and retailers. A publisher has made public announcements contesting, among others, the right of commercial use. The University takes the matter seriously and is taking a series of measures to put things right. Intellectual property rights must be respected and protected.

The purpose of this webpage is to provide a central place of communication for all those who are affected or are concerned about the situation. It includes a Frequently Asked Questions section addressing common issues, and key developments and new updates of the incident.

1. Why are HKU theses in open access?

HKU Theses in open access is one of the initiatives in alignment with the University’s vision in knowledge exchange, contributing to the advancement of society and the development of leaders in Hong Kong, the wider region and the rest of the world. In accordance with the University’s Regulations governing the format, binding and presentation of theses for higher degrees by research , one soft copy of the thesis is to be stored in the University’s institutional repository, and will be open to general access and consultation.

2. What actions have been taken by the Libraries so far?

We have restricted direct full text download and are making every effort to have Amazon and other distributors take down HKU dissertations and theses from their platform. We have also met with and exchanged ideas with the formed alliance led by two alumni. The incident has been reported to the Hong Kong Police. We are now seeking further advice from an international law firm based in Hong Kong who is in communication and negotiations with the CEO of the publishing company.

3. Can I restrict access to my theses now?

To secure access to HKU theses, direct full text downloading has been disabled on 3 March 2017. Requests now have to go through an auto-response form that generates a link enabling immediate access to a requested thesis. Included in this process is a mechanism that prevents automated access by computer programs. We hope this arrangement enables the University’s pursuit of knowledge exchange to continue while exercising due diligence in the secure access to HKU theses.

If a thesis author still wants to take down his/her thesis from the Scholars Hub temporarily until the incident is settled, he/she may submit a request to the University Libraries via the enquiries link below. The Libraries will further communicate with alumni when the incident is fully settled and theses should then be put onto the Hub again.

4. Who is the copyright owner of my thesis?

According to HKU’s Intellectual Property Rights Policy , Section 5.1.3 on “Student thesis”

(a) The Student shall retain copyright in his or her written thesis.

(b) The Student grants the University, in particular the University Libraries and the University Archives, a royalty free, perpetual, non-exclusive worldwide licence to circulate the thesis or use the thesis for other non-commercial purposes. The licence granted under this clause shall persist should the Student no longer be enrolled as a Student of the University.

5. I am going to publish my thesis / article based on my thesis with a publisher but my thesis is being sold on many online platforms. What can I do?

As of 21 March 2017, Creative Media Partners, LLC has in an open letter , “instructed that all dissertations immediately be removed from sale”. It may take some time for the bookstores to have the theses taken down. As copyright holder of the theses, you may still follow the applicable procedures and file complaints/ take-down notices according to the designated websites (e.g. typically meeting the requirements of the Digital Millennium Copyright Act (U.S. Copyright Office)).

6. We were told that the publisher will no longer sell HKU theses as of 21 March 2017 but our theses still appear in Amazon and other online bookstores and retailers. Why?

The sale of theses from the websites has been halted. We are in discussions to have the records removed. In an email from the publisher dated April 10, 2017, it was stated "We are monitoring and following up to have listings removed as efficiently, and quickly as possible. As we have stated, no dissertations are able to be produced pursuant to any order that may be attempted by any retailer". Our regular monitoring of the situation shows that most sites now list the theses as "Out of stock" or "unavailable". Additionally, the number of websites that originally listed the theses is declining. Please see the following reports for details:

Mrs Clara Pi

Mrs Clara Pi is a Registered Dietitian and an Adjunct Associate Professor at HKU SPACE. She was the Chair for the Asia Pacific Region of the Foodservice Consultants Society International (FCSI). In addition to her professional roles, Mrs. Pi is a dedicated environmentalist with a focus on food and nutrition, and has contributed to the field through public talks and publications including "Save our planet one carbon bite at a time! ".

Dr Jenny Tung

Dr Tung Shong Jenny, Senior Programme Director at HKU SPACE, is a leading figure in Traditional Chinese Medicine (TCM) in Hong Kong. With nearly two decades of experience in TCM clinical practice, education, and programme management, Dr. Tung is dedicated to promoting TCM culture and healthcare education. Her contributions, notably the Advanced Diploma in Practical Chinese Medicine (Chinese Medicine Nutritional Studies), are highly regarded within the community. Dr Tung has actively disseminated TCM knowledge through various media channels, including newspapers and television. In 2023, she secured funding from the Hong Kong Chinese Medicine Development Fund for the project "Inheritance of TCM Culture," featured in "Ju Jing Chuan Xiang."

Dr Benjamin Au Yeung Wai Hoo (Ben Sir), is a scholar in Linguistics. Apart from his career in academia, Benjamin is also a host, actor and the former senior lecturer at the Chinese University of Hong Kong’s Department of Chinese Language and Literature. Benjamin completed a Bachelor’s degree in English and Master of Philosophy at Chinese University of Hong Kong in 1995 and in 1997 respectively. He obtained his PhD at Hong Kong University of Science and Technology in 2005. Yeon Soo Lee is a cartoonist based on Jeju Island, South Korea, who studied art at Emily Carr University of Art + Design in Canada. Her bright and imaginative comics depict everyday scenes of friendship and love between dogs and humans. She currently serialises comics in The Hankyoreh, one of the largest daily newspapers in Korea, and on Instagram with over 12.4K followers. She has also published a comic book series called "A Dance with You" which consists of volumes 1 to 5. Additionally, she held a solo exhibition in 2018, and a new exhibition will be held in June this year in Korea.

Ms Laura Yamina Bermeo Mazzeo is a native Spanish language teacher from Argentina. She has been working as a Spanish language teacher at different institutions and universities in Hong Kong for over 20 years. Besides, having completed her accredited yoga teacher training at the International Yoga Academy, she has taught yoga to different age groups in both English and Spanish. With her experience of serving in the family-run yoga studio in Argentina and then teaching yoga, Pilates and aerobics in several fitness centers in Ecuador, she started her first yoga classes in Hong Kong on Lamma Island in 2013, and up to now, there are over 130 participants in her Yoga group.

Niu Niu(Zhang Shengliang) unveiled his exceptional talent at the age of three and graduated from the New York’s Juilliard School in 2018. In 2010, Niu Niu was named the youngest laureate of the PRIX Montblanc in Berlin. In 2012, as the first laureate of the Artemisia Foundation, he made his debuts in Boston’s Jordan Hall and Yale University’s Sprague Hall. In 2017, he was invited to perform for the presidents of China, Russia, India, Brazil and South Africa at the BRICS summit evening gala. Her teachers include renowned pianists and pedagogues Nancy Loo, Raymond Young, Elizabeth Powell, and Gerard Willems. Besides performing, Elsa is also a dedicated educator. Elsa is also an active presenter at music education conferences and received the “Best Presentation Award” at the College Music Society Northeast Conference. She was selected as one of the five Yamaha Graduate Fellows to work closely with deans and music faculty from across the United States at the Eastman Music Leadership Conference in 2017. Elsa taught applied piano lessons at Columbia University and Chamber Music at ArtsAhimsa Chamber Music Festival in Lenox, MA, USA. Mr Rex Shiu is a professional with more than ten years of experience in art restoration. His art processing level covers antiques and contemporary art, such as porcelain, mixed-media, sculptures, and paintings, to name a few. He mainly serves private collectors, auction houses, galleries, artists, insurance brokers and art logistics companies. In addition to assessing artworks' conditions, repairing damaged works, and providing art maintenance plans, this involves highly detailed technical work, such as evaluating the risks of art transportation and packaging and providing professional solutions. Regarding consulting services, he needs to provide customers with strategic and targeted solutions, recommends display spaces for artworks at art events of different scales, and set requirements for short-, medium-, and long-term storage and collection.

Ms Jeannie Wu

Ms Jeannie WU is an experienced Consultant with a Master of Arts in Literary & Cultural Studies from The University of Hong Kong and a demonstrated history of working in the management consulting industry. Wu’s role as an assistant to the art dealer at Vermillion Art Collections allowed Wu to gain in-depth insight into contemporary art collecting and connect closely with artists, particularly helping renowned local artist ‘Frog King’ to organise his studio. She actively engaged in various large-scale projects as a Project Officer at the Hong Kong Arts Centre, administering the project ‘Hong Kong Short Film: New Action Express’ sponsored by CreateHK. Wu then further expanded and consolidated her network within the local art scene during her freelance work supporting the artist-run initiative Painting On and On. After 4 years of working as Personal Assistant to collector/consultant/curator William Zhao, Wu took up key positions at K11 Art Foundation as Cultural Manager and then as the Director of HART Collective to lead within the art and cultural industry, break boundaries and connect creative talents within the network. By March 2022, she completed a contract with Alan Chan Design Company as an Art Consultant & Strategist. She is also a registered horticultural therapist with the International Asia-Pacific Horticultural Therapy Association, as well as with the Taiwan Horticultural Assisted Therapy Association, the Taiwan ACP Certified Horticultural Therapist, the Taiwan Heart Healing Card Instructor, a certified instructor in Japanese Pastel Nagomi Art, a certified instructor in Mental Health First Aid by the Hong Kong Mental Health Association (Standard, Youth Version, Older Persons), and a tutor in Korean Hand-Kneaded Aroma Stone. She has also participated in the publication of numerous articles on life education and horticultural therapy.

Mr Cheung is a dedicated practitioner and expert in the fields of traditional incense art and holistic well-being. With a wealth of teaching experience and profound knowledge, he currently serves as a tutor for HKU SPACE courses and as a master for the "Chinese Traditional Culture Promotion Association." In addition, he holds the position of The Chief Shingon Buddhist Guru at the "Universal Brightness Esoteric Buddhist Seminary".

Ms Lo is an experienced instructor and therapist, specializing in the art of Tao of Incense and promoting holistic well-being. She is a tutor and Shingon Buddhist Guru for the "Chinese Traditional Culture Promotion Association" and the "Universal Brightness Esoteric Buddhist Seminary". With her down-to-earth style and profound knowledge, Ms. Lo strives to promote the importance of incense appreciation and nurturing one's spiritual well-being.

Ms Ivana Chiu completed her undergraduate studies in Chinese-Korean Interpreting at Hankuk University of Foreign Studies in Korea, and earned a Master's degree in Chinese Linguistics and Language Acquisition from the Chinese University of Hong Kong. She presently serves as a full-time lecturer in the Korean Language Programme at HKU SPACE.

Mr Eric Kwong

Eric Kwong is a College Lecturer at HKU School of Professional and Continuing Education (HKU SPACE) and is currently the executive committee member of the Society of Japanese Languae Education Hong Kong. He has extensive experience in teaching Japanese language and Japanese culture, and has been in charge of the Associate of Arts in Languages and Humanities (Japanese Studies Theme) for many years. He was awarded the Outstanding Teacher Award of the HKU SPACE International College in 2018 and won the “Best Paper Award” in the 9th Biennial Convention of the Pacific and Asian Communication Association in 2012.
