Protecting Employees from Workplace Hazards • Employers must protect employees from workplace hazards such as machines, hazardous substances, and dangerous work procedures that can cause injury • Employers must: • Use all feasible engineering and work practice controls to eliminate and reduce hazards • Then use appropriate personal protective equipment (PPE) if these controls do not eliminate the hazards. • Remember,PPE is the last level of control! OSHA Office of Training and Education

Payment for PPE When PPE is required to protect employees, it must be provided by the employer at not cost to employees, except for specific items, such as: • Safety-toe footwear, • Prescription safety eyewear, • Everyday clothing and weather-related gear, and • Logging boots(See 72 FR 64341, Nov. 15, 2007) OSHA Office of Training and Education

Establishing a PPE Program • Sets out procedures for selecting, providing and using PPE as part of an employer’s routine operation • First -- assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of PPE • Once the proper PPE has been selected, the employer must provide training to each employee who is required to use PPE OSHA Office of Training and Education

Training Employees required to use PPE must be trained to know at least the following: • When PPE is necessary • What type of PPE is necessary • How to properly put on, take off, adjust, and wear • Limitations of the PPE • Proper care, maintenance, useful life and disposal OSHA Office of Training and Education

What are some of the causes of eye injuries? • Dust and other flying particles, such as metal shavings or sawdust • Molten metal that might splash • Acids and other caustic liquid chemicals that might splash • Blood and other potentially infectious body fluids that might splash, spray, or splatter • Intense light such as that created by welding and lasers OSHA Office of Training and Education

Safety Spectacles • Made with metal/plastic safety frames • Most operations require side shields • Used for moderate impact from particles produced by such jobs as carpentry, woodworking, grinding, and scaling OSHA Office of Training and Education

Goggles • Protect eyes, eye sockets, and the facial area immediately surrounding the eyes from impact, dust, and splashes • Some goggles fit over corrective lenses OSHA Office of Training and Education

Welding Shields Protect eyes from burns caused by infrared or intense radiant light, and protect face and eyes from flying sparks, metal spatter, and slag chips produced during welding, brazing, soldering, and cutting. OSHA Office of Training and Education

Laser Safety Goggles Protect eyes from intense concentrations of light produced by lasers. OSHA Office of Training and Education

Face Shields • Protect the face from nuisance dusts and potential splashes or sprays of hazardous liquids • Do not protect employees from impact hazards OSHA Office of Training and Education

Safety Shoes • Have impact-resistant toes and heat-resistant soles that protect against hot surfaces common in roofing, paving, and hot metal industries • Some have metal insoles to protect against puncture wounds • May be designed to be electrically conductive for use in explosive atmospheres, or nonconductive to protect from workplace electrical hazards OSHA Office of Training and Education

Types of Gloves Norfoil laminate resists permeation and breakthrough by an array of toxic/hazardous chemicals. Butyl provides the highest permeation resistance to gas or water vapors; frequently used for ketones (M.E.K., Acetone) and esters (Amyl Acetate, Ethyl Acetate). OSHA Office of Training and Education

Types of Gloves (cont’d) Viton is highly resistant to permeation by chlorinated and aromatic solvents. Nitrile provides protection against a wide variety of solvents, harsh chemicals, fats and petroleum products and also provides excellent resistance to cuts, snags, punctures and abrasions. About Handwashing

• Many diseases and conditions are spread by not washing hands with soap and clean, running water.
• Handwashing with soap is one of the best ways to stay healthy.

Why it's important

Washing hands can keep you healthy and prevent the spread of respiratory and diarrheal infections. Germs can spread from person to person or from surfaces to people when you:

• Lather your hands by rubbing them together with the soap. Lather the backs of your hands, between your fingers, and under your nails.
• Scrub your hands for at least 20 seconds . Need a timer? Hum the “Happy Birthday” song from beginning to end twice.

• Dry your hands using a clean towel or an air dryer.

Use hand sanitizer when you can't use soap and water

Washing hands with soap and water is the best way to get rid of germs in most situations. If soap and water are not readily available, you can use an alcohol-based hand sanitizer that contains at least 60% alcohol. You can tell if the sanitizer contains at least 60% alcohol by looking at the product label.

Cancer is a leading cause of death among firefighters. That's why one local department is ramping up its efforts to protect members.

"Firefighters, in general, are 13 to 14 percent higher risk of contracting some sort of cancer than the average Joe-shmo off the street. It's a dirty secret in the fire service. Not a lot of people talk about it. But we're to the point now where we can't hide it or brush it under the rug," said Chief Bill Jeffcoat.

Jeffcoat is the chief of the Penn Hills No. 7 Volunteer Fire Department. He says in the station's 75-year history, six firefighters have been diagnosed with cancer.

"When we respond to a fire, whether it's a house fire, a car fire, the smoke that you see coming off the car or coming off the house, that's all incomplete combustion. Those are all cancer-causing carcinogens. Our firefighter's gear eventually, at some point and time, turns into a sponge and holds those carcinogens in and expose us, unnecessarily expose us, to those carcinogens," Jeffcoat said.

Sadly, two of those firefighters died from cancer. It's why Jeffcoat and his fire station sounded the alarm and reached out to Sen. Jay Costa, requesting funding for better aid and protection.

"This shouldn't be something that is something for one station, this should be something that every single fire station, everybody, whether you are career or volunteer, should have access to," Jeffcoat said.

The station was granted $50,000 from the Department of Community and Economic Development for the following necessities: a personal protective washer/extractor, dryer, ultrasonic cleaner and a firehouse washer/scrubber were all purchased.

The washer/extractor has settings to clean and sanitize gear that has been exposed or contaminated. The dyer will have that gear ready to go in just two hours, as opposed to a couple of days when, normally, firefighters would hang out their gear to dry. The ultra-sonic cleaner sanitizes various pieces of equipment like helmets and boots, and the fire house washer/scrubber will provide it a deeper clean.

Costa told Pittsburgh's Action News 4 that the number of volunteer firefighters are dwindling.

"We have to do everything we can to protect and ensure that we have a good volunteer base in each of our communities along those lines," Costa said. It's why finding this funding was so important to him.

"They need to be provided with the most appropriate equipment possible and that's what I try to do with local firefighters that I work with," Costa said.

Jeffcoat said one of our most valuable assets is firefighters. And this grant is just one way they can be taken care of. He expressed his gratitude for this grant, saying it will pay dividends to its members and the community. But he also said it shouldn't stop there.

"And that's why it's imperative that we find ways to provide them additional state support to allow them to be able to operate and work to make sure they have the best protection possible," Costa said.

Ponte Vedra Beach Man Indicted For Fraud Scheme Involving COVID-19 Personal Protective Equipment

Jacksonville, Florida – United States Attorney Roger B. Handberg announces the return of an indictment charging James Elliott Davis II (35, Ponte Vedra Beach) with 16 counts of bank fraud, 12 counts of wire fraud, and 1 count of money laundering and theft of mail. If convicted, Davis faces up to 30 years in federal prison for each count of bank fraud, up to 20 years in prison for each count of wire fraud, up to 10 years in prison for the money laundering count, up to 5 years’ imprisonment on the theft of mail count, and payment of restitution to the victims he defrauded.  

According to court documents, from March 2018 through 2022, Davis ran a purported medical supply company named Medisale, Inc. By using false representations, Davis enticed individuals and business entities to invest over $7 million in Medisale. He falsely represented to victim-investors that Medisale was making significant profits on the sale of COVID-19 Personal Protective Equipment (PPE). He claimed to have contact with CEOs at various hospitals and that Medisale had contracts with hospitals to sell large volumes of N95 masks and other PPE. As part of his sale’s pitch, Davis showed bank statement with large balances, claiming the money was from the sale of PPE.

In reality, Medisale had no such contracts and had no true revenue from the sale of PPE. Davis kited checks and conducted fraudulent ACH/wire transfers between multiple financial institutions to artificially inflate the apparent balances on his bank accounts. Utilizing victim-investor money, Davis paid off previous debts, paid other investors purported profits from the sale of PPE, and paid for personal expenses. This included Davis using victim-investor money to purchase a membership at a luxury club in Ponte Vedra Beach and spending more than $27,000 on custom clothing.

An indictment is merely a formal charge that a defendant has committed one or more violations of federal criminal law, and every defendant is presumed innocent unless, and until, proven guilty.          

This case was investigated by the Federal Deposit Insurance Corporation - Office of Inspector General, Florida Department of Law Enforcement, and the Internal Revenue Service – Criminal Investigation. It will be prosecuted by Assistant United States Attorney Kevin C. Frein.

Worker safety groups sue EPA over chemical evaluations

At least three worker safety groups have launched lawsuits against EPA’s final chemical risk evaluation rule, alleging the agency’s language overly relies on assumptions about personal protective equipment, or PPE.

Worksafe Inc., a California-based nonprofit, the International Association of Machinists and the United Steelworkers — also known as the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union — filed complaints against EPA in the U.S. appellate courts for the 9th, 4th and D.C. circuits, respectively.

EPA’s final rule lays out a framework for how regulators risk reviews for chemicals under the agency’s extensive review process under the recently revamped Toxic Substances Control Act.

The Biden administration’s framework varies in a few key areas from the Trump administration’s framework, which the 9th Circuit tossed in 2021 . EPA’s chemicals chief vowed this new framework would not assume that workers have adequate access to PPE while assessing risks, but the workers unions argue the rule offers too much leniency during the determination process.

This case was investigated by the Internal Revenue Service Criminal Investigation (CI), the Federal Deposit Insurance Corporation - Office of Inspector General, and Florida Department of Law Enforcement. It will be prosecuted by Assistant United States Attorney Kevin C. Frein.

CI is the criminal investigative arm of the IRS, responsible for conducting financial crime investigations, including tax fraud, narcotics trafficking, money-laundering, public corruption, healthcare fraud, identity theft and more. CI special agents are the only federal law enforcement agents with investigative jurisdiction over violations of the Internal Revenue Code, obtaining a more than a 90 percent federal conviction rate.
