Why has a UN body withheld accreditation to India’s NHRC?

What are the paris principles and the global alliance of national human rights institutions how does not having ganhri accreditation affect the national human rights commission.

For the second year in a row, an organisation affiliated with the UN human rights office has deferred accreditation for India’s human rights body, the National Human Rights Commission (NHRC).

Without accreditation from the Geneva-based Global Alliance of National Human Rights Institutions (GANHRI), NHRC cannot represent India or vote at the UN Human Rights Council (formerly United Nations Commission on Human Rights).

The delay in accreditation can also been cited to raise questions about the independence, competence, and fairness of the NHRC. The NHRC, which was established on October 12, 1993 after Parliament enacted the Protection of Human Rights Act (PHRA), is currently chaired by former Supreme Court judge Arun Mishra.

What is the accrediting agency?

GANHRI, which represents about 120 national human rights institutions, is responsible for reviewing and accrediting these institutions in compliance with the Paris Principles every five years.

GANHRI acts through its Subcommittee on Accreditation (SCA), which categorises member NHRIs into two groups, ‘A’ and ‘B’. As of November 29, 2023, 120 NHRIs were accredited by GANHRI, 88 of which were given ‘A’ rank, indicating full compliance with the Paris Principles; the remaining 32 were put under ‘B’, indicating partial compliance.

And what are the Paris Principles?

The Paris Principles, formally Principles Relating to the Status of National Human Rights Institutions, which were adopted by the UN General Assembly on December 20, 1993, set out minimum standards that NHRIs must meet in order to be considered credible and to operate effectively.

The Paris Principles lay down six main criteria to determine which NHRIs are functioning effectively, and would receive accreditation from GANHRI.

They are (i) broad mandate based on universal human rights norms and standards; (ii) autonomy from the government; (iii) independence guaranteed by the statute or Constitution; (iv) pluralism, including membership that broadly reflects their society; (v) adequate resources; and (vi) adequate powers of investigation.

These Principles also say that NHRIs should be equipped to receive complaints and cases brought by individuals, third parties, NGOs, trade unions, or other organisations representative of professionals such as lawyers and journalists.

What happens if India loses accreditation?

NHRIs with ‘A’ status can participate in the UN Human Rights Council, its subsidiary bodies, and some UNGA bodies and mechanisms. They are also eligible for full membership of GANHRI, which includes the right to vote and hold governance positions.

NHRIs accredited with ‘B’ status can participate in GANHRI meetings, but cannot vote nor hold governance positions.

Unless India is accredited, the NHRC can’t represent the country at the UN Human Rights Council, or vote or hold governance positions. India’s review has been deferred, with no final decision yet.

Why has India’s accreditation been put on hold?

The decision was taken after an SCA meeting held on May 1 at the United Nations Palais des Nations in Geneva. The SCA has such sessions twice a year, and receives detailed briefings on each country. Subsequently, a pre-session is held to ascertain issues for consideration, followed by an interview with each country’s human rights institution.

The May 1 meeting was chaired by New Zealand. South Africa, Sri Lanka, and Spain were among the countries that participated.

The committee is yet to release its report. However, last year’s report listed the areas where the NHRC was seen as not properly adhering to the Paris Principles. These included a lack of transparency in NHRC appointments, conflict of interest caused by the appointment of police to oversee investigations, and no minority or female representation on the panel.

Also, on March 26, nine human rights organisations, including Amnesty International and Human Rights Watch, jointly wrote to GANHRI expressing concern about India’s human rights institutions. “…The United Nations High Commissioner for Human Rights, Volker Türk, [has] raised concerns about the increasing restrictions on the civic space and discrimination against minorities in India ahead of the country’s General Elections,” the letter said. These concerns were also raised by UN human rights experts who drew attention to “attacks on minorities, media and civil society” in India, it said.

The letter urged GANHRI-SCA to amend the current ‘A’ rating of the NHRC.

What is India’s record of accreditation with GANHRI?

The NHRC was established in 1993, and was accredited for the first time in 1999. It got ‘A’ rank in 2006, and retained it in 2011. In 2016, accreditation was deferred due to reasons that included the appointment of political representatives, and the failure to ensure gender balance and pluralism in NHRC staff, but the SCA ultimately gave NHRC ‘A’ status in 2017.

Last year, the SCA withheld India’s accreditation again, and gave six reasons for it, including that the NHRC couldn’t create conditions for operating without government interference, that there were too many government officials and individuals affiliated with the ruling party in the NHRC.

The panel comprised experts in international humanitarian law and international criminal law, and two of its members are former judges at criminal tribunals in The Hague, where the ICC is based, Amal Clooney wrote. The panel also published an op-ed about its recommendation in the Financial Times on Monday.

As a leading barrister in international human rights law, Amal Clooney is ranked in the legal directories Legal 500 and Chambers and Partners and is described as a 'first-class international lawyer, a 'natural lead advocate' and a 'rare combination of intellectual depth and pragmatism', according to the Columbia Law School. She represents victims of mass atrocities, including genocide and sexual violence, and has acted in landmark human rights cases, including the ISIS attacks and the Russia-Ukraine war.

Amal Clooney is an Adjunct Professor at Columbia Law School and a Senior Fellow at the Columbia Law School Human Rights Institute. Prior to joining the London Bar, she completed a clerkship in The Hague at the International Court of Justice and worked as a prosecutor at the International Criminal Tribunal for the Former Yugoslavia and the Special Tribunal for Lebanon. She is currently admitted to the New York Bar and practiced as a litigation attorney at Sullivan & Cromwell LLP there.

She had earlier sparked criticism for not speaking publicly about the Israel-Hamas war, which has killed 35,000 people in Gaza. Khan, thanked Clooney in his statement announcing the move, describing her as part of “a panel of experts in international law” whom he had turned to for advice and to review the evidence in the case. Many of the named experts are British, according to the Guardian.

What did the ICC say about Israel and Hamas?

Monday's announcement marks the first time the ICC prosecutor sought to intervene in the escalating conflict in the Middle East, heightened by Israel's ongoing operations in the southern city of Rafah, where over a million Palestinians have taken refuge from the war. Khan said, "Israel, like all States, has a right to take action to defend its population. That right, however, does not absolve Israel or any state of its obligation to comply with international humanitarian law."

He also said crimes against humanity allegedly carried out by Israel were part of "a widespread and systematic attack against the Palestinian civilian population pursuant to State policy." His office collected evidence that showed Israel systematically depriving civilians of "objects indispensable to human survival" like food, water, medicine and energy, he said, adding that Netanyahu and Gallant bore responsibility for willfully causing great suffering and committing war crimes.

On the other hand, the Hamas leaders face allegations of bearing responsibility for crimes committed by Hamas including extermination and murder, the taking of hostages, torture, rape and other acts of sexual violence. Khan said Hamas leaders gunned down several people at a dance party and killed entire families, adding that he himself witnessed "devastating scenes of these attacks and the profound impact of the unconscionable crimes".

"There is no doubt that the step taken today by the prosecutor is a milestone in the history of international criminal law. There is no conflict that should be excluded from the reach of the law; no child’s life valued less than another’s. The law we apply is humanity’s law, not the law of any given side. It must protect all the victims of this conflict; and all civilians in conflicts to come," wrote the panel including Clooney in the op-ed in Financial Times.

Can the ICC arrest someone?

Karim Khan's request will now go to a pre-trial chamber consisting of three judges. If the judges agree with Khan on "reasonable grounds" of alleged war crimes, they will issue an arrest warrant naming the person and the specific crimes for which the warrant has been sought. This process can take several months and the warrants can be amended later.

The founding Rome Statute of the ICC obliges all 124 signatory states to arrest and hand over any individual subject to an arrest warrant if they set foot on their territory. However, the court has no means to enforce an arrest, although member states ignoring the arrest calls can be sanctioned. However, an ICC warrant against Netanyahu is expected to dent his international standing and could strengthen legal challenges such as an arms embargo on Israel.

The ICC is the permanent court of last resort, established in 2002 to prosecute individuals for war crimes, crimes against humanity, genocide and the crime of aggression. Several countries don't accept the court's jurisdiction, including the United States, China and Russia.

Amal Clooney is one of the legal experts who recommended that the chief prosecutor of the world's top war crimes court seek arrest warrants for Israeli Prime Minister Benjamin Netanyahu and leaders of the militant Hamas group.

The human rights lawyer and wife of actor George Clooney wrote of her participation in a letter posted Monday on the website of the couple's Clooney Foundation for Justice. She said she and other experts in international law unanimously agreed to recommend that International Criminal Court chief prosecutor Karim Khan seek the warrants.

Khan announced his intention to do so on Monday, saying that actions taken by both Israeli leaders and Hamas in the seven-month war in Gaza amounted to war crimes.

“I served on this Panel because I believe in the rule of law and the need to protect civilian lives,” Clooney wrote. “The law that protects civilians in war was developed more than 100 years ago and it applies in every country in the world regardless of the reasons for a conflict.”

The panel comprised experts in international humanitarian law and international criminal law, and two of its members are former judges at criminal tribunals in The Hague, where the ICC is based, Clooney wrote. She added that their decision was unanimous. The panel also published an op-ed about its recommendation in the Financial Times on Monday.

A panel of three judges at the ICC will decide whether to issue the arrest warrants and allow a case to proceed. The judges typically take two months to make such decisions.

In his announcement Monday, Khan accused Netanyahu, Israeli Defense Minister Yoav Gallant and three Hamas leaders — Yehia Sinwar, Mohammed Deif and Ismail Haniyeh — of war crimes and crimes against humanity in the Gaza Strip and Israel.

Netanyahu and other Israeli leaders condemned the move as disgraceful and antisemitic. U.S. President Joe Biden also lambasted the prosecutor and supported Israel’s right to defend itself against Hamas.

Israel is not a member of the court, so even if the arrest warrants are issued, Netanyahu and Gallant do not face any immediate risk of prosecution. But the threat of arrest could make it difficult for the Israeli leaders to travel abroad. Hamas is already considered an international terrorist group by the West.

The latest war between Israel and Hamas began on Oct. 7, when militants from Gaza crossed into Israel and killed about 1,200 people, mostly civilians, and took 250 others hostage.

Since then, Israel has waged a brutal campaign to dismantle Hamas in Gaza. More than 35,000 Palestinians have been killed in the fighting, at least half of them women and children, according to the latest estimates by Gaza health officials, who do not distinguish between civilians and Hamas militants.
