Read, 44, is charged with second-degree murder in the death of O’Keefe, who was found cold to the touch and unresponsive on Jan. 29, 2022, outside of a home in Canton.

Norfolk County prosecutors charged Read after his death and stated that she struck O’Keefe with her SUV while driving intoxicated. Read’s attorney, David Yannetti, said during the trial’s opening statements that her car never struck O’Keefe and that others are to blame for his death.

The trial is taking place in Dedham’s Norfolk County Superior Court.

On Monday, Brian Albert, a retired Boston police officer and homeowner of 34 Fairview Road, where O’Keefe was found unresponsive, testified about what happened on the night of Jan. 28, 2022.

Cross-examination of his daughter, Caitlin Albert, resumed on Tuesday morning.

Jurors heard from a witness on Tuesday who said she saw a “black blob” on the lawn of 34 Fairview as she left in the early hours of Jan. 29, 2022.

Here’s what we learned Tuesday about the testimonies of four witnesses.

Witness Julie Nagel describes birthday party at Canton home, says ‘I did notice something’ — 12 p.m.

Julie Nagel, the fourth witness to testify on Tuesday, described the party at the Canton home of her friend Brian Albert Jr.

“Everyone having fun, hanging out,” listening to music, drinking alcoholic seltzers, she said.

By 12:15 a.m. on Jan 29, 2022, Brian Albert Jr.’s parents arrived with family members, Jennifer and Matthew McCabe, and friend Brian Higgins. Jennifer McCabe is the sister-in-law of Brian Albert, the homeowner of 34 Fairview Road when O’Keefe’s body was found.

All were in the kitchen and dining room area, she said.

At one point, Brian Albert, the homeowner, took the family’s German Shepherd, Chloe, outside and brought her back upstairs.

Nagel said she could see the front door from where she was seated in the house.

She said she could see from within the house a black SUV that pulled up to the house before she went outside to speak with her brother, who was there to pick her up. The SUV left by the time she walked outside to speak with her brother.

The SUV was in front of the mailbox, stopped, and then pulled up near the flag pole, she said.

She spoke with her brother for less than three minutes, she said. Nagel said she decided to stay at the party and find another way home.

Matt McCabe and Jennifer McCabe offered to drive Nagel and her friend Sara Levinson home.

“I did notice something out of the ordinary, like a black blob in the ground by the flagpole,” she said when they got into the car and drove away.

“As the vehicle is going by the house, as you make the observation, what, if anything, did you say in the back seat of the car?” Adam Lally, the Norfolk prosecutor, asked.

“I did say out loud, I was like, ‘I think I might have saw something. I’m not kind of sure what it was.’ But I was also intoxicated, drinking, so didn’t really know what it was, what I saw,” Nagel said. “But Sara was like, ‘What, Julie?’ And I was like, ‘I don’t know what it was.’ And then that was kind of really it.”

It was about five to six feet long, she said.

O’Keefe’s body was later found near the flagpole on the front lawn of 34 Fairview Road around 6 a.m. that morning by Read and two other women.

Under cross-examination, Nagel said it wasn’t until eight months later that a police investigator spoke with her.

Nagel confirmed that she never saw the black SUV move backward.

David Yannetti, Read’s attorney, began to focus on a portion of testimony that Nagel gave under direct examination.

Nagel agreed she never told police investigators that the black object she saw was five or six feet long and Tuesday’s testimony was the first time she mentioned the length of the black object.

“Lally [Norfolk prosecutor] asked me how big it was so I just told him right now, yeah,” Nagel said.

Yannetti asked whether she thought it was a body as they passed by in the car, and she responded, “No.”

“At 1:45 a.m. and getting into the McCabe vehicle, and passing the Albert lawn, you did not think that you saw a person who was in trouble, correct?” Yannetti asked.

“Correct,” Nagel said. She added that she said it “out loud in the car” that she saw a black object on the front lawn.

“Is it your testimony now, that you said out loud in the car, ‘There’s a person who’s in trouble?’” Yannetti asked.

“That’s not what I said, no,” Nagel said. She agreed that she did not ask the driver to stop the car or check on the object.

“You didn’t see a body on that lawn?” Yannetti asked.

“I mean, I don’t know what I saw but I saw an object,” Nagel said.

“You told investigators that when Brian Albert Jr. called you the next morning and you found out about the tragedy the previous night, you quote ‘put two and two together,’ correct?” Yannetti asked.

“I did, yes,” Nagel said but admitted she did not call Canton police, state police, or the district attorney’s office about what she saw.

Testimony ended shortly after 1 p.m. Testimony in the Read trial will resume on Wednesday morning.

Third witness says they did not see O’Keefe on the lawn after 1 a.m. — 11:51 a.m.

Jurors returned at 11:24 a.m. for the cross-examination of Sara Levinson, a friend of Brian Albert Jr., the son of the homeowner of 34 Fairview Road when O’Keefe was found unresponsive.

Levinson and Brian Albert Jr. are close friends and went to the junior prom together, she agreed under questioning.

She said she arrived at 34 Fairview Road at about 8 p.m. and left close to 2 a.m. Snow began to stick on the ground and there wasn’t a lot of accumulation yet, she said.

She could still see the color of the pavement, but couldn’t remember whether she could still see the grass in the front yard.

David Yannetti, Read’s attonrey, handed her a transcript from an interview she had with a federal grand jury where she testified that she could “sort of” see grass as she left the house on Jan. 29, 2022.

She did not see a sneaker, a black hat, a 6-foot, 200-pound man on the front lawn, or 45 pieces of red plastic on the front lawn, she said.

“You did not hear somebody get hit in the back of the head with anything, correct?” Yannetti asked.

“Correct,” Levinson said.

Levinson left the stand at 11:49 a.m.

Sara Levinson, friend of Brian Albert Jr., describes the night of Jan. 28, 2022 — 10:58 a.m.

Sara Levinson recalled eating, drinking, and listening to music at the Albert house on the night of Jan. 28, 2022.

The following day was the birthday of Brian Albert Jr., the son of the homeowner of 34 Fairview Road.

Besides Levinson and Albert, another four people came to 34 Fairview Road, but most left before midnight.

“Everything was good, happy, everyone was celebrating,” Levinson said. “There were no issues.”

Levinson said Brian Albert, Brian Higgins, Nicole Albert, Caitlin Albert, Jennifer McCabe, and Matt McCabe all came in from The Waterfall Bar & Grille in Canton around 12:15 a.m.

Read and O’Keefe were drinking with them at the bar and received an open invitation to come back to 34 Fairview Road.

Colin Albert, the nephew of Brian Albert, arrived and left, but Levinson did not recall when. He was picked up, she said.

Levinson said she left around 1:30 a.m. to 2 a.m. She never heard of Read or O’Keefe prior to Jan. 29, 2022.

The judge called a recess at 10:58 a.m.

Caitlin Albert’s boyfriend Tristin Morris takes the stand — 10:25 a.m.

Tristin Morris has dated Caitlin Albert for roughly eight years. The couple lives together in Easton, he said.

On the morning of Jan. 29, 2022, Morris was scheduled to help plow snow from the storm that arrived overnight. He said he was on call from 3 a.m. to 4 a.m., ready to help plow if needed.

On cross-examination, David Yannetti, Read’s attorney, showed Morris a photograph of 12 people in Ned Devine’s, a pub in Boston, that included Morris and members of the Albert family. The photo was taken on June 5, 2022, according to Morris.

The photo was taken four days before Read’s arraignment, according to Yannetti.

Yannetti asked if they were “celebrating the indictment of Karen Read?”

The presiding judge allowed the question over the objection of Adam Lally, the Norfolk County prosecutor.

“No,” Morris said, shaking his head slightly and scratching the back of his head.

Morris testified that he picked up his girlfriend, Caitlin Albert, after midnight on Jan. 29, 2022. He said he waited less than 10 minutes for her to leave the house.

Morris said the first time an investigator spoke to him about the Read case was on May 7 — over a week after the trial began.

Plans changed in the early hours of Jan. 29, 2022, Morris said. He needed to make a trip from Easton to Canton a second time that night even though he needed to be ready to plow by 3 a.m., he agreed to under questioning.

Morris said he did not see a 6′2″ man on the front lawn, a black baseball hat, a black sneaker, or any pieces of red plastic.

“You saw nothing out of the ordinary, correct?” Yannetti said.

“Correct,” Morris said.

Asked by Lally why Caitlin Albert asked him to pick him up, Morris responded, “Because she is high maintenance, I didn’t really want to have to deal with it.” Members of the courtroom gave a chuckle.

“She said she didn’t want to get snowed in,” Morris said.

He left the stand at about 10:20 a.m.

The next witness was Sara Levinson, a friend of Brian Albert Jr. who was celebrating his birthday on Jan. 29, 2022.

Caitlin Albert says she saw nothing suspicious on parents’ lawn — 9:50 a.m.

Defense Attorney David Yannetti continued to probe the connections between Caitlin Albert, whose parents owned the home where John O’Keefe was found, and Canton firefighter Katie McLaughlin. The defense has attempted throughout the last two weeks to illustrate the ties between first responders and witnesses in the case.

Albert denied that she is close friends with McLaughlin but said they shared mutual friends and spent time in a group together on a weekend trip to Maine, at the beach and at college.

Yannetti then turned to the night of Jan. 28, 2022, when prosecutors allege Read hit O’Keefe with her car.

Albert said she did not see or hear the signs of a car crash, nor signs of O’Keefe’s body, as she left her parent’s home on 34 Fairview Road in Canton around 1:45 a.m. on Jan. 29.

“Against that white snow, did you see a black baseball cap?” Yannetti asked.

“I did not,” Albert responded.

“As you stepped out of the house, did you see a white sneaker?” Yannetti asked.

“I did not,” Albert said again.

“Did you see 45 pieces of red taillight plastic?”

“I did not.”

“Did you see one piece of red taillight plastic?”

“Did you see a 6-foot-2 man on your parents’ lawn in front of you? Yannetti asked.

Despite an objection from Assistant District Attorney Adam Lally, the judge instructed Albert to answer the question. She said she did not see a man on the lawn.

“You saw nothing unusual on that front law of your parents’ home, did you?” Yannetti asked.

“I did not,” Albert said.

She said she left the home when her boyfriend, Tristin Morris, arrived to pick her up. As the pair drove away, they passed by the entirety of the front lawn. Albert said she saw nothing suspicious outside the home, though she insisted she was not looking.

On re-examination from Lally, Albert said she did not recall whether the home’s outdoor lights were on as she left the home. As Morris drove away from the home, Albert said she was looking toward him, away from the lawn.

Testimony resumes from Caitlin Albert — 9:10 a.m.

Testimony has resumed in trial of Karen Read, the Mansfield woman charged with killing her boyfriend, Boston Police Office John O’Keefe.

On Monday, defense attorneys grilled Brian Albert, a retired Boston police officer and homeowner of the home at 34 Fairview Road in Canton where O’Keefe was found gravely injured the morning of Jan. 29, 2022.

Cross-examination of his daughter, Caitlin Albert, began Monday and resumed Tuesday morning. Albert attended high school with Katie McLaughlin, a Canton firefighter who testified last week, and the defense has zeroed in on their connection, aiming to highlight links between witnesses in the cases and first responders.

Karen Read murder trial Day 10 testimony featured tense cross-examination of Brian Albert

DEDHAM - The Karen Read murder trial resumed Monday with tense  cross-examination of Brian Albert , the owner of the Canton, Massachusetts home where Read's boyfriend, Boston police officer John O'Keefe was found dead in January 2022.

Albert, a former Boston Police officer, began testifying in Norfolk Superior Court in Dedham last Friday . He described O'Keefe as a friend, but admitted he did not know him well.

Read, 45, is charged with second-degree murder in the case. Prosecutors say she hit and killed O'Keefe with her SUV. Defense attorneys say Read is being framed and O'Keefe was killed during a fight inside Albert's home. Albert said O'Keefe never entered his home that night. 

Albert, who recently retired, was drinking with a group that included Read and O'Keefe at the Waterfall Bar & Grille in Canton on January 28, 2022.   

Brian Albert's cellphone

Defense attorney Alan Jackson, without the jury present, accused Albert of destroying cellphone data . Albert was given a preservation order for his cellphone use from January 28 to February 28, 2022.

According to Albert, he had upgraded his cellphone before learning of the order.

After questioning without the jury present, jurors returned to the room and Jackson questioned Albert about what happened to his cellphone data.

Albert said he got a new phone around September 22, 2022, and the preservation was ordered on September 23, 2022.

"So according to you, you got rid of the phone that was the subject of a court-ordered preservation the day before it was ordered preserved? Right?" Jackson asked.

"September 4 was my birthday. The phone was broken and failing. I had planned on getting a new phone and that just happened to be the day I got it," Albert said.

Phone calls the night John O'Keefe died

Jackson showed Albert surveillance video from the Waterfall bar that appears to show him and ATF agent Brian Higgins play-fighting. 

Albert said the two were "fooling around," but Jackson has attempted to show that they were practicing fighting techniques.

Records show Albert and Higgins later exchanged calls around 2 a.m. on January 29, 2022. Albert said he "inadvertently" called Higgins, calling it a "butt dial." Higgins called Albert back, but Albert testified the two never spoke.

"That next morning, while everything was going on, I mentioned to Brian 'I may have butt-dialed you last night. Sorry about that,'" Albert testified.

"Did you two both agree to say that those were butt dials in order to cover up those calls?" Jackson asked, to which Albert replied, "We did not say that."

Cross-examination of Brian Albert

Several members of the group from Waterfall returned to Albert's Fairview Road home after leaving the bar. O'Keefe's body was found hours later on Albert's lawn. Read's attorneys argue that O'Keefe was killed during a fight inside the home, then dragged outside.

On Monday, Jackson peppered Albert with questions.

Jackson read a transcript from previous grand jury testimony Albert gave, when he said "I've never met or seen [Karen Read] before. Maybe once, but I've never had a conversation with her I don't think." Jackson said the statement was not true, because they had previously met. 

Jackson displayed a photo of Albert, O'Keefe and two others that was taken the week before O'Keefe's death. According to Jackson, Read took the photo.

Albert testified that the night at Waterfall in Canton, he did not talk to Read. Jackson played surveillance video that he said shows Albert talking to Read.

Jackson asked Albert if he was trying to "distance" himself from the fact that he knew O'Keefe and Read during his grand jury testimony. 

"Mr. Albert, you knew if you had a relationship with John O'Keefe or Karen Read, you knew you'd have a lot to answer for when his body ended up dead on your lawn six days later?" Jackson asked, to which the prosecution objected.

Jackson showed a video from Albert's backyard and asked if it was possible to move a large heavy object out of the basement and not bring it through the house. Albert answered yes. "There is a bulkhead door you can use," he said.

Brian Albert says Read, O'Keefe never entered home

On Friday, Albert first took the witness stand and testified about the night of O'Keefe's death. He said Read and O'Keefe never entered his home that night.

During cross-examination, Jackson asked Albert if O'Keefe came into the house. He said no, something he reiterated when cross-examination continued on Monday.

"John never came into my house that night. He would've been welcomed. And the defendant would've been welcomed if she had come," Albert said. "I wish they had come over that night, they would've been welcomed with open arms. I really do."  

Jackson asked Albert why he never went outside after seeing the police activity the morning O'Keefe died. Albert said he never noticed anything was happening until after O'Keefe's body had been taken from the scene to the hospital.

"At that time, there was no victim outside my house. There was no one who needed first aid. There was nothing I could do," Albert said.

Months after O'Keefe's death, Albert sold the home. He testified on Friday that the sale was not because of O'Keefe's death.

Who was inside Brian Albert's home?

Albert was questioned on who was inside his home the night O'Keefe died.

Specifically, Jackson asked Albert why he and his wife both left out their nephew, Colin Albert from the list.  

"Did both of you conveniently forget that Colin had been there?" Jackson asked. Albert said he did not mention Colin Albert because he left shortly after he returned home from Waterfall.

Brian Albert Jr. testifies he saw dark-colored SUV

Next on the stand was Brian Albert Jr., Brian Albert's son. He was the first witness who has testified to seeing a dark SUV outside 34 Fairview the night O'Keefe died. 

"There was another car that I didn't, I hadn't recognized before. It was a dark SUV," Brian Albert Jr. said. 

Albert said he was sitting at the family dining room table and looked out the window. He said he saw the SUV near the mailbox, then later looked again and it was closer to the flagpole with the passenger side towards the house.

Read was driving a black Lexus SUV at the time of O'Keefe's death.

Albert Jr. said he saw tire tracks in the snow. The defense pushed the 25-year-old about his vision.

"So you'd agree that visibility in front of the house was good enough that you could see tire tracks? But you did not see a 220-pound man lying in the snow in your front yard?" defense attorney Elizabeth Little asked. Albert Jr. said he did not.

Previous witness accused of perjury

Brian Albert's daughter, Caitlin Albert, took the stand after her father and brother. She testified that O'Keefe and Read never entered the Fairview Road home the night of his death.

The defense questioned Caitlin Albert about her relationship with Canton firefighter-paramedic Katie McLaughlin. "I can't think of a time possibly ever where her and I ever hung out one on one or individually," Caitlin Albert said.

Court ended for the day with Caitlin Albert still on the stand. She was dismissed for the day and cross-examination will resume on Tuesday.

After jurors left the room, Judge Beverly Cannone heard arguments from each side about prior testimony of McLaughlin .

While on the stand earlier in the trial, McLaughlin said she heard Read repeatedly say "I hit him" when she was on scene after O'Keefe's body was found. Yannetti argued Monday that McLaughlin changed her story "once she realized this was the Albert family."  

Defense attorney David Yannetti argued that McLaughlin committed perjury when she described herself as an acquaintance, not a friend, of Caitlin Albert.

Yannetti said he received a "deluge" of photographs following McLaughlin's testimony. Read's attorneys argue the photos show McLaughlin and Caitlin Albert are friends.

Prosecutor Adam Lally said Yannetti is being "intentionally vague" about where he got the photographs from. Lally also said Yannetti was mischaracterizing the testimony about what Read was heard saying at the scene.

Cannone did not rule on the issue Monday. She said she will look over her notes and decide on Tuesday.

Who is Karen Read?

Prosecutors said Read dropped O'Keefe off at Albert's home after a night of drinking in January 2022 and hit him with her SUV as she drove away, leaving him for dead in a snowstorm. In addition to second-degree murder, Read is also charged with manslaughter while operating under the influence of alcohol, and leaving the scene of personal injury and death.

Read has pleaded not guilty to all of the charges.

SWLA (KPLC) - In 1962, former U.S. President John F. Kennedy declared May 15 Peace Officers Memorial Day and the week it falls in Police Week.

It’s a time for agencies and citizens all over the United States to honor police officers.

The Lake Charles and Sulphur police departments held their memorials Monday.

“It’s a double-edged sword. It’s always a tremendous loss, and a loss for the families and a loss for those departments who unfortunately have to go through that, but it’s a time to honor them and to embrace their memories,” Lake Charles Chief Shawn Caldwell said.

According to the National Law Enforcement Officer’s Memorial Fund , 118 officers died in the line of duty in 2023.

Eight of those were here in Louisiana.

Sulphur Police Chief John Wall recalled a terrifying moment in August when he thought he may have lost an officer while on duty.

“We had an officer-involved shooting last August that was a significant gun battle. One of our officers did get hit, but they made a full recovery and were able to make it back shortly after. That was tough, especially not being there and hearing it over the radio and over the phone,” Wall said.

Chief Wall said that although this a difficult week to reflect on for them, he’s glad to be a part of such a courageous field.

“Officers that gave the ultimate sacrifice, which is their lives. Taking this job we all know that it can happen any day, and we hope it doesn’t, we train to make sure that doesn’t happen, but if it’s our time there’s not much we can do about that,” Wall said.
