The Uniform Civil Code is listed under Article 44 of the Indian Constitution. It is a part of the Directive Principles of State Policies, which are not enforceable by law. These policies are meant to guide both central and state governments to make laws for the welfare of all. The UCC talks about one common civil code for everyone. 

UCC meant the abolition of personal laws—laws based on scriptures and religious texts. These personal laws regulated almost every aspect of life, such as marriage, divorce, adoption, inheritance, guardianship, etc. A lot of these laws were discriminatory and unfair to minorities and women.

The origin of the Uniform Civil Code can be traced back to the Romans, who governed themselves based on a civil law, and not holy texts. So did the Mesopotamians. They followed the code of ‘Ur-Namo’, which is the oldest law code in history. 

The US Constitution is another example, where every individual is equal. The UCC was introduced in the Constituent Assembly in November 1948, and it divided the assembly into two different groups; some were in favour, while others were against. 

The objective of the UCC was simple: One Nation, One Law. Although the objective was simple, the Constituent Assembly failed to implement UCC. India is a highly diverse country with a population of more than 330 million people.

Right after independence, there was constant chaos of religions, ethnicities, customs, and social structures. Both Islamic Fundamentalists and Orthodox Hindus opposed the UCC. They wanted Sharia and Shashtras to determine personal laws. 

They feared that the UCC would diminish their authority and give it a different term, ‘A Threat to Religious Freedom’ . To challenge the UCC, they warm up to social unrest in the country. DR Ambedkar, the founding father of the Constitution retreated and made the proposal optional. Therefore, UCC was made Article 44 and listed under the Directive Principles of State Policies.

According to Article 44 of the Indian Constitution, ‘The State Shall Endeavour to Secure for the Citizens a Uniform Civil Code Throughout the Territory of India.’

  • It will uplift women and oppressed religious communities who have been deprived of their rights. Today, Goa is the only Indian state where the UCC is implemented. 
  • Until 1961, Goa was a Portuguese colony, where they introduced a civil code applicable to everyone in the colony. 
  • Even Islamic countries like Turkey, Egypt, Jordan, and Morocco have codified personal laws as per their constitutions. Also, Jordan and Egypt have banned triple talaq.

In the 1980s, the UCC once again gained momentum. In the Shah Banu case, she appealed for justice after being divorced by her husband. According to Muslim Law, she was entitled to only 3 months of alimony. The Supreme Court ruled in her favour and Shah Bano was awarded maintenance.

The Supreme Court of India said, ‘A common civil code will help the cause of national integration by removing disparate loyalties to laws that have conflicting ideologies.’ 

In its 2019 manifesto, the BJP promised the best provisions for different personal laws from different religions.

The Trump Trial’s Extraordinary Opening

The first days of the criminal case against the former president have been mundane, even boring—and that’s remarkable.

The defendant nodded off a couple of times on Monday. And I have to confess, as a spectator in an overflow courtroom watching on closed-circuit television, so did I.

Legal proceedings can be like that. Mundane, even boring. That’s how the first couple of days of the trial in the People of the State of New York v. Donald J. Trump, Indictment No. 71543–2023, felt much of the time. Ordinary—despite being so extraordinary. And, frankly, that was comforting. The ordinary mechanics of the criminal-litigation process were applied fairly, efficiently, and methodically to a defendant of unparalleled notoriety, one who has devoted himself to undermining the rule of law.

Certainly the setting was ordinary. When the Criminal Courts Building, at 100 Centre Street in Lower Manhattan, first opened in 1941, an architectural critic lamented that the Art Deco structure, a New Deal/Public Works Administration project, was “ uncommunicative .” Eight decades later, it still has little to say. Raw and spartan, it’s a bit of a mystery to people who aren’t familiar with it (including me, a civil litigator who, despite having been admitted to the New York state bar some 35 years ago, practiced mostly in federal and Delaware courts). A pool reporter yesterday described the surroundings as “drab.”

Drab indeed, but busy—very busy. There’s never a want of bustle here, of the sort you would expect. As the former federal prosecutor Andrew Weissmann put it this week, 100 Centre is, “well, Dickensian—a beehive of activity with miscreants, state prosecutors, judges, defense lawyers, probation officers, court security [and] families—in dark, dingy halls and courtrooms.” It’s a bit like New York City as a whole: How it functions, with the volume it handles, never ceases to amaze.

And how the court manages to keep track of things, Lord only knows. In contrast with the federal courts or even New York’s civil courts, it has no electronic, publicly accessible docket. The Supreme Court of the State of New York for the County on New York, Criminal Term, is, as one courthouse reporter said last month, “stuck in the past.” It’s a tribunal “where the official record is a disorganized and incomplete mass of paper with no accounting of what’s inside.” The records come in brown accordion folders—Redwelds, lawyers call them—and what judges and clerks decide to put in them is the record, and what they don’t is not.

But somehow it works. Somehow the court manages to dispose of thousands of cases a year, involving all manner of defendants and offenses. A calendar emailed to journalists by the Manhattan District Attorney’s Office listing the week’s anticipated court appearances gives you the flavor. It catalogs names seemingly of many ethnicities, with a couple of corporate entities to boot. A hodgepodge of alleged charges, including the violent and the corrupt: robbery, conspiracy, forgery, criminal mischief, identity theft, enterprise corruption, stalking, murder, attempted murder, sex trafficking, grand larceny, attempted grand larceny, possession of a forged instrument, offering a false statement for filing.

And the list contained three cases involving the crime of falsifying business records, one of which was set for trial on Monday, April 15, in Part 59, Courtroom 1530—People v. Trump.

Nothing on the calendar, other than the defendant’s readily recognizable name, would have told you there was anything special about the case. In that sense, it was ordinary. But the hubbub outside—a handful of protesters, multiple television cameras, and a long line for the press and other spectators—made clear that something somewhat special was afoot. An overflow courtroom down the hall from the main courtroom offered a closed-circuit television feed of the proceedings. Those who had lined up went through an extra set of security screeners and machines—mandated, we were told, by the United States Secret Service.

But still, so much was ordinary—the stuff of the commencement of a criminal trial, housekeeping of the sort you’d see in virtually any court about to try a criminal case. That began promptly at 10:00 a.m. on Monday, when Judge Juan Merchan assumed the bench. There were loose ends for the judge to tie up, pending motions to decide. Merchan denied the defendant’s motion to recuse, reading, in even tones, an opinion from the bench. The motion was frivolous; the result unsurprising. And then the parties argued some motions in limine—pretrial efforts to exclude evidence.

For example, would the notorious Access Hollywood tape that rocked the 2016 presidential campaign be played for the jury?  The prosecution said it should be: An assistant district attorney said the tape would elucidate why the defendant and his campaign were so hell-bent, to the point of falsifying business records, on keeping additional instances of the defendant’s miscreant conduct with women out of the public eye. The defense, of course, argued that playing the tape would be prejudicial. After all, this wasn’t a case about sexual assault.

The judge allowed that the tape’s existence provided context for the business-records charges but ruled that actually showing the tape to the jury would be prejudicial. Instead, the jury would be given a transcript. And speaking of sexual assault, prosecutors tried to get in an excerpt from Trump’s deposition in the E. Jean Carroll sexual-assault and defamation cases in which Trump testified that he was a “star,” and that stars historically get to do to women what Trump said on the Access Hollywood tape that he liked to do to them. Judge Merchan rightly said no, he would not allow the jury to hear that. It would be too much, too beside the point of what this case (unlike the Carroll cases) is actually about.

But as unusual and colorful as the factual predicate for the evidentiary motions was, the argument wasn’t all that interesting. It was rather low-key, in fact. Perhaps that was because none of the proffered evidence was new. But it was also because the arguing of pretrial evidentiary motions, however crucial they may be (although these, frankly, weren’t), is seldom scintillating. I can’t imagine that Donald Trump and I were the only ones watching who dozed off.

Then came jury selection, which took the rest of Monday, all of yesterday, and will probably consume tomorrow and Friday as well. (The judge will be handling his other cases today.) That was a bit more interesting, but slow going at first. Again, the ordinary met the extraordinary. Ninety-six potential jurors were brought in. The judge provided an overview of the case in the broadest terms, describing the charges in a few sentences; explained what his role and what the jury’s would be; and read the names of the cast of characters (some would be witnesses, others would simply be mentioned, including—full disclosure—my ex-wife). Still, it was mundane. It was pretty much what a judge would say in any big case.

And jury selection was a bit tedious; in a case like this, it simply has to be. Jurors were asked to give oral answers—some 42 of them, including a number with multiple subparts—to a written questionnaire. In substance: Where do you live? What do you do? What’s your educational background? What news sources do you read? What’s your experience with the legal system? Have you ever been to a Trump rally or followed him on social media? Have you belonged to any anti-Trump groups? And on and on and and on. But the most important inquiries came toward the end of the list: questions asking whether the prospective jurors could be fair. Occasionally the judge would interject, when an unusual or unclear answer was given. And once in a while there was a moment of levity: One woman—in response to a question about having relatives or close friends in the legal field—noted that she had once dated a lawyer. “It ended fine,” she volunteered, with a flatness of tone that betrayed no hint of nostalgia or loss.

This process took well over a day, and included brief follow-up questioning—“voir dire”—by the lawyers for both sides. But the judge did take a shortcut, one that saved a great deal of effort: After describing the case, but before proceeding to the individual-by-individual, question-by-question process, he asked the entire group the bottom-line question: Do any of you think you couldn’t judge the case fairly? Roughly two-thirds of this first batch of potential jurors said they couldn’t. That was extraordinary—a reflection of the fact that everyone knows who the defendant is, and that not many people lack a strong opinion about him.

And during the lawyers’ voir dire, a few interesting moments did occur, mostly when Trump’s lawyers pulled out social-media posts that they claimed showed possible bias on the part of the remaining candidates in the jury pool. One man was stricken by the court for cause because he once posted that Trump should be locked up.  The Trump lawyers attempted, but failed, to get the court to strike a woman whose husband had posted some joking commentary about the former president. The judge’s response: That’s all you have? He allowed the juror to stay, and left it to counsel to decide whether to use their limited number of peremptory strikes.

In the end, for two days, the extraordinary intertwined with the ordinary, as it should in a case like this one. As one young woman from the Upper East Side, now to be known as Juror No. 2,  put it during the selection process, “No one is above the law.” Let’s hope that sentiment prevails.

An NPR editor who wrote a critical essay on the company has resigned after being suspended

NEW YORK (AP) — A National Public Radio editor who wrote an essay criticizing his employer for promoting liberal views resigned on Wednesday, attacking NPR’s new CEO on the way out.

Uri Berliner, a senior editor on NPR’s business desk, posted his resignation letter on X, formerly Twitter, a day after it was revealed that he had been suspended for five days for violating company rules about outside work done without permission.

“I cannot work in a newsroom where I am disparaged by a new CEO whose divisive views confirm the very problems” written about in his essay, Berliner said in his resignation letter.

Katherine Maher, a former tech executive appointed in January as NPR’s chief executive, has been criticized by conservative activists for social media messages that disparaged former President Donald Trump. The messages predated her hiring at NPR.

NPR’s public relations chief said the organization does not comment on individual personnel matters.

The suspension and subsequent resignation highlight the delicate balance that many U.S. news organizations and their editorial employees face. On one hand, as journalists striving to produce unbiased news, they’re not supposed to comment on contentious public issues; on the other, many journalists consider it their duty to critique their own organizations’ approaches to journalism when needed.

In his essay , written for the online Free Press site, Berliner said NPR is dominated by liberals and no longer has an open-minded spirit. He traced the change to coverage of Trump’s presidency.

“There’s an unspoken consensus about the stories we should pursue and how they should be framed,” he wrote. “It’s frictionless — one story after another about instances of supposed racism, transphobia, signs of the climate apocalypse, Israel doing something bad and the dire threat of Republican policies. It’s almost like an assembly line.”

He said he’d brought up his concerns internally and no changes had been made, making him “a visible wrong-thinker at a place I love.”

In the essay’s wake, NPR top editorial executive, Edith Chapin, said leadership strongly disagreed with Berliner’s assessment of the outlet’s journalism and the way it went about its work.

It’s not clear what Berliner was referring to when he talked about disparagement by Maher. In a lengthy memo to staff members last week, she wrote: “Asking a question about whether we’re living up to our mission should always be fair game: after all, journalism is nothing if not hard questions. Questioning whether our people are serving their mission with integrity, based on little more than the recognition of their identity, is profoundly disrespectful, hurtful and demeaning.”

Conservative activist Christopher Rufo revealed some of Maher’s past tweets after the essay was published. In one tweet, dated January 2018, Maher wrote that “Donald Trump is a racist.” A post just before the 2020 election pictured her in a Biden campaign hat.

In response, an NPR spokeswoman said Maher, years before she joined the radio network, was exercising her right to express herself. She is not involved in editorial decisions at NPR, the network said.

The issue is an example of what can happen when business executives, instead of journalists, are appointed to roles overseeing news organizations: they find themselves scrutinized for signs of bias in ways they hadn’t been before. Recently, NBC Universal News Group Chairman Cesar Conde has been criticized for service on paid corporate boards.

Maher is the former head of the Wikimedia Foundation. NPR’s own story about the 40-year-old executive’s appointment in January noted that she “has never worked directly in journalism or at a news organization.”

In his resignation letter, Berliner said that he did not support any efforts to strip NPR of public funding. “I respect the integrity of my colleagues and wish for NPR to thrive and do important journalism,” he wrote.

NPR editor Uri Berliner resigns after essay accusing outlet of liberal bias

A senior business editor at National Public Radio has resigned after writing an essay for an online news site published last week accusing the outlet of a liberal bias in its coverage.

In a Wednesday post on X , Uri Berliner included a statement in what he said was his resignation letter to NPR President and CEO Katherine Maher.

"I am resigning from NPR, a great American institution where I have worked for 25 years," Berliner wrote in the post. "I don't support calls to defund NPR. I respect the integrity of my colleagues and wish for NPR to thrive and do important journalism. But I cannot work in a newsroom where I am disparaged by a new CEO whose divisive views confirm the very problems at NPR I cite in my Free Press essay."

On Friday, Berliner was suspended for five days without pay, NPR confirmed Tuesday , a week after his essay in the Free Press, an online news publication, where he argued the network had "lost America's trust" and allowed a "liberal bent" to influence its coverage, causing the outlet to steadily lose credibility with audiences.

Berliner's essay also angered many of his colleagues and exposed Maher, who started as NPR's CEO in March, to a string of attacks from conservatives over her past social media posts.

NPR reported that the essay reignited the criticism that many prominent conservatives have long leveled against NPR and prompted newsroom leadership to implement monthly internal reviews of the network's coverage.

Neither NPR nor Maher have not yet publicly responded to Berliner's resignation, but Maher refuted his claims in a statement Monday to NPR.

"In America everyone is entitled to free speech as a private citizen," Maher said. "What matters is NPR's work and my commitment as its CEO: public service, editorial independence, and the mission to serve all of the American public. NPR is independent, beholden to no party, and without commercial interests."

NPR Suspends Editor Whose Essay Criticized the Broadcaster

NPR has suspended Uri Berliner, the senior business editor who broke ranks and published an essay arguing that the nonprofit radio network had allowed liberal bias to affect its coverage.

Mr. Berliner was suspended by the network for five days, starting Friday, for violating the network’s policy against doing work outside the organization without first getting permission.

Mr. Berliner acknowledged his suspension in an interview with NPR on Monday , providing one of the network’s reporters with a copy of the written rebuke. In presenting the warning, NPR said Mr. Berliner had failed to clear his work for outside outlets, adding that he would be fired if he violated the policy again.

Mr. Berliner’s essay was published last week in The Free Press, a popular Substack publication.

He declined to comment about the suspension. NPR said it did not comment on personnel matters.

The revelation of Mr. Berliner’s punishment is the latest aftershock to rattle NPR since he published his essay. Employees at the public radio network were taken aback by Mr. Berliner’s public condemnation of the broadcaster, and several have said they no longer trust him because of his remarks. Mr. Berliner told The New York Times last week that he did not reach out to the network before publishing his essay.

After Mr. Berliner’s essay was published, NPR’s new chief executive, Katherine Maher, came under renewed scrutiny as conservative activists resurfaced a series of years-old social media posts criticizing former President Donald J. Trump and embracing progressive causes. One of the activists, Christopher Rufo, has pressured media organizations into covering controversies involving influential figures, such as the plagiarism allegations against Claudine Gay, the former Harvard president.

NPR said on Monday that Ms. Maher’s social media posts were written long before she was named chief executive of NPR, and that she was not working in the news industry at the time. NPR also said that while she managed the business side of the nonprofit, she was not involved in its editorial process. Ms. Maher said in a statement that “in America everyone is entitled to free speech as a private citizen.”

Several NPR employees have urged the network’s leaders to more forcefully renounce Mr. Berliner’s claims in his essay. Edith Chapin, NPR’s top editor, said in a statement last week that managers “strongly disagree with Uri’s assessment of the quality of our journalism,” adding that the network was “proud to stand behind” its work.

Some employees have begun to speak out. Tony Cavin, NPR’s managing editor for standards and practices, took issue with many of Mr. Berliner’s claims in an interview with The Times on Tuesday, saying Mr. Berliner’s essay mischaracterized NPR’s coverage of crucial stories.

Mr. Cavin said NPR’s coverage of Covid-19, one of the lines of reporting that Mr. Berliner criticized, was in step with reporting from other mainstream news organizations at the time. The coverage, he said, attributed the origins of the virus to a market in Wuhan, China. He also defended NPR’s coverage of Russian interference in the 2016 U.S. election, another area Mr. Berliner focused on, noting that Robert Mueller, the special counsel investigating the issue, concluded that Russian state actors had made attempts to sway the election.

Mr. Cavin also pointed out that NPR had no way to verify early articles about Hunter Biden’s laptop after the story broke but pursued follow-up stories examining the situation. Mr. Berliner wrote that NPR had “turned a blind eye” to the story about Mr. Biden’s laptop.

“To somehow think that we were driven by politics is both wrong and unfair,” Mr. Cavin said.
