How to write a cover letter for a rental application

In many of parts of Australia, there’s stiff competition for great rental properties. The cover letter that goes with the application is a way for prospective tenants to explain why they should get the rental above other applicants.

Essentially, a cover letter is a summary of all the key information and data provided in the application, showing why someone would be a good tenant – similar to the cover letter that accompanies an application for a job.

If an online portal like Ignite is used, there may not be a specific spot for a cover letter, but the advice for writing a good one applies equally to how tenants answer the all-important question: “Why is this property right for you?”.

What should a cover letter include?

Sofia Ligeros , leasing consultant with ACT-based Independent Property Group, said a cover letter should be addressed to the person who is handling the tenancy and include:

  • Information about the applicant
  • A bit about their hobbies
  • Working background and other personal information
  • Tenants should also explain why they’re moving and why they like the property, making sure to include the actual address of the property.

“You also need to show you have an understanding of your obligations as a tenant and why you believe you would make a great fit for their home,’ she said.

Ms Ligeros said photographs can be a great personal touch, too, helping the property manager put a face to a name.

Michelle Wilde , the principal of Queensland-based Stella Property, uses Ignite to handle applications, so doesn’t require cover letters. However, she said applications need to make it clear the would-be tenant can pay on time, are responsible and will look after the property. The biggest red flag for Ms Wilde is if a tenant has had an issue or dispute with a previous property manager.

Why is this property right for you?

Many application forms ask tenants to answer a simple question: Why is this property right for you? Whether it’s answered directly in a field online, as it is with Ignite , or through a cover letter, the vital response is vital.

Trish Mewett , a Jim’s Real Estate franchisor, said it’s a way for applicants to speak openly and honestly about why they want the property.

She said prospective tenants should explain how the property suits their life and speak with passion. “Home is where the heart is, so speak from the heart, but don’t overdo it so that it sounds unbelievable, as this may put managing agents off your application.”

It’s also smart to add some additional background details, such as your work, education and hobbies, to help flesh out the full picture of who an applicant is.

We are particularly interested in this property because of the nearby amenities, proximity to public transport and easy commute to both of our workplaces.

Each state and territory also has its own legislation regarding residential tenancies.

One way to obtain the best information — and weed out bad tenants — is for the landlord to attach a cover letter that explains the significance of the rental application.

Here are some tips for drafting the rental application cover letter:

Many property managers use a form letter or instruction sheet as a transmittal for the rental application. While this format looks official and sets a firm tone, using one of these forms is not always the most effective strategy.

Instruction sheets often are generic, with multiple check-off boxes. Not only is this confusing for the applicant, but it’s impersonal, which can discourage complete answers. Also, these forms can be intimidating. For instance, if the first line of the form is a list of all the personal documents the tenant must hand over, along with a demand for money, the applicant may become defensive. Purchasing a single-family rental home with a tenant already in place can be a good way to start generating rental income the day that escrow closes. 

However, when a tenant learns that their home has been sold, they may become anxious or even upset. In order to get off to a good start with the tenant, many new owners send the tenant a new landlord letter to give a tenant peace of mind and make a positive, lasting impression.

There are four main reasons for sending a letter introducing the new landlord to the current tenant:

  • Lay the groundwork for open lines of communication and a positive rapport with the tenant with the goal of renewing the lease with the tenant as the expiration date comes near.

Sometimes tenants become upset when a property changes hands. Even if the previous landlord notified the tenant that the property was being sold, a new landlord letter helps to reassure the tenant that there is no cause for concern.

Outline for a new landlord letter

A new landlord letter provides the opportunity to make a lasting first impression on the tenant. The general outline for a landlord letter may include:

Landlord introduction

In this section a new landlord can let the tenant know when the property sold, and how the new landlord is looking forward to having the tenant rent the home. 

If a landlord also owns other rental property, the beginning part of the letter can also be used to describe the landlord’s business to the tenant, in part to let the tenant know that the landlord is an experienced real estate investor .

Verify tenant & lease agreement information

The second part of a new landlord letter should review the tenant contact information and general terms and conditions of the lease. Include information currently on file such as:

  • Names of all tenants occupying the new property
  • Places of employment
  • Make/model and license plate numbers of vehicles driven by the tenant
  • Contact information for each tenant

Key points of the current tenant lease should also be reviewed in this section:

  • Monthly rent amount and due date
  • Additional rent such as pet or appliance rent
  • When a late fee will be assessed and in what amount
  • Expiration date of the lease
  • Amount of the tenant security deposit transferred to the new landlord when the home was sold

Instructions for paying rent

Thank the tenant in advance for paying the rent by the due date, and verify the amount of rent due and any late fees that may be assessed. Provide the tenant with a new mailing address for the monthly rent, along with information to sign up for any online rent payment system the new landlord is using.

Most rent payment services collect a small service fee from the tenant, then process the tenant rent payment and forward funds to the landlord’s business account within one or two business days. 

Describe to the tenant some of the advantages of paying the rent online , such as multiple payment options including debit from a checking account or using a credit card, and how on-time rent payments are reported to the credit bureaus to help improve the tenant’s credit score.

New landlord contact information

Share contact information with the tenant, including business name (if applicable) and mailing address, daytime and evening phone numbers, business email address, and website domain name if the real estate business has one.

Maintenance request procedures

Explain to the tenant how to make a request for maintenance or repairs, being sure to let the tenant know that it’s important to catch small issues before they become big and costly. 

Reiterate the tenant’s role in helping to keep the property in good condition, and remind the tenant about the schedule for routine interior and exterior inspections of the home so that they are not surprised when they receive notice of an upcoming property inspection.

Update tenant information

A new landlord letter can also include a form for the tenant to complete to update their most recent information. Information to ask for may include:

  • Full names of all tenants
  • Cell phone, work, and home phone numbers
  • Place of employment 
  • Email addresses
  • Names and ages of all occupants
  • List of all vehicles including make/model, color and license plate number
  • Pets including gender, age, and breed
  • Mailing address if other than the property address
  • Name, address, and phone number of an emergency contact for someone not living at the property

Schedule a property inspection

Sending a new landlord letter to a tenant can also provide the perfect opportunity to schedule an inspection of the inside and outside of the home (if not already completed while the property was in escrow). 

A property inspection allows the landlord to meet the tenant in person, to identify items in need of repair, and to remind the tenant of their responsibility to help maintain the property and keep the home clean. 

Many landlords also bring a copy of the move-in checklist completed when the tenant first moved into the home, to help identify normal wear and tear items versus any unusual damage caused by the tenant.

Get a credit report on yourself. No credit is better than bad credit so even a credit report with no history is of some value. Free credit reports are available at annualcreditreport.com . Many landlords and most professional property managers will want to use the credit reporting company they are accustomed to, but having one ready may get you through the “first cut.” Make note in your cover letter that you have one available but do not include it in the packet.

Many landlords who rent to students require a co-guarantor for the rent. Mention in your cover letter that you will provide one upon request and have the form filled out and ready to go, but only give to landlords seriously considering your application.

Being a landlord means you’ll have to communicate with your tenants frequently about a range of topics, from repairs to rent notices. While phone calls may be easier, you’re leaving yourself open to disputes unless you communicate in writing.

When you must communicate something serious to your tenants, like a pay or quit notice or lease termination notice, not only must it be written properly, but you must deliver it by the appropriate process outlined by your state .

Written documentation is critical when you are communicating with tenants about terminating a lease or starting the eviction process . State laws require these notices to be done in writing, with variations from state to state on the details of the process. Landlords can lose disputes in court simply for failing to follow their state’s laws that outline the landlord/tenant communication process.

It’s also in your best interest to keep written documentation of other types of communication besides notices, such as conversations about landlord repairs, notices to enter the rental property and follow ups on lease violations. If you end up with a tenant dispute that goes to court, such as over a repair or a security deposit, your written notices are evidence showing your side of the story. Written notices also confirm dates, times and situations that may be hard to remember several weeks, months or years after the fact.

In most states, there are three ways that you can officially leave written notice with a tenant.

1. Personal Delivery

You can hand the written communication to the tenant, either at the rental property or at the tenant’s workplace. Even if the tenant refuses to take the letter, you can leave it near him, such as on the front step or on his desk at work. Make a note of the delivery time and date on your copy of the notice

2. Substitute and Mail

You can leave the written communication with someone who lives with the tenant, such as another adult or an older teenager. Make a note of the deliver time and date on your copy of the notice, as well as the full name of who you left it with. That same day, you must send a copy via certified mail to the tenant’s address. Note the day on your copy.

3. Nail and Mail

If the previous methods don’t work, you can affix the written notice to the door of the property. That same day, send a copy via certified mail to the tenant’s address. Record all the steps on your copy of the notice.

Storing Tenant Notice Letters

If your written communication has to do with evictions, repairs, leases or disputes, it’s wise to keep copies in a folder in your office. Start a file for each one of your tenants and add to it as needed. You may never need the correspondence, but if you do, having written documentation of a tenant episode may just make things easier for you, in or out of court.

Lease renewal is optional in most cases, absent specific terms in the rental agreement. By default, a landlord can end a tenant’s lease at the end of its term, as long as the landlord follows state notice requirements.

When To Send a Lease Renewal Letter

Landlords often send a lease renewal letter far in advance of the lease’s end date. Tenants may take a long time deciding whether to renew. The landlord also has an interest in reserving enough time to find a new tenant in the event of non-renewal.

Some states additionally require a specific amount of advance notice, by law, regarding the option for lease renewal. This chart lists notice requirements, state by state:

If a lease renewal letter is not sent before the required state deadline, a current fixed-term lease upon expiration transitions into a month-to-month lease.

In states without an explicit timeframe, it’s still good practice to send a lease renewal letter well in advance of the lease’s expiration. Doing so provides the following benefits:

  • The tenant has time to make a decision about renewal.
  • Landlord and tenant can discuss and/or negotiate any new or changing terms.
  • The landlord has time to advertise and start screening for new tenants if the current tenant decides not to renew the lease.

Elements of a Lease Renewal Letter

A lease renewal letter normally includes the following information:

  • Landlord’s name and contact information.
  • Tenant’s name and contact information.
  • Rental property address, including the unit number.
  • Reference to current lease agreement (a copy is often included with the letter).
  • Due date for last rental payment.
  • Expiration date of existing lease.
  • New monthly rental amount.
  • Date and length of new lease.
  • Any terms for the new agreement that are new or changed from the original lease terms.
  • Tenant process for lease renewal.
  • Deadline for response.
  • Landlord’s signature.
  • Tenant’s acknowledgement.

Lease Agreement Renewal Terms

Some terms of the rental usually change when a lease gets renewed. Potential changes may include:

  • Raising the rent to reflect the current market. ( calculate rental rates here )
  • Lowering the rent to entice a tenant to stay.
  • Switch to a month-to-month lease (usually if property sale is a possibility).
  • Other change of terms to resolve issues that arose during the current lease.

Tenants for their part may also want to renegotiate the lease. A tenant may want to negotiate the following:

  • Rent price or security deposit.
  • Duration of the lease.
  • Policies or rules.
  • Renters’ insurance requirements.
  • Payment method(s).

While the landlord has final say on any proposals the tenant makes, there’s a pressure to renew by default since finding a good new tenant is often a lengthy and difficult process. Here are some methods and considerations landlords use to stay in a strong negotiating position:

  • Reviewing local rental markets to see what similar units charge.
  • Assessing seasonality and current rental demand.
  • Factoring the property owner’s financial situation (i.e., mortgage on rental property).
  • Potential concessions or amenities to offer the tenant.
  • The quality of the tenant and tenancy in general.

Sending a Lease Renewal Letter

Sending a lease renewal letter can be done by mail, in person or email. Each of these methods requires some care to ensure receipt and proper documentation:

  • Certified Mail: Restricted delivery is sometimes a consideration, since only the addressee (in this case, the tenant) can sign to receive it.
  • Email: Often sent with delivery and read receipts to document that the tenant received and opened the message.
  • In-person: Standard practice is to have the tenant acknowledge receipt with a signature.

After delivery, it’s common for landlords to keep a copy of the renewal letter filed with a notation of delivery method plus any other relevant information.

What if a Tenant Does Not Renew Their Lease?

Sometimes a tenant receives a lease renewal letter but decides not to renew. Documentation and notice are important in this situation. Rental best practice is for the tenant to produce a letter confirming non-renewal in writing, and for the landlord to give the tenant written notice about the lease’s end date.

The notice of end date usually includes specific instructions on what the tenant must do prior to moving out. These instructions vary depending on the specifics of the tenancy, but often include the following directions:

  • Remove all trash and personal items.
  • Thoroughly clean all appliances.
  • Repair any damage caused to the property by tenants and invitees.
  • Discontinue cable and phone services and other relevant utilities.
  • Return keys.

Whether you need to request repairs, complain about your neighbors, or make a simple request, writing a letter or email to your landlord can be beneficial in all kinds of different situations. 

In this article, we’ll walk you through some tips for writing your landlord and offer a series of sample templates you can use as guidelines for your own correspondence. 

Basic tips for crafting a successful letter or email

Any time you write a letter or email to your landlord, keep your language clear and concise to eliminate any potential for confusion. Include relevant details such as the date of writing, the dates of any instances referenced within the letter, and your contact information and unit number.

Depending on your reason for writing a letter, you may wish to cite the details of your lease or the tenant laws in your state. If your landlord is flaky, reminding him that you know your rights may be enough to spur him into taking action. 

To write or to email?  

Both posted letters and emails can be effective ways to communicate with your landlord, and in many ways they’re interchangeable. Email is faster, and allows you to keep a clear record of your communications. And it’s easy to keep multiple parties in the loop on one email conversation.

Mailing a letter can be a great way to reinforce your request or message, especially if your landlord has been unresponsive. Make sure to include your return address so your landlord has no excuse not to write you back.

Sample Templates

The following templates cover various common scenarios in which a letter to your landlord may be helpful or even required. Don’t be afraid to adjust your letter’s tone to best suit your relationship with your landlord.

Paying the rent late

A well-crafted letter explaining why your rent is late and offering solutions can be a powerful tool for staying on your landlord’s good side and lessening the penalties that typically accompany late payment. Use the following sample to craft a letter to your landlord regarding late rent payment.

[Date] Dear [Landlord’s Name], I’m writing to inform you that my rent payment will be late this month. I was recently laid off from my job and won’t be able to make the payment on time. I have applied for unemployment benefits, but it may take up to 2 weeks before I receive my first payment. I can pay $500 on the due date, and I will pay the remainder of the rent as soon as I receive my first unemployment check. I’ve also picked up some freelancing gigs and am actively interviewing for new jobs to avoid this problem next month. Please let me know if this payment plan will work for you. I understand that my late payment may have negative repercussions on your financial situation, and I’m very sorry for the inconvenience. I’m working diligently to ensure this never happens again. Best Regards, [Your Name]

Intention to vacate

When you decide to move out of your apartment, you must give notice to your landlord. Check your lease agreement to see how many days of advance notice you are obligated to provide. If you have a good relationship with your landlord, you may wish to give early notice so he has plenty of time to find new renters.

In the letter, you should state the date you plan to vacate and remind the landlord that you wish to have your security deposit returned. You can offer to do a walk-through to assess the condition of the unit. Don’t forget to share your forwarding address so your landlord can get in touch with you in the future, if necessary. 

You can use the template below to craft your letter.

[Date] Dear [Landlord’s Name] I am writing to inform you that I will be vacating my rental at [rental address] on [date you will move out]. I’m confident that you’ll find the unit in excellent condition. As such, please send my refundable security deposit in the amount of $________  to the following address: [Your forwarding address] If you wish to discuss this or schedule a walk-through of the unit, you can reach me at XXX-XXX-XXXX. Best Regards, [Your Name]

Request for Security Deposit

In some states, your landlord isn’t required to return your security deposit unless you request it. Each state has different rules stipulating how long your landlord has to return your deposit. 

The following was written in the context of California law. Make sure to adjust the following template to conform to the laws in your state.

[Date] Dear [Landlord’s Name] I wish to request that you return my security deposit in the amount of $________, which I paid for the rental at [rental address].  I expect to receive my deposit within 21 days, as stipulated by California state law. I vacated my rental on MM/DD/YYYY and thus expect to have my deposit returned no later than MM/DD/YYYY. Please send payment to the following address: [Your forwarding address] If you have any questions or concerns, you can reach me at XXX-XXX-XXXX. Best Regards, [Your Name]

Contesting deductions from your security deposit

As long as you leave your rental unit in the same condition in which you found it (minus normal wear and tear ),  you are entitled to have your full security deposit returned. If your landlord determines that you’ve caused property damage that warrants repair, they may deduct from your deposit to cover those expenses. Unfortunately, some landlords may try to pull one over on you by making deductions that are excessive or unfair.

If you disagree with your landlord’s deductions from your security deposit you can dispute them. Do so in writing so there’s a clear paper trail.

Use the following template to craft your letter.

[Date] Dear [Landlord’s Name] I am writing to formally contest the deductions you made from my security deposit for the rental at [rental address]. Your deduction of $ _____ based on the claim that I left my rental “excessively dirty” is unjustifiable. I hired a professional cleaning service to clean the unit before I vacated and oversaw the work myself. I am confident the unit was left in impeccable condition. You will find the receipt for the cleaning attached to this letter.  Please send the remainder of my deposit, totaling $_______ to the following address within 7 days. [Your forwarding address] If I do not receive the payment by MM/DD/YYYY I will pursue legal action. If you have any questions or concerns, you can reach me at XXX-XXX-XXXX. Best Regards, [Your Name]

Request for Repairs

When it comes to repairs on your rental, it’s wise to create a paper trail of your requests in case there are ever issues regarding maintenance in the future.

In your letter, state the date the issue began, describe the problem in detail, and outline a timeline for arranging repairs.

If you have already requested maintenance and the issue is ongoing or has yet to be repaired, writing a letter is a great way to follow up and remind your landlord that you are still expecting a resolution. Don’t be afraid to pressure your landlord by referencing state laws or the terms of your lease regarding maintenance.

The following is a template you can use for a standard maintenance request. 

[Date]  Dear [Landlord’s Name] I am writing to inform you that the bathroom sink in my rental unit located at [rental address] has been leaking into the vanity cabinet since [date the issue started]. I have been unable to fix the problem on my own and request that it be evaluated by a professional. I appreciate your arranging to have this repaired as soon as possible. I can make myself available to let a technician into the rental any day this week after 2 PM. Please let me know when the technician will be arriving. If you wish to discuss this issue further, you can reach me at XXX-XXX-XXXX.  Best Regards, [Your Name]

Following up on request for repairs

In some instances, you may contact your landlord over the phone to request repairs rather than writing a letter, especially if the issue is urgent. In this case, it’s wise to write a follow-up letter confirming what you discussed to ensure that there is a record of the problem.

Use the following template to craft your own follow-up letter.

[Date] Dear [Landlord’s Name], I am writing to follow-up on the repairs we discussed over the phone on [MM/DD/YYY] As you know, on [MM/DD/YYY], the faucet in the kitchen sink of my unit, #_______, began leaking.  I contacted a plumber and had the faucet replaced. The cost of the repair came to $123.75.  As we agreed, I would appreciate it if you could send a check reimbursing me for that amount within 10 days. Thanks for your assistance with this issue.  Best Regards, [Your Name]

Vacating your rental due to uninhabitable conditions

When your landlord fails to keep your rental in inhabitable condition, they are violating the terms of your lease. If you find yourself in this situation, you can break your lease agreement and move out early without penalty. 

In your letter, detail the issues that render the unit unfit. Collect as much evidence as you can to support your claims in case your landlord disputes the issue. If you can provide photos and documentation as well as a record of communication with your landlord regarding the problems, it will all be helpful if the issue is ever escalated. 

Here’s a sample letter you can send to your landlord in this situation. Adjust the tone of the letter to suit your relationship with your landlord. 

[Date] Dear [Landlord’s Name], I am writing to inform you that I will be vacating my rental at [rental address] on [move out date]. As you are aware, my lease doesn’t expire until [MM/DD/YYYY] but I will be moving out early due to ongoing maintenance issues that render the unit uninhabitable.  I have reported the presence of black mold in the bathroom multiple times, first on [MM/DD/YYYY] and again on [MM/DD/YYYY] and the issue has yet to be addressed.  As you know, pursuant to California Civil Code Section 1942 , I am entitled to break my lease and vacate the rental free of penalty because the mold is a health concern. As such, I expect that you will forward my damage deposit in the amount of $_____ to the following address by [MM/DD/YYYY]. [Your forwarding address] If you wish to discuss this you can reach me by phone at XXX-XXX-XXXX. Best Regards, [Your name]

Complaint about neighbors sample letter

If noisy neighbors are causing you to lose sleep at night, it may be worthwhile to have your landlord intervene. 

Ideally, a civil conversation will be all it takes to come to a resolution, but in extreme cases, having noise complaint letters on file might assist your landlord in building a case for eviction.

Before you draft the letter, review your lease agreement to see what it says about noise issues . It may be helpful to quote the language on your lease in your letter to your landlord.

Below is a noise complaint template letter to help you get started.

[Date]  Dear [Landlord’s Name] I am writing to make a formal complaint about noise from the tenants in unit #_______.  My lease states that building quiet hours are between 10 PM and 6 AM. However, these neighbors are consistently playing loud music well past midnight. The noise is impeding my ability to sleep and thus my ability to do my job.  I have spoken with these individuals three times this month on [MM/DD/YYYY], [MM/DD/YYYY], and [MM/DD/YYYY], but the issue is still ongoing. I would really appreciate it if you could speak with them regarding the noise. If we cannot resolve this situation I will be forced to begin looking for a new apartment. Thank you in advance for attending to this matter. Best Regards, [Your Name]

L.A. council member to seek more money to help tenants in Chinatown apartment building

The Los Angeles City Council voted Friday to spend nearly $15 million to spare many tenants of a Chinatown apartment building from major rent hikes, even as several of those residents demanded the city do more to erase their unpaid back rent.

On a 14-0 vote, the council agreed to use city funds to limit rent increases for the next 10 years at the Hillside Villa Apartments, where residents have been in a battle with their landlord since 2019, when previous restrictions on the building’s rents expired.

The agreement approved Friday would roll back rent hikes in many of Hillside Villa’s units. In addition, tenants with unpaid back rent would avoid eviction proceedings by signing an agreement promising to gradually repay the landlord over the next six years at 3% interest, according to the city’s report .

Tenant advocates and some residents of Hillside Villa denounced the deal, saying many cannot afford to pay. Residents in 48 of the building’s 124 units still owe a combined $1.4 million in back rent, according to Ann Sewill, who heads the city’s housing department.

For years, a major portion of the building’s tenants have participated in a rent strike, withholding payments in an effort to counter steep rent increases.

Some of those debts were erased in recent years by city and state COVID-19 relief funds. The tenant advocates said more help is needed.

Appearing before the council, one speaker said the repayment requirement would be a “death sentence” for the building’s low-income residents. Another called the agreement a “slap in the face.”

“We’re really, really dissatisfied with this deal,” said Rosasela Hernandez, a 17-year Hillside Villa resident. “We’re still at risk of being evicted.”

L.A. cuts tentative deal to provide $15 million to spare Chinatown tenants from steep rent hikes

The agreement, if approved, would keep many rents affordable inside Hillside Villa, but also scuttle efforts to have the city acquire the building.

Councilmember Eunisses Hernandez, whose district includes Chinatown, said this week that she had persuaded the owner to delay the start of the six-year repayment period by six months. She said she also intends to use $250,000 of her office’s discretionary funds to erase the first year of unpaid rent debt at Hillside Villa, a move that could delay the start of the repayment process until late 2025.

Hernandez said she is looking for other funding sources to cover the remaining back rent.

“We’re going to look under every rock and every opportunity and every pathway to try to find the resources to close that gap,” she said. “That’s inside this building, that’s outside of this building.”

Thomas Botz, managing member of 636 NHP, the company that owns the building, said the unpaid rent ranges from less than $5,000 for some households to nearly $91,000. After Friday’s vote, Botz praised Hernandez for working to find a resolution.

“I admire that she stands up for the tenants and is trying to be there for them,” he said. “She really went to bat for them.”

Housing officials reported last week that they had struck a deal with Botz to use city money to roll back rent for many Hillside Villa tenants to 2019 rates.

Hillside Villa had served for 30 years as affordable housing as part of an agreement with city officials. Those rent restrictions expired five years ago, prompting Botz to increase rents, in some cases doubling or tripling the amount.

Tenant activists responded by urging the council to purchase Hillside Villa using eminent domain , a process used by government agencies to acquire private property. Protesters went to city officials’ homes to demand they force a sale. In 2022, the council voted to begin an effort to purchase the building .

Sewill, whose home was picketed multiple times, eventually came out against that idea, saying the cost of acquiring the property from an unwilling seller, then fixing and refinancing it, would reach nearly $93 million, or $748,665 per unit.

Not every household in Hillside Villa will get city assistance. Seventeen of the building’s units are occupied by residents who are paying market rate. An additional 68 units already have been subsidized by Section 8 rental vouchers — although some of those tenants have also withheld rent, Botz said.

As part of the deal, Botz will have an additional 10 years to repay a $3.5-million redevelopment loan at 1% interest. A second, $1.85-million loan will eventually be forgiven, as long as the landlord adheres to the terms of his agreement with the city, housing officials said.

Landlords are wrongly making vulnerable tenants cover the costs of administering the government-run Centrepay debit system, in one case passing it on to a blind disability pensioner.

A Guardian Australia investigation has revealed multiple failings with Centrepay, a system allowing businesses early access to welfare payments, prior to money hitting a welfare recipient’s bank account.

The system, designed to ensure recipients budget for essentials such as electricity and rent, has seen hundreds of thousands of dollars wrongly diverted from vulnerable Australians to a major energy company, AGL , and used to help prop up a disgraced Christian rehabilitation centre practising gay conversion practices and forced baptisms.

Multiple tenants unions have warned that, in some cases, landlords and real estate agents are passing on the costs they are supposed to cover for administering the Centrepay system.

Services Australia, the government agency that administers welfare payments, charges businesses a 99c transaction fee for each of the more than 23m transactions made using Centrepay each year.

Businesses are warned they must not pass on that fee to customers.

In one case, however, the Julalikari Aboriginal Corporation was caught passing on the fee to vulnerable tenants in Tennant Creek by deducting it from their rental payments.

The two tenants, a then 53-year-old on the disability support pension and her husband, a disability support pensioner who was blind and mobility impaired, took Julalikari to the Northern Territory Civil and Administrative Tribunal on a range of issues. The tribunal found the fee should not have been taken out of their rental payments.

The Tenants’ Union New South Wales chief executive officer, Leo Patterson, said it was not an isolated case. He said his organisation sees tenants complain about the behaviour from “time to time”.

“We usually see it added on to the rent rather than taken out of the rent,” he said.

“Generally, [community housing providers] and public housing aren’t passing it on; the problems tend to be with real estate agents or landlords in the private market.”

Ben Cording, the lead community eduction lawyer at Tenants Victoria, said financial counsellors in his state also had seen the fee being passed on. The low fee meant individuals were unlikely to challenge it themselves, meaning the problem went unaddressed legally.

“Over the years, we’ve definitely seen real estate agents [passing it on]. And it goes to real estate training. They look at Centrepay, they’ve never dealt with it before, they say ‘That’s a dollar we shouldn’t pay, let’s pass it on’,” Cording said.

“It should be a pretty straightforward matter but you’ve got to find a client who’s prepared to go into the Victorian Civil and Administrative Tribunal and navigate that. That’s where justice is really tricky in terms of being accessible.”

Patterson said the rule was difficult to enforce because it was risky to challenge a landlord on it and was “more expensive to take it to the tribunal than cop it”.

“There needs to be better protection around rent charging practices generally; there’s lots of benefits to agencies in terms of time-savings from third-party payments, including for Centrepay, but this [fee] shouldn’t be passed on to renters,” he said.

Julalikari did not respond to requests for comment.

Services Australia said it accepts that improvements need to be made to Centrepay.

“This is why the agency has commenced priority work and consultation to reform Centrepay policy,” spokesperson Hank Jongen said.

“We’re committed to seeing this process through and will have more to say in the coming weeks.”

“Businesses are not permitted to pass on Centrepay transaction fees to customers, and we investigate any claims of businesses breaching this policy.”
