20 socio-legal research topics India – India is a country with a complex and diverse social and legal landscape, and there are many research topics that could be explored at the intersection of these two areas. Here are 20 potential socio-legal research topics for India:
- Caste-based discrimination : Despite the abolition of untouchability and the caste system in India, discrimination based on caste continues to be a major issue. Research could explore the extent and nature of this discrimination and potential legal solutions.

About the Event
Family law plays a crucial role in nearly every aspect of our lives. The past few decades have witnessed myriad changes in the realm of family law in India. These changes have been triggered by transitioning notions of equality, liberty, and justice. Stakeholders from various strata of the societal edifice have identified and advocated the need to address these concerns. Currently, family as a concept is no longer confined to blood relations and has expanded to include adoption, surrogacy, and alternative family structures such as the hijra communities or even polycules. Marriage is no longer restricted to cisgender; heterosexual couples and the queer rights movement is fighting a two-fold battle to include queer persons within the scope of individuals eligible to get married while simultaneously challenging the institution of marriage itself. This warrants an urgent conversation on how family law can be reimagined to not merely accommodate diversity but fulfil the needs and secure the rights of the individuals and communities it is applicable to.
The National Law University, Jodhpur is organizing a two-day National Seminar on: “Revisiting the Current Regime of Family Law in India”. This seminar strives to revisit the family law of India to complement critical gender theory, social and economic justice while simultaneously keeping it grounded within constitutional theory and a rights-oriented framework. We hope to engage with and contribute to contemporary family law scholarship by facilitating academic discussions with emerging scholars, lawyers, and academics. The Seminar shall be held over a period of two days where esteemed speakers shall be deliberating on the key issues pertaining to the contemporary challenges the family law regime in India faces.
Seminar Structure
This seminar shall be conducted over a period of 2 days through an online platform, i.e., Cisco Webex.
Day 1: The seminar shall commence with a keynote address by the Hon’ble Vice Chancellor and the Guest of Honour. This would be followed by the parallel sessions of paper presentations chaired by the esteemed panelists. The day would end with a panel discussion.
Day 2: Paper presentations will continue, followed by a panel discussion. The seminar will conclude with a keynote address by the Guest of Honour followed by the vote of thanks.

Scheme for Action Research and Studies on Judicial Reforms

A Plan Scheme for Action Research and Studies on Judicial Reforms is being implemented by the National Mission for Justice Delivery and Legal Reforms since 2013. Under the Scheme, financial assistance is being extended for undertaking action research / evaluation / monitoring studies, organizing seminars / conferences / workshops, capacity building for research and monitoring activities, publication of report/material, promotion of innovative programmes / activities in the areas of Justice Delivery, Legal Research and Judicial Reforms. From the financial year 2021-22 onwards, the Scheme was incorporated under the “non-scheme” component of Department of Justice.
Reputed institutions working in the field of justice delivery, legal education and research and judicial reforms may apply as per the Scheme guidelines. The Guidelines prescribed format and other details about the Scheme for Action Research and Studies on Judicial Reforms can be accessed below :
Scope of Scheme
– A Plan Scheme for Action Research and Studies on Judicial Reforms is being implemented by the National Mission for Justice Delivery and Legal Reforms since 2013. Under the Scheme, financial assistance is being extended for undertaking action research / evaluation / monitoring studies, organizing seminars / conferences / workshops, capacity building for research and monitoring activities, publication of report/material, promotion of innovative programmes / activities in the areas of Justice Delivery, Legal Research and Judicial Reforms. From the financial year 2021-22 onwards, the Scheme was incorporated under the “non-scheme” component of Department of Justice.
Eligible Implementing Authorities
– The eligible implementing authorities for the Scheme are Indian Institute of Public Administration (IIPA), Administrative Staff College of India (ASCI), Indian Institute(s) of Management (IIMs), Indian Law Institute (ILI), National Law Universities (NLUs), National Council of Applied Economic Research (NCAER), National Judicial Academy (NJA), State Judicial Academies (SJAs) and other reputed institutions working in the field of justice delivery, legal education and research and judicial reforms.

– Under the Scheme for Action Research and Studies on Judicial Reforms, financial assistance shall be extended for undertaking action research/evaluation/monitoring studies, organizing seminars/conferences/workshops, capacity building for research and monitoring activities, publication of report/ material, promotion of innovative programmes/activities in the areas of Justice Delivery, Legal Research and Judicial Reforms.
Objectives:
The objectives of the scheme are to promote research and studies on the issues related to the National Mission for Justice Delivery and Legal Reforms being implemented by the Department of Justice.
Projects/Activities eligible for financial assistance:
Financial assistance shall be given to the eligible implementing agencies by the Department of Justice for the following projects/activities in the fields of Justice Delivery, Legal Research and Judicial Reforms:
- To undertake action research I evaluation studies.
- To organise seminars I workshops/ conferences.
- To undertake capacity building activity for research and monitoring activities.
- To undertake publication of report/material.
- To undertake promotion of innovative programmes/activities.
- To undertake any other project/activity for the promotion of issues related to the National Mission to be decided by the Project Sanctioning Committee.
Eligible Implementing agencies
Indian Institute of Public Administration, Administrative Staff College of India, Indian lnstitute/s of Management, Indian Law Institute, National Law Universities, National Council of Applied Economic Research, National Judicial Academy, State Judicial Academies and other reputed institutions working in the field of justice delivery, legal education and research and judicial reforms.
The Project Sanctioning Committee shall be empowered to allow any Government or Government aided Institute/Organisation as eligible implementing agency, if found suitable for undertaking project/activity permissible under the scheme.
Pattern of Assistance
Financial assistance shall be given, on agreed terms and conditions, to the eligible implementing agency on the basis of Project Proposal submitted by such agency indicating the project cost.
The financial assistance may be given in instalments and at least 10% of the project cost may be kept for payment as final instalment on acceptance of the final project report by the National Mission for Justice Delivery and Legal Reforms, Department of Justice.
The financial assistance would be limited to actual expenditure incurred by the grantee institution, subject to overall ceiling of Rs.25.00 lakhs.ln exceptional cases, however, where the scope of the Project is sufficiently wide, sample size is large and Project is for longer duration, the Project Sanctioning Committee may relax this ceiling.
Project Proposal
The project proposal shall be invited by the National Mission for Justice Delivery and Legal Reforms, Department of Justice from the selected implementing agencies for identified subjects which shall include following informationas terms and conditions of the project:
- Title of the project
- Name of the implementing agency
- Details of Principal Coordinator (Name, Designation and Research Experience)
- Methodology
- Duration (with specific timelines for initiation of project, submission of interim progress report, presentation before submission of final report and submission of final report)
- Project cost with detailed break up:
Project Sanctioning Committee
All project proposals shall be placed before the Project Sanctioning Committee for consideration and approval. The composition of the Project Sanctioning Committee shall be asunder:
Secretary, Department of Justice – Chairman Additional Secretary & Financial Advisor, DoJ – Member Secretary General, Supreme Court – Member Joint Secretary and Mission Director, DoJ – Member Joint Secretary, Law Commission of India – Member Director, lndian Law Institute – Member Director, National Judicial Academy – Member Director/Deputy Secretary (National Mission), DoJ – Member Secretary
While considering the proposals from Indian Law Institute (ILI) and National Judicial Academy (NJA) , the Directorsof the concerned Institute / Academy shall recuse from deliberations of Project Sanctioning Committee in respect of their proposals.
Procedure for Approval of the Project
The invited Proposals from the selected institutes/organisations on the identified subjects shall be placed before Project Sanctioning Committee for consideration and approval. The decision of Project Sanctioning Committee shall be final and binding. The approved Project Proposals shall then be submitted to the Integrated Finance Division of Ministry of Law and Justice for approving the project/s and release of funds. Each instalment shall be released on the approval of IntegratedFinance Division.
Utilisation Certificate
The implementing agency shall be required to submit Utilisation Certificate, as prescribed by the Department of Justice, for the funds received from the Department of Justice for undertaking the project.
Dispute Redressal
Any dispute relating to any project shall be decided by the Secretary(Justice) and MissionLeader, National Mission for Justice Delivery and Legal Reforms, Department of Justice, which shall be binding on the implementing agency.

1. Three New Criminal Law Enacted Replacing IPC, CRPC And Evidence
On 25th December 2023, three newly passed criminal law bills received the President's assent. These bills include the Bharatiya Nyaya (Second) Sanhita, aiming to substitute the Indian Penal Code, the Bharatiya Nagarik Suraksha (Second) Sanhita, seeking to replace the Code of Criminal Procedure, and the Bharatiya Sakshya (Second) Sanhita, intending to supplant the Indian Evidence Act. These bills received clearance from the Lok Sabha on December 20th and from the Rajya Sabha on December 21st.

2. Supreme Court’s Verdict on Repealing of Article 370 from Jammu and Kashmir
On 11th December 2023, the Supreme Court gave its final verdict on the repeal of Article 370 from the state of Jammu and Kashmir. A constitution bench was set up to ascertain the legal validity of the government’s decision to remove the special status given to the said status. The apex court ruled in favour of the decision of the union government taken in 2019 which led to the abrogation of Article 370, and stated that the decision was taken aptly.
3. Parliament Security Breach
On 13th December 2023, the Parliament of India witnessed a security breach wherein two persons entered the premises and used smoke bombs. The two persons jumped on tables and were later detained by the police. A total of five people have been arrested in the said matter and investigations are ongoing to uncover the purpose and objective behind the attack.
4. Manipur Massacre: Continuing Violence and Legal Intervention
On 25th September 2023, the Supreme Court stated that there must be a thorough investigation to find if there were any state officers who colluded in the violence taking place in the state. It was also stated that as much as the court is unsatisfied with the state of affairs, it cannot take over the state administration. The apex court also stated that the legal rights of advocates from appearing in the court must not be curtailed.
5. 28% GST levied on Online Gaming
On 11th August, 2023 the Parliament approved of the 28% GST (Goods and Services Tax) to be levied on online gaming. These amendments relate to the Integrated Goods and Services Tax (Amendment) Bill, 2023, and the Central Goods and Services Tax (Amendment) Bill, 2023. This action of the legislative council is in parlance with the decision made by the GST Council in its 51st meeting which was held on 2nd August 2023. The ideology is to provide clarity on the taxation of these specific sectors.
6. Supreme Court rules against the Plea for Legalising same-sex marriage
On 17th October 2023, the Supreme Court through a 5-judge constitution bench refused to legalise same-sex marriage in India. However, it has left the matter to be legislated upon by the Parliament. While all the judges of the constitution bench agreed to the fact that the discrimination against same-sex couples must be brought to an end, they also stated that the matter of allowing their marriage is a legislative subject and thus must first be dealt with by the Parliament. The Special Marriage Act, 1954 needs to be amended in that regard, as was the plea of the petitioners. They stated that Articles 14, 15, 19, 21 and 25 are violated by the SMA, 1954.
7. Removal of Air Traffic restrictions in Agra: Taj Trapezium Case
On 4th February 2023, the Supreme Court removed the restrictions imposed on air traffic as per which the traffic had to be reduced and limited keeping instead of the protection to be granted to the monument that is: the Taj Mahal. In the year 2019, the apex court had ordered the construction of a new terminal at the Agra Airport, however, it had also added that there mustn’t be a resultant increase in the air traffic. The same restriction, however, was removed this year in February.
8. NTPC’s Requirement of clearing CLAT for Assistant Law Officers: Question forwarded to Supreme Court
On 3rd January 2023, the question about the validity of the condition as imposed by National Thermal Power Corporation Limited (NTPC) for clearing CLAT (Common Law Admission Test) to become Assistant Law Officers in the Public Sector Undertaking being itself, was forwarded to the Supreme Court by way of appeal. Before that the Kerala High Court ruled in favour of NTPC stating that it has the right to ascertain the eligibility and recruitment conditions.
9. Anusandhan National Research Foundation Act 2023 passed by Parliament
On 7th August 2023, the bill was passed by Lok Sabha. This act seeks to establish NRF (National Research Foundation) that will seed, grow and promote Research and Development (R&D) and foster a culture of research and innovation throughout India’s universities, colleges, research institutions, and R&D laboratories. The Department of Science and Technology (DST) will be the administrative Department of NRF which will be governed by a Governing Board consisting of eminent researchers and professionals across disciplines. The Act embodies the principles as enunciated in the National Education Policy (NEP) 2020.
10. Inauguration of India’s new Parliament Building by Prime Minister Narendra Modi
On 28th May 2023, post a seven-hour program held as a part of the inauguration program, the new Parliament building was made functional by India’s Prime Minister Shri Narendra Modi. The new Parliament building as inaugurated is a part of India's Central Vista Redevelopment Project. The same is situated in New Delhi. It is aimed at strengthening the governance infrastructure by redevelopment and renovation of India’s Parliament, thereby showcasing the renewed India which is an evolution of the traditional form.
11. Mitti Café inaugurated at the Supreme Court by CJI Chandrachud to encourage inclusivity
On 10th November 2023, Chief Justice of India that is Justice DY Chandrachud inaugurated ‘Mitti Café’ and by that, he sent out a message of inclusivity. The café which has been set up in the court premises, is run and managed entirely by persons with disabilities. Alina Alam is the founder of ‘Mitti Café’ and her idea was endorsed by Senior Advocate Priya Hingorani who suggested that one such café must be opened in the Supreme Court’s premises. It is a social initiative aimed at providing employment opportunities to the disabled.
12. The Digital Personal Data Protection Act, 2023 passed by Parliament
On 11th August 2023, the Digital Personal Data Protection Act, 2023 came into force to provide the processing of digital personal data in a way that does not infringe on the right to privacy of individuals but also provides relevant access to the data for lawful objectives. Moreover, this is a revolutionary enactment as it is the first time that in an Act, both the pronouns, that is ‘she/he’ have been used.
13. Introduction of the Telecommunications Bill, 2023 in Lok Sabha
On 18th December 2023, the Telecommunications Bill, 2023 was introduced in the Lok Sabha. The bill is crucial as it seeks to repeal the Indian Telegraph Act, 1885, the Indian Wireless Telegraphy Act, 1933, and the Telegraph Wires (Unlawful Possession) Act, 1950. The bill seeks to regulate all activities that are related to the field of telecommunications. The bill also amends the Telecom Regulatory Authority of India (TRAI) Act, 1997.
14. Rejection of plea by Supreme Court to ban Pakistani Artists citing ‘cultural harmony’ as a reason
On 28th November 2023, the Supreme Court stated that it shall not allow the appeal which primarily seeks to ban artists hailing from a particular country for the sole reason that they belong to that country. The apex court stated that in today’s scenario, it is of utmost importance to maintain cultural harmony and so doing this would only instigate violence and hatred among the two countries’ populations.
15. Strike down of 75% domicile reservation in Haryana by Punjab and Haryana High Court
On 17th November 2023, the Punjab and Haryana High Court stated that the domicile reservation quota of 75% introduced by the Haryana government in the private sector is discriminatory and so the same was struck down by the said court. The court cited that the same is violative of the constitutional principles which demand equality of opportunity for all.
16. Supreme Court admits plea to examine if transgender women can claim under Domestic Violence Act, 2005
On 2nd November 2023, while hearing a plea against the Bombay High Court judgement which stated that if a person has identified as a ‘woman’ then naturally they are covered under the definition of ‘aggrieved person’ under Section 2(a) of the Domestic Violence Act, 2005. The same shall be decided by the Supreme Court in January of 2025.
17. Competition Amendment Act, 2023: Amendment made to a decade-old law
On 3rd April 2023, Competition Amendment Act, 2023 was passed. The Act has made significant changes in the principal law such as a change in the definition of the word ‘control’ which now also includes ‘material influence’ over the management, affairs or strategic decision-making. The amendment has also reduced the timeline for the implementation of a combination from 210 days to 150 days. Moreover, if CCI does not approve/ pass its opinion on a combination within 30 days, the same shall lead to the combination being deemed approved.
18. Introduction of Mediation Act, 2023
On 15th September 2023, the Mediation Act, 2023 received Presidential assent. The Act seeks to recognize pre-litigation mediation, and online and community mediation and encompasses the term "conciliation" to align with international practice. The provisions also encompass the enforcement of domestic mediated settlement agreements. ‘Mediation Council of India’ has been established by this Act to streamline the functions as proposed to be performed under this Act.
19. Advocates Amendment Act, 2023 passed by Lok Sabha
On 4th December 2023, the Lok Sabha passed the Advocates (Amendment) Act, 2023 which seeks to amend the Advocates Act of the year 1961. The amendment act is important as it covers the following aspects about instructing certain courts to maintain and prepare a list of touts. Along with the preparation of lists the amendment has also mentioned provisions for providing for penalty to such touts respectively.
20. The Supreme Court has ruled that Consumer Disputes are non-arbitrable
On 5th October 2023, the Supreme Court stated that it is not appropriate to compel consumer disputes for arbitration based solely on the fact that consumers are part of an arbitration agreement. This order of the Supreme Court has thereby reaffirmed the importance of consumer protection in disputes and preserves the right of consumers to address their grievances.

This is one of the major current legal issues in India. The government banned 59 Chinese mobile applications to counter the threat posed by these applications to the country’s “sovereignty and security, “as per a press release shared by the Indian government in June 2020. Several popular apps such as TikTok, WeChat, Helo, ShareIT, Clubfactory, etc. were included in the list. The press release also mentioned that the applications are “prejudicial to sovereignty and integrity of India, defense of India, the security of the state and public order” by exposing sensitive user data to malicious third parties as per investigations conducted by the Indian Cyber Crime Coordination Centre.

Experts predict that with the ongoing Ladakh stand-off between the two countries and the bold move of banning Chinese originating apps, the diplomatic ties could suffer. However, tech start-ups across the country have rejoiced the news and plan on bringing more customers with aggressive marketing efforts.
However, the youth of the country as the exhaustive user base of the popular app TikTok is not happy and so are the Tibetans based in the country who used WeChat to connect with their families back home. Interestingly, a few of these apps have already been taken down from Google Play Store and Apple App Store.

2. Kulbhusan Jadav refuses to file review petition
Kulbhushan Jadhav, ex-Indian Navy officer, has refused to go for a review petition over his conviction, as per Pakistani officials working on his case. As per the Pakistan Additional Attorney General, Jadhav, who has received capital punishment in charges of espionage, has decided to his pending mercy plea instead. However, there are claims suggesting coercion.

Interestingly, the International Court of Justice, in its July 2019 verdict, has ordered Pakistan to review Jadhav’s death sentence citing that Pakistan “deprived the Republic of India of the right to communicate with and have access to Mr Kulbhushan Sudhir Jadhav, to visit him in detention and to arrange for his legal representation”. Following this, India gained consular access to Jadhav in September 2019. As per the deadline set by Pakistani officials, Jadhav has time till July 20 to file an application petition against his conviction and sentence in the civilian High Court.
3. Online classes worry students across India
For a developing country like India, online learning is not possible due to an obvious lack of infrastructure and technology. Since the coronavirus crisis hit India earlier this year, students across the country have been struggling to carry on with their studies. Private institutes and state governments have been favoring online classes to proceed with this year’s academia. However, economically poor students are unable to join the classes conducted through any online platform. However, some of the elite institutions of the country such as IITs and IIMs want to conduct online classes and exams. Their decision has triggered an immediate backlash from large sections of their students, including the teachers’ association.

On the other hand, CBSE has reduced its syllabus by 30% for classes 9 to 12 while cancelling the 10th and 12th standard board exams. The students will be graded as per their last internal assessment exams .
4. Indo-china Ladakh standoff continues
Even after a series of talks meant to de-escalate the red flag situation in Ladakh, the standoff between India and China has entered its third month. In May, the standoff began as Chinese forces objected to road construction in the Galwan River valley. Consequently, a melee between the forces on June 15-16 resulted in the death of 20 Indian and 43 Chinese soldiers. Following this, there has been a fierce campaign to ban Chinese products in India.
Experts predict the skirmish to be the result of the development of Indian infrastructure in the Ladakh region, the growing relationship between India and the USA, and the revocation of the special status of Jammu and Kashmir by the Indian government in August 2019.
Although high-level quiet diplomacy between the countries continues to calm the situation, media reports suggest the ground situation remains disturbing. There are chances that the Chinese side will abide by current talks and start pulling back troops from the disputed region, the Indian forces continue to remain vigilant.
5. Yes Bank Scam
On March 2020, the RBI, financial regulatory body of India, placed a moratorium on the Yes bank. The RBI cited the bank’s deteriorating financial health for the decision. However, there was soon panic amongst the account holders as RBI placed a cap on withdrawals at Rs 50, 000.
Back in 2015, global financial firm- UBS- raised the first red flag in a report. The report stated that Yes Bank has loaned more than its net worth to companies that are unable to make payment. Ignoring the red flags, the bank continued business, as usual, quickly becoming fifth-largest private sector lender.
The bank issued more than 25% of the loans to non-banking financial companies, real estate, and construction. This resulted in a build-up of toxic assets. Despite previous warnings from RBI, the bank continues its modus operandi. With the falling of the bank’s share prices, investors pulled out Rs. 18, 000 crores between Apr-Sept 2019.
As per its Yes Bank revival plan, the RBI has allowed 49% stake to be acquired by SBI. Yes Bank founder, Rana Kapoor, is under ED custody and the matter is more likely to be resolved in a court.
6. “Self-reliant India” in a COVID ridden world
Indian Prime Minister Narendra Modi called India to be “Atmanirbhar” or “self-reliant” on 12th May 2020. This data is enough to support the claim of the Prime Minister kickstarting the program. While leaders claim that the government has started reinforcing the idea of a self-reliant India speedily by implementing many of the measures , there is still no visible impact on the economy.
While the plan may sound robust, the finer details of the execution still need sorting out. As per the scheme, the government has already distributed credits worth Rs. 1.10 lakh crore to Micro, Small and Medium Enterprises. These industries were primarily affected by the pandemic and shutdown. However, there remains a major chunk of the industry waiting for revival. Same is the case with other measures announced under the scheme.
7. Rising demand for legal-tech start-ups
As the Coronavirus confines people to their houses, netizens are welcoming online solutions to so-called physical problems. Legal matters, traditionally associated with office visits and physical meets, are sorted out online. People under any kind of legal distress are looking for options to gain legal consultation instantly. Most of them are seeking legal advice related to divorce, property disputes, and financial issues. Taking advantage of the situation, local legal-tech start-ups have started to offer online consultation with a minimal cost.
Similarly, lawyers wary of physical proximities are looking for ways to take their practice online with the help of established software. With regular judiciary services under strain, legal tech might just be the answer to the current problem.
