In Mike Judge's Office Space , Lumbergh, the French-cuffed smug dolt of a boss, passive-aggressively berates Peter for failing to file his TPS reports with a cover sheet. Thanks to that scene, "TPS report" has entered the vernacular and is routinely used when someone wants to evoke mundane, rote busywork. It has popped up in ads , music , video games ...the list goes on.

But what is a TPS report?

According to Rolling Stone , Judge was asked this at a 10th Anniversary screening of Office Space . He replied, "When I was an engineer, it stood for Test Program Set. Isn't that exciting?" A Test Program Set a document describing the step-by-step process in which an engineer tests and re-tests software or an electronics system. Before getting his start with Beavis and Butthead , Mike Judge earned a degree in physics and was an engineer and programmer for a subcontractor working on military jets. In other words, the man had to fill out his fair share of TPS reports in his day.

"TPS" can also refer to a "Testing Procedure Specification," which is a very similar bit of tedious documentation created and defined by the Institute of Electrical and Electronics Engineers (IEEE). (Its document number is IEEE 829.)

The Supreme Court decision on TPS

On June 7, 2021, the Supreme Court issued a decision in Sanchez v. Mayorkas. The Supreme Court decision clarifies that having TPS does not count as an “inspection” and lawful admission to the U.S., which is generally required by law for somebody to “adjust status” and get a green card from within the U.S. instead of having to apply for it abroad. The Supreme Court’s decision means that even if you were granted TPS and a family member or employer wants to sponsor you for a green card, if you entered the United States unlawfully, you have to travel outside of the U.S. and apply at a U.S. consulate or embassy for your green card, which often creates additional legal hurdles to TPS holders to secure a green card.

This does not mean that all TPS holders cannot adjust status, or be issued an immigrant visa, if they qualify and are admissible; it simply means that for those who were not inspected or admitted when coming to the U.S., they cannot get their green card from within the U.S. However, if a TPS holder is granted advance parole — travel authorization issued by the government– re-entering the U.S. with advance parole will enable a person to get a green card from within the U.S.

An immigrant that is “admitted” into the U.S. is someone who lawfully entered the U.S. through a port of entry and was inspected by an immigration officer. Someone who enters the U.S. without inspection by an immigration officer was not “admitted.”

Adjustment of Status means applying for permanent residency (a green card) and receiving it while living in the United States in a temporary immigration status.

TPS holders can qualify for permanent immigration pathways. However, someone cannot adjust to permanent status solely because they currently have TPS – they have to qualify for another pathway (family-sponsorship or employer-sponsorship, for example).

TPS holders should consult with an immigration attorney or accredited legal representative to see if they are eligible to adjust status or for other categories for immigration relief.

What is TPS?

Temporary Protected Status (TPS) is a form of humanitarian relief established by a bipartisan act of Congress (the Immigration Act of 1990) and granted by the Department of Homeland Security (DHS) to eligible nationals of countries undergoing an environmental disaster, armed conflict, or extreme conditions preventing their safe return. It does not– by itself– provide a pathway to lawful permanent status or citizenship. TPS holders are protected from deportation and can be temporarily authorized to work and travel. The Secretary of DHS can extend TPS designations based on current conditions of the designated country, and re-designate countries– move forward the date of when somebody needs to have been in the U.S. to be eligible– if conditions persist or worsen.

TPS Litigation and Developments

The Trump Administration terminated TPS for Nepal, Honduras, Guinea, Liberia, Sierra Leone, El Salvador, Haiti*, Nicaragua, and Sudan. However, due to lawsuits from TPS holders, the government has been forced to delay the termination of TPS for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan. However as of September 10th, DHS announced they would automatically be extending TPS from October 4, 2021, to December 31, 2022 for El Salvador, Haiti, Nicaragua, Sudan, Honduras, and Nepal pending a court decision. TPS was also extended and redesignated for Syria, Yemen**, Somalia***, and South Sudan, meaning that people arriving more recently from these countries who do not already have TPS are eligible to apply.

On June 9th, 2023 the Biden Administration rescinded the prior Administration’s termination of TPS for El Salvador, Honduras, Nepal, and Nicaragua. The decision extended TPS for 18 months for those countries but did not redesignate TPS. Meaning current TPS beneficiaries of those countries must re-register for TPS to keep their protections, but individuals from those countries who do not already have TPS generally cannot now. See below for specific re-registration period windows. Unfortunately, new applicants cannot apply at this time.

*** Somalia

On July 19, 2021 the Secretary of Homeland Security announced an extension and re-designation of TPS designation for Somalia through March 17, 2023. The extension allows current TPS holders to renew their protections; the redesignation allows Somalia nationals who have been continuously present in the U.S. since July 19, 2021 to apply as well.

This means that current TPS holders and people who qualify for TPS from Yemen can obtain TPS through March 17, 2023.

The re-registration period is from July 22, 2021- September 20, 2021, this means that current TPS holders must renew during this time period.

New applicants can apply between July 22, 2021- March 17, 2023

** July 6, 2021 – Yemen

On Jul 6, 2021 The Secretary of Homeland Security announced an extension and re-designation of TPS designation for Yemen through March 3, 2023. The extension allows current TPS holders to renew their protections; the redesignation allows Yemeni nationals who have been continuously present in the U.S. since July 5, 2021 to apply as well.

This means that current TPS holders and people who qualify for TPS from Yemen can obtain TPS through March 3, 2023.

The re-registration period is from July 9, 2021 through September 7, 2021 , this means that current TPS holders must renew during this time period.

New applicants can apply between July 9, 2021 to March 3, 2023.

* May 22, 2021 – Haiti

On May 22, 2021 the U.S. government announced a new TPS designation for Haiti. Because the previous designation for Haiti was terminated, everyone eligible for Haiti TPS , including individuals who currently have TPS under the previous designation, need to apply for protection under the new designation.

All applicants can apply between August 3, 2021 through February 3, 2023.

March 2, 2022 – South Sudan

On March 2, 2022 the Secretary of Homeland Security announced an extension and re-designation of TPS designation for South Sudan through November 3, 2023. The extension allows current TPS holders to renew their protections; the redesignation allows South Sudan nationals who have been continuously present in the U.S. since March 1, 2022 to apply as well. 

This means that current TPS holders and people who qualify for TPS from South Sudan can obtain TPS through November 3, 2023. 

The re-registration period is from March 3, 2022, to May 2, 2022, this means that current TPS holders must renew during this time period. 

New applicants can apply between March 3, 2022, through Nov. 3, 2023. 

March 2, 2022 – Sudan 

On March 2, 2022 the Department of Homeland Security announced the new TPS designation for Sudan. 

Existing TPS Sudan beneficiaries can retain their TPS through December 31, 2022, and the Department of Homeland Security will continue to extend TPS for them as required by court order. However, these beneficiaries are also strongly encouraged to register under the new designation of Sudan to receive TPS benefits for the full 18-month period. Individuals will need to file a new application to register for TPS to avoid losing TPS or experiencing a gap in coverage.

March 3, 2022 – Ukraine

On March 3, 2022 the Department of Homeland Security announced the new TPS designation for Ukraine for 18 months. Individuals eligible for TPS for Ukraine must have continuously resided in the United States since March 1, 2022. 

March 16, 2022 – Afghanistan

On March 16, 2022 the Department of Homeland Security announced the new TPS designation for Afghanistan for 18 months. Individuals eligible for TPS for Afghanistan must have continuously resided in the United States since March 15, 2022. 

There are two pending lawsuits (Bhattarai v. Nielsen) and (Ramos v. Nielsen) challenging the previous administration’s decision to end TPS for the following countries:

  • El Salvador

Due to the lawsuits the terminations have been paused and TPS protections have been extended. (See above for expiration dates per country).

While the court cases are still pending, and we don’t know how they will be resolved, we do know that those TPS holders –and their families– from countries where TPS has been extended and/or redesignated (as discussed above, which would keep you protected if you qualify for TPS) at least have relief, and the Biden Administration has the authority to extend and redesignate those countries whose designations remain in limbo.

It is important, in these uncertain times, for those eligible to re-register for TPS to do so as soon as possible. As always, we encourage you to consult with an immigration attorney or accredited legal representative before filing anything. You can find a step-by-step re-registration guide here . In the meantime, advocates will continue to push Congress to use its power to find a permanent solution for all TPS holders, whether they are covered by the injunction or not.

If there is a redesignation– a new designation– TPS holders from that country are required to re-register if they wish to maintain TPS status. Typically, in addition to re-registering, TPS holders must renew their Employment Authorization Documents (EADs) to continue working legally in the United States until their TPS expires.

First-time TPS applicants and TPS holders who are re-registering can now file for TPS online . We recommend that you seek legal help or reach out to an accredited organization that can guide you through the process. There will be people who might try to take advantage of your situation, check out these resources that can help you avoid becoming a victim of fraud .

First, check if the re-registration window is currently open for TPS for your country by visiting USCIS’ TPS page here , and selecting your country from the left hand side of the page for guidance.

If you have not re-registered and TPS is still active for your country, follow these steps to re-register:

  • Find your previous registration or re-registration application and use it as a guide as you complete your new application. You can check to make sure that the information on your new application is consistent with the information you submitted in your previous application.
  • Make sure to download the correct forms directly from USCIS. You can download them here . IMPORTANT: if a form is out of date or old, USCIS will not accept it and your application will be rejected.

You will need to download and complete the following forms. Make sure to read the list of requirements for each form on the USCIS page to ensure you are not leaving out any required supporting documents or materials:

  • Form I-821 : Application for Temporary Protected Status
  • Form I-765 : Application for Employment Authorization. Description: this is the application to receive an Employment Authorization Document (EAD) to work legally in the U.S., which is available to all individuals approved for TPS. Please note that this form must include two passport-sized photos with the applicant’s name, A-Number, and form number written on the back of each photo and paper clipped to the I-765 form.
  • Form I-912 : Request for Fee Waiver. Description: fee waivers are available to some individuals for certain immigration services and forms based on a demonstrated inability to pay (financial need).
  • Form I-131 : Application for Travel Document. Description: this is the application for “advance parole,” which enables the recipient to temporarily travel outside of the U.S for humanitarian, education, or employment purposes. Please note that this form must include two passport-sized photos with the applicant’s name, A-Number, and form number written on the back of each photo and paper clipped to the I-131 form.
  • Form I-601 : Application for Waiver of Grounds of Inadmissibility. Description: When you apply, if you are aware that a relevant ground of inadmissibility applies to you and you need a waiver to obtain TPS, please fill out this form. However, once you have had a I-601 form approved by USCIS and received a waiver of inadmissibility, you do not need to file a new Form I-601 for any future TPS applications. USCIS may grant a waiver of certain inadmissibility grounds for humanitarian purposes, to assure family unity, or when it is in the public interest. Please note that this form must be submitted along with a $930 filing fee.
  • A letter explaining in detail why you are filing late. If you file outside of the registration period, the letter must show “good cause” for late filing – in other words, you must have a good reason. Reasons can include but are not limited to: an emergency situation that prevented you from filing on time, reasonable confusion caused by pending litigation, or confusion caused by DHS announcements of termination or extension of TPS for your country. Explain how these affected you, including how they impacted your ability to re-register on time.

*If you file your TPS re-registration application late, processing may be delayed and can lead to gaps in your work authorization.

3. Accurately fill out all forms. Remember to read all instructions on the forms thoroughly, and to double check your responses with the responses you included in your previous registration or re-registration application so that the information is consistent. It is recommended that you fill out the forms digitally to make sure all information is readable. If you are filling them out by hand, make sure you write clearly with a black pen.

4. Create a cover letter that includes a checklist of the items and documents in the submission to help the USCIS agent easily see what they are about to review.

5. Purchase your money order. You can purchase one at your local U.S. Post Office. USCIS does not accept cash. The money order must be made out to “U.S. Department of Homeland Security” (do not use abbreviations like “DHS”).

If the application is for someone 15 years or older, the money order should be for $495. This covers the Employment Authorization Application (Form I-765) filing fee ($410) and biometrics fee ($85). Applicants 14 years and younger do not need biometrics done, so their money order should be for just $410.

If you are also applying for a waiver of grounds of inadmissibility (form I-601), you must also include a money order for $930, the filing fee for that form.

6. Photocopy the contents of your entire application, including copies of your money orders, photos, and supporting documentation.

7. Package and send your application, ideally via certified mail so that you can track your package and verify that it was delivered to USCIS. We recommend that your application packet be in the following order to make it easier for review:

  • $495 Money Order ($410 for applicants 14 years and younger)
  • Cover Letter
  • Completed Form I-821
  • Letter explaining your reason for a late re-registration (if applicable)
  • Completed Form I-765.The form should include two passport size photographs. You can paper clip the photos to the correct form. Make sure to write the applicant’s name, Alien Registration Number (A-Number), and form number on the back of each photo.
  • Other completed forms as relevant to your case (e.g. Form I-601, Form I-912, Form I-131)
  • A copy of your last EAD (if possible, include copies of all EADs you have received over the years)
  • Past TPS approval notices
  • Evidence to prove your identity and nationality, such as passports and birth certificates
  • Evidence to prove your date of entry into the United States
  • Evidence to prove your residence in the United States
  • Court disposition records (if you were ever arrested, charged, or convicted for a criminal offense)
  • Other documentation of your immigration proceedings

Tip: Do not staple your application together. This makes it harder for the review process and your application could even be rejected by USCIS. Instead use paper clips.

After reviewing and double-checking your application for accuracy, you are ready to mail it to USCIS for processing. The mail-to address depends on the country you are from which has received TPS designation.

You can check on the USCIS site here for where to mail the application. Once on the site, on the left hand side under TPS, select your country. Once on the landing site for your selected country, scroll down to “Where to File” and click the section open to see the correct mailing address to send your application to.

Tip: We advise that you mail using priority shipping that includes a tracking number. The USPS’s Priority Mail flat-rate envelopes are perfect for this.

CLINIC: TPS and DED Resources for Practitioners and Beneficiaries

Tps expiration.

If your TPS expires and you are not eligible to re-register, you will generally return to your prior immigration status before you obtained TPS. For example, if you entered the U.S. without inspection and are not eligible for another form of immigration relief, then you return to an undocumented status and become subject to removal. However, if you previously had a lawful nonimmigrant status, such as having a student or work visa, if it has expired, you will no longer be considered to have that status and will be considered undocumented. You should consult an immigration attorney, legal services organization, or DOJ-accredited representative for guidance and closer examination of your case to see if you qualify for another form of relief. You can find an organization near you that can help with this.

If your TPS expires and you are eligible to re-register, DHS may automatically extend your current EAD to accommodate the time it takes to submit and process your re-registration application. We advise re-registering as soon as the re-registration window for your country opens

Whether you qualify for another form of immigration relief or not, you should construct a family preparedness plan to prepare for various scenarios. You can find guides here . Your work permit is valid until the expiration date listed on the employment authorization document. If your TPS expires but you are eligible to re-register, DHS may automatically extend your current EAD to accommodate the time it takes to submit and process your re-registration application.

If TPS for your country has been terminated and you are not eligible to renew, you will be unable to renew your work permit under TPS.

You may be eligible for another form of immigration relief if you have or used to have TPS. You should consult with an organization, immigration attorney, or DOJ-accredited representative to review your case, as each individual’s case is unique and there can be many options. You can find an organization near you that can help with this. You can also use the Immi tool to check if you’re eligible for other forms of immigration relief.

A U.S. citizen’s status is not impacted if their parents’ TPS expires. However, they may be emotionally or financially impacted if a parent is forced to leave the U.S. If you or a family member have TPS, it is a good idea to make a family plan that includes travel, financial, and custody arrangements for your children, in case you need to relocate or navigate other circumstances. You can find family preparedness planning guides here . Making a plan will help you and your loved ones feel more prepared and secure, no matter what happens.

TPS holders who want to travel outside the United States must first apply for advance parole travel authorization. You may apply for this with Form I-131 and file it together with the I-821 or separately based on a pending or approved I-821.

However, before deciding to depart the country, you should consult an immigration attorney or DOJ-accredited representative about the risks of traveling with advance parole.

Some Fans Think ‘The Mandalorian’ Made A Subtle ‘Office Space’ Reference

The latest episode of The Mandalorian gave fans a lot less Baby Yoda Grogu and a lot more wardrobe changes for its titular character. Spoilers ahead if you haven’t streamed it yet, but there was also a sly reference to the Mike Judge cinematic universe that wasn’t quite as viral as a tiny force-sensitive creature, but certainly had fans talking on social media.

The seventh episode of Season 2 had our hero swapping Mandalorian armor for something a bit more Imperial, then actually revealing his face when things got tight on Morak. But it also brought with it the return of Bill Burr, which is apparently as close to Boston as the Star Wars universe will get anytime soon.

Din Djarin and Burr’s Migs Mayfeld get into a tight spot with some Imperial officers on a refinery near the episode’s end, and before they eventually shoot their way out of the predicament Mayfield actually tried to talk his way out by saying they needed to fill out some “TPS reports.” Perhaps that’s a real thing somewhere in the deep well of Star Wars lore, current canon or otherwise. And though it quickly earned a place in the fan-run Wookieepedia , a lot of sharp fans thought it was actually a reference to Mike Judge’s cult classic Office Space .

In the 1999 film starring Ron Livingston and Jennifer Aniston about committing financial crimes amid the mundanity of corporate life, the film’s protagonist, Peter Gibbons, is hounded by several bosses (including Gary Cole) about an office rule involving TPS reports. The scene is one of the film’s most famous, an example of how dreadfully dull and pedantic the modern workplace can often be. The phrase “TPS reports” has become one of the most enduring jokes from the film in the two decades since its release, which is why many fans were convinced it wasn’t a coincidence, but an Office Space reference, when Burr’s Mayfeld mentioned them.

That meant a lot of fans taking their thoughts, and Mandalorian / Office Space photo edits, to Twitter.

Certain foreign nationals physically present in the United States may apply for or renew Temporary Protected Status (TPS) with Form I-821, Application for Temporary Protected Status . The U.S. Department of Homeland Security may designate a county for Temporary Protected Status due to conditions in the country that may make it dangerous for that country’s nationals to return. During the designated temporary period, TPS beneficiaries receive certain benefits:

Authorized Stay in the United States

Employment authorization, travel outside the united states, eligibility to apply temporary protected status, who qualifies for form i-821.

Only certain individuals can meet the eligibility requirements for Temporary Protected Status. In general, you must be a national of a designated TPS country and be continuously physically present and continuously residing in the U.S. from specific dates set for each country.

  • Be a national of a country designated for TPS, or a person without nationality who last habitually resided in the designated country;
  • File during the open initial registration or re-registration period, or you meet the requirements for late initial filing during any extension of your country’s TPS designation;
  • Have been continuously physically present (CPP) in the United States since the effective date of the most recent designation date of your country; and
  • Have been continuously residing (CR) in the United States since the date specified for your country.

The law allows an exception to the continuous physical presence and continuous residence requirements for brief, casual and innocent departures from the United States. When you apply or re-register for TPS, you must inform USCIS of all absences from the United States since the CPP and CR dates. USCIS will determine whether the exception applies in your case.

You may NOT be eligible for TPS or to maintain your existing TPS if you:

  • Have been convicted of any felony or two or more misdemeanors committed in the United States;
  • Are found inadmissible as an immigrant under applicable grounds in INA section 212(a), including non-waivable criminal and security-related grounds;
  • Are subject to any of the mandatory bars to asylum. These include, but are not limited to, participating in the persecution of another individual or engaging in or inciting terrorist activity;
  • Fail to meet initial or late initial TPS registration requirements; or
  • If granted TPS, you fail to re-register for TPS, as required, without good cause.

The continuous physical presence requirement must be met for Temporary Protected Status eligibility. The requirement confirms that you have been physically present in the United States since the designated date for your country.

For example, the continuous physical presence date for Venezuela is March 9, 2021. Therefore, an applicant for initial TPS registration must have been physically present inside the United States since March 9, 2021.

When filing Form I-821, Application for Temporary Protected Status, you will also need to submit proof that you meet the requirement. Submit evidence that proves your date of entry into the U.S. was prior to the continuous physical presence date that the Department of Homeland Security designated your country for TPS. For detailed continuous physical presence (CRR) and continuous residence (CR) dates by country, visit the USCIS TPS page .

The continuous residence requirement must be met when filing Form I-821. While similar to continuous physical presence, it is a unique criteria for TPS eligibility. The requirement confirms that you have been residing (living) in the United States since the designated continuous residence date.

For example, the continuous residence date for Ukraine is April 11, 2022. Therefore, an applicant for initial TPS registration must have been living inside the United States since April 11, 2022. The person would not be eligible to file Form I-821 if he or she arrived in the U.S. after April 11th.

When filing Form I-821, Application for Temporary Protected Status, you will also need to submit proof that you meet the continuous residence requirement. The Department of Homeland Security designates a continuous residence date for each TPS country. Submit evidence that proves you began living in the United States prior to the continuous residence date and continue to live within the U.S. up until the present time. For detailed continuous physical presence (CRR) and continuous residence (CR) dates by country, visit the USCIS TPS page .

TPS Work Permit

Can i request employment authorization with form i-821.

As a TPS beneficiary, you may work in the United States, but only after your request and receive an Employment Authorization Document (also known as an EAD or work permit). The EAD allows will allow you to work while in the United States during the designated period. You’ll need to file Form I-765, Application for Employment Authorization , to request this benefit. You may file at the same time as filing Form I-821 or at a later date.

Typically, the EAD is valid for a period that matches the dates of your TPS protections.

TPS Travel Authorization

Can i travel outside the u.s. after filing form i-821.

You may travel outside the United States with Temporary Protected Status, but first you must obtain a special TPS travel document that is similar to Advance Parole . On July 1, 2022, USCIS stopped issuing Advance Parole to TPS beneficiaries and began issuing a new travel authorization document called Form I-512T, Authorization for Travel by a Noncitizen to the United States. Failure to obtain this travel authorization or return within the approved dates will likely result in the loss of TPS benefits.

To apply for TPS travel authorization, complete and file Form I-131, Application for Travel Document , with USCIS. Upon approval, you will receive Authorization for Travel by a Noncitizen to the United States. The document will allow you to travel abroad and to return to the U.S. within the time period for which you are authorized. This permit is often authorized for multiple reentries, but you can remain outside the U.S. for only a total of 90 days.

Travel authorization allows you to board a transportation carrier and seek lawful entry into the United States at a U.S. Port-of-Entry (POE). It does not guarantee that you will be allowed into the United States. U.S. Customs and Border Protection (CBP) will perform all the required inspection procedures, including determining admissibility or ability to enter, upon your arrival at a POE. Individuals who have any criminal record or past time in an unlawful immigration status should seek the advice of an immigration attorney before departing the U.S.

A complete Temporary Protected Application package should contain Form I-821, the USCIS, and all required supporting documents.

Form I-765, Application for Employment Authorization

Passport-style photos, identity and nationality evidence.

  • Passport showing your picture, name, and date of birth
  • Birth certificate accompanied by photo identification
  • A visa issued by a foreign consulate
  • Any national identity document from your country of origin bearing your photo and/or fingerprint

Evidence of Initial Date of Entry

  • I-94 Arrival/Departure Record

Continuous Residence Evidence

  • Employment records;
  • Rent receipts, utility bills, receipts or letters from companies;
  • School records from the schools that an applicant or their children have attended in the U.S.;
  • Hospital or medical records concerning treatment or hospitalization of you or your children; or
  • Attestations by church, union or other organization officials who know the applicant.

How long does it take to approve tps.

The processing time for a TPS application ranges from 10 to 18 months for most applicants. Form I-821 processing times are affected by several factors such as designated country, initial or re-registration, and service center. During this time, USCIS will adjudicate the request for Temporary Protected Status (Form I-821) and then process the application for employment authorization (Form I-765). When filing Form I-821, the total fee is dependent on a few different factors. Find a chart of the fee structures on the USCIS website . Please note there is an additional fee when filing Form I-765 for employment authorization and Form I-131 for travel authorization.

Each country that the U.S. Department of Homeland Security designates for Temporary Protected Status has its own registration period, which may be followed by a re-registration period. Any attempts file an I-821 application after these dates must be carefully handled as a late filing for TPS.

You can submit an initial application for TPS during an extension of your country’s TPS designation period. If you qualify for a late filing of your original TPS application, you must still independently meet all the TPS eligibility requirements.

USCIS may accept a late re-registration I-821 application if you have good cause for filing after the end of the re-registration period of your country. You must submit a letter that explains your reason for the late filing along with your Form I-821, Application for Temporary Protected Status. It’s important to understand that you may have gaps in your employment authorization if you file your TPS re-registration application late.

What Is a USCIS Cover Letter?

A cover letter is a document that helps USCIS officers navigate your application materials. You can place a cover letter at the top of your citizenship , permanent resident , DACA , or visa application package. By outlining your reasons for applying and the contents of your application in a cover letter, you give your USCIS officer a useful overview of your case. You can also use your cover letter as a personal checklist to make sure you’ve included all necessary documents in your package.

You may also use a cover letter to explain any special circumstances you want the USCIS officer to be aware of before they start reviewing your application. If you have a unique or complicated background, it is especially helpful to supplement your application with a cover letter. It will ensure that USCIS becomes aware of any special circumstances and can consider your application with this in mind.

Is a Cover Letter Required for My USCIS Application?

USCIS does not require you to submit a cover letter for any immigration benefit or visa application. Many immigration attorneys include cover letters for their clients to prevent any misunderstandings or missing paperwork. Immigration officers read through a lot of paperwork, so any guidance or organization you can offer them will be helpful. 

Cover letters may be especially helpful when you are in a unique situation. Suppose you are applying for a marriage green card with Form I-130 : Petition for Alien Relative, and you and your spouse have lived apart for some time. You and your U.S. citizen or green card holder spouse can use a cover letter to explain this or any other unusual circumstances behind your marriage. 

USCIS will want to know the reasons behind an unusual living or marriage situation when evaluating your adjustment of status application. A cover letter can help you address any major concerns at the beginning of the process.

What Should My USCIS Cover Letter Include?

When submitting a cover letter with your application, be sure to include the following:

The USCIS filing location or lockbox address to which you’re sending your application

The date of filing

An appropriate subject (re:) line

A short introductory paragraph to describe the contents of your letter and package

If applying for a marriage-related benefit, information about the marriage date and location for yourself (the beneficiary) and your spouse (the petitioner)

An ordered list of the content in your application package, including all supporting documents and filing or biometrics fees included

A closing paragraph including your contact information

Your signature and full printed name

Your supporting documents for an application will depend on which forms you’re filing. You can determine which documents are necessary by reviewing USCIS’ webpage for your specific form. For example, USCIS lists the required supporting evidence on its webpage for Form N-400 applicants.

You’ll also need to identify the right mailing address for your application. To do so, you should consult the USCIS website. For example, naturalization applicants can review USCIS’s webpage for Form N-400 direct filing addresses .

Your filing fees will depend on your specific application type. You can use the USCIS Fee Calculator to determine your costs. For example, suppose you are filing for naturalization with Form N-400. You should select Form N-400 on the Fee Calculator and enter your age. USCIS may ask for additional information, such as your specific application category.

Yes, most Green Card related filings require passport-style photos, or they are highly recommended. When in doubt, add them to the filing.

Are Copies of Documents ok?

Yes, copies of all documents are acceptable, as long as the copy is a nice color scan. The only time to provide original documents is when they are specifically requested by USCIS, and when submitting Certified Copies of Court, Police, and Prison Records.

Peter ( Ron Livingston ) spends his work-life staring at computer screens all day in a cubicle. He has great friends, like Jennifer Aniston , a waitress at Chotchkie’s , a generic beer-and-burger joint à la  Chili’s . And  Diedrich Bader (The Drew Carey Show) has a minor but hilarious part as Peter’s mustached, long-haired, drywall-installin’ neighbor.

But even Pete’s friends can’t save him from his job and boring daily routine. He goes home to an apartment sparsely furnished by IKEA and  Target . Then starts the day again with a maddening commute. His coworkers in the cubicle farm are annoying. His boss is a snide, patronizing jerk, and his days are consumed with tedium. In desperation, he turns to career hypnotherapy, but when his hypno-induced relaxation takes hold, there’s no shutting it off.

The company is having layoffs, and he plans to steal money from the accounts with two co-workers who are also losing their jobs. The scheme soon snowballs, however, throwing the three into a panic until the unexpected happens and saves the day.

Watching “Office Space” seems especially therapeutic after dealing with craziness at work. This probably explains the film’s broad appeal; it resonates with people who have needed to suffer bureaucratic B.S., the latest manifestations of “office speak,” and arbitrary rules at some point in their working lives. Of course, Judge himself drew upon his own memories of work in an office, which he finally escaped after hitting upon the idea for “Beavis and B*tt-head.” Although some people have criticized “Office Space” for not having enough “funny stuff,” they don’t seem to understand the subtlety of Judge’s humor, which leans towards the dry and sardonic. One could almost imagine Billy Wilder feeling at home with the plot, though he might have needed a little extra nudging to include the gangsta rap songs.
